It would be fair if spillover numbers are equally divided between EB2 and EB3 retrogressed country so both category can get equal relief.
Any thoughts?

PlainSpeak...F1 are not burden to US, they pay big college fees for the education.
You know who is real burden, thats H4 visa holders like you. who have nothing to do. they just sit home eat and fight.
you are a classic example of burden to the society.. you are spending all the time here and fighting with everyone.
if anyone starts talking about anything, you just come and start fighting.

Wonder full now EB2 is against H4 visa also beside BE3 ?

Please stop taking out the frustrations on IV. It is very easy to do. All you need to do is write a post. But doing some real action is the challenge.
We are all like you and in this together. We try to create action items and guide and try to lobby within our limited time, energy and means. Everything else is dependent on members. If members contribute funds we lobby hard. If members are not even willing to contribute $5, and we can only get less than 5K in more than 2 months, how can we accuse core? If members write letters to administration or USCIS, call lawmakers, meet lawmakers etc that directly helps everyone. Members need to involve their big employers and have them contact administration and local lawmakers. We all need to contact media and raise awareness. We all need to create publicity of this effort so that more people can join it and make it successful. We will help you all the way in this effort. Come and travel to DC with all your state chapter members and meet officials. Try taking part in conference calls, answer emails and calls from all kinds of members and non-members, media outreach and mundane official work of IV yourself during office hours and you will see how difficult it is to manage this for IV team.Take days off from your work spend your own money on travel and hotel and visit offices and talk to lawmakers in DC. We will help you with the meetings. IV core has been doing that and we get such brickbats through such posts.
Just accusing IV, writing posts about ideas or action, and asking IV to wake up will not solve anything. This is a community effort and each IV member is responsible for the failure or success. IV leaders already devote lot of time from their professional and personal life on this effort. Individual members need to step up if they want more and take it upon themselves to get active.
I am sorry to say this Pappu, but honestly I do feel one thing. There are some things that IV can do without spending money(which I think are not being done). For example, it can lead everybody everybody to send letters to USCIS and congressmen and the press for justice highlighting abrupt actions of USCIS. I made so many pamphlets in the thread "Lets get Organized" which can be sent alongwith to make an impact. It is not about eb2 or eb3, it is about accountability and transparency from USCIS. It does not involve any money from anybody excepting a 41 cents stamp on the letter which I think most of people should be ready to spend. However, the push from IV seems to be missing.

Very sorry to know about the nanny situation. I would not recommend taking any legal action on that nanny because you are not supposed to hire her in the first place. So if you do complain about her, it is going to back fire on you, saying how did you hire her in the first place.
It is really horrible how a person can have heart to beat a small baby. Also she is not supposed to work on a tourist visa, if someone complains she can be deported.
I would suggest the following, just terminate her asap and try to use some local nanny who has proper papers to work. (since any way you are paying the same amount).
If you had hired someone who had proper papers, and if they had committed this , i am very sure you can take them up legally and make sure they do not do this again to someone else. But in this case it is a bit complex as you too may get in to trouble for hiring her.

Hi, I'm very tensed. I applied for H-1B under master CAP. I have finished all degree requirements including depositing PhD thesis. However, at the time of filing I could not wait for a letter from the registrar (it takes 5 business days).
So, I filed with a letter from my dept. The letter has the letterhead of the university and states that I completed all degree requirements and will graduate May 13th. It is signed by the dept associate dean.
Would that suffice? Could the petition be denied?
I have seen some denials but all for ppl who hasn't actually completed all requirements at the time of filing.
The petition was filed under regular processing, VSC. I got a receipt notice dated April/24. Online status still shows case pending.
Thanks for any replies.
What was the date on which you filed. I think you should be fine. I did it the same way and got the letter from the Grad School. Mine was filed on 23rd. I haven't received the receipt yet!! dunno when it would come in!! this delay sucks!

I just talked to a NSC representative and he told me that my case is sent to extended review. Now what is this extended review?
Well, what annoys and confused me is that when I took Info pass day before yesterday she told me that my case is with IO. And now NSC rep is giving me another version called extended review.
Don't know whom to believe.
Does anyone here had same exp.
I talked to a TSC rep a couple days back and she told me that my case is under review. When pressed what it meant she told me I have to wait for some more time before action is taken on my case:confused:

We understand retrogression is due to non availability of visa but we will have some comfort factor, if we know un-used visa# that may move PD...
Anybody have any statisctics on unused visa# for last couple of years?
Thanks in advance..
Has anyone got an idea of unused visas from EB1 and ROW EB2?
It just can't be right the EB2 movement for India and China is hardly moving since EB1 is current and EB2 ROW is current since 6-10 months.
Which category does the unused/overflow visas go?
None of the lawyers I emailed have an answer (they like this retrogression btw more $).
USCIS doesn't care if a non citizen asks a question.

Did anyone get refund back?
Did any US-MS get refund back?
From immigration-law.com:
04/06/2007: What Does Refund Checks from USCIS for FY 2008 H-1B Cap Filing Mean?
There are a growing number of reports from the H-1B cap filers beginning from late yesterday that they started receiving "refund" of filing fees from the CSC or VSC. These are the cases of the petitioners whose filing fee checks have been cashed by the Service Centers. We do not know whether this news implies that the USCIS has completed the job of sorting-out and data-enties for all the cases and the random selection process has commenced. Assuming otherwise, one wonders how they have decided that these cases have been not selected and the filing fees should be refunded. There are two theories as to how the random selection would be conducted. Obviously, the entire cases should be data-entried before they can start a random selection process. Otherwise, the random selection process will be not scientic and too arbitrary. But no one knows. One theory is that in order to make the data entries, they should take the filing fees and the payment of these fees will have to be refunded for those which fail to make it. Other theory is that the checks will not be deposited until the selections are made. Currently the process of random selection remains a mystery. However, the fact that refund checks started being mailed out may indicate that the first theory is more likely than the second theory, and there is a possibility that the random selection is made by the computer during the process of data entry rather than after completion of data-entries of the entire cases. Since they had only opened and sorted out a little over 34,000 cases, it may be hard to believe that yesterday they could have completed sorting out of the entire remaining cases in one day. Please stay tuned to this website for the development of H-1B lottery results.

I have a problem where my "Given Name" is entered as "<first name> <last name>" in my passport (India). The "Surname" is left blank. I have been in the US for 7 years now and it has never been a problem so far. I usually enter the "<last name>" in the last name column on all documents. I wonder if this will cause problems during the I485 name check stage. Any one here who can throw some light on this issue?
I realize that the question is a little weird, I appreciate any response.
Thanks
I have a similar problem with my name in the passport being not broken as first, last and middle. I never had any issues until an immigration officer pointed it to me while extension visa stamping. As it was hand written in the passport I just mentioned that it would have been an error and I really don’t have time to get it corrected. She gave me a stare and let me go at that time.
I filed my I-485 and had no issue with anything including name check which I assume got cleared. My passport is expiring soon may be I'll get it sorted out at that time. I hope this helps.
