But, sherman has a point....
1. Why do we put up with the inefficiencies of the American Govt?
2. Why do we sit down and accept what is given to us instead of asking for what we want/ desire?
3. Why do I hear - "I am not interested in protesting" or "I don't have the time" from folks that are paying a high price due to retrogression?
We are LEGAL, tax paying, resident aliens that are contributing to the economic growth and not siphoning off government funds. Don't we deserve better?
Why were there 100's of thousands of faxes sent by NumbersUSA (aka Sherman and gang) while all we could muster was a meager 20000? Where are the rest of the 1.2 million EB applicants?????
Its time we stood up and showed them our strength. We have the numbers- we just need the strenght and courage to stand up for our convictions.

- Get a letter from your Advisor and your Internaltion Student Concil Mgmt
- Try to look for a H1 sponsor organization who will wait for you till Oct, 2008
- Try not to get a job in non-profit org/universities in exempt H1, later your will be subjected to H1 cap if you try to txfr to for profit company

Thanks for the IV core team, and all others who helped to achieve this victory. I am just couple of days old member on IV but realized the importance of supporting IV for addressing the issues concerning our immigration community. I also contributed my donation as a token of my support. IV rocks!
Thanks a lot to all members for being with us in this struggle. We have tasted our first big success this year. Credit goes to each and every IV member. We were all affected by the visa bulletin fiasco and this is our victory. This is a victory for all our members and we must rejoice.
IV had worked very hard and had been pushing for this in the background. Our flower campaign, rally and other advocacy efforts all came together and helped us at a crunch time. We thank members that sent flowers and also walked in the San Jose heat for 4 hours. All that really shows our commitment to this cause.
We are happy that our efforts are successful and IV has been able to make a difference. Please also know that during this effort, IV was extremely active and decision makers heard our voice. We cannot give out all the details but what IV members should know is that these efforts should make each one of us proud and what we can do if we have a firm resolve. We were also the first to break this news even before anyone else or media could, and continued to update our members as time passed.
IV also thanks its contributing members and it is because of their contributions we were able to continue this effort. Many thanks to the members that are contributing now after this good news.

Currently NSC processing time for employment based 485 is 15th Sept. 2007... My notice date is 18th Sept. 2007 (based on case status shown on USCIS site)
Looks like I am going to miss my GC by 3 days and wait till next year :mad: I highly doubt that dates will stay at 2005 during next month bulletin.. (I truly hope I am wrong!)
My PD is 12/04 and yesterday I learned they haven't even opened my case file. So for all these years it had been gathering dust. But that could be just my kismet and your might be different. Anyways, I am not looking for GC till 4th qtr 2010:cool:.

Dude if u didnt have I94 how did u you work all these days?
u should have got your I94 in chennai if u went for chennai
let me make it clear
as per my under standing if u didnt apply for change of status,then your h1 papers didnt have i94 attached with them when they were first released,they might have asked you to go for chennai for stamping
which u didnt am i right?

As i said earlier, i relied too much on my employer as istated to him in the first place to do a change of status Visa. They didn't do it, and as i was under the impression that i didn't have to go to India to get it stamped, i didn't leave the country so far and worked all these days. The ugly thing is that even my employer didn't ask me to go to India and get my Visa stamped in India, but he did find projects for me and produced pay slips all the time so far. Now, i found out the mess i am in, that too because i was ready to apply for I-140 and I-485 together. The immigration attorney who is preparing my I-140 caught my out of status situation and all the hell broke lose. Is there a way to seek an adjustment n my status from INS based on the fact that i was eligible for Chnage of Status from L-1 to H-1 in 2005, but mistakenly, i got a H-1 that was supposed to be stamped? Would they consider any such cases? Is there any example of anybody whoever did it???
And even if i leave the country now, would i face any problem in next three years, if i attempt to come to USA on a new H1 next year, with a new Visa?
Please provide me some advice if anyone knew any situation like this before?

This thread starts with a call to all the EB2 people. Is it only the EB2 people suffering due to USCIS actions? Or are EB2 applicants a distinguised lot that they dont want EB3 to join with them?
It is so depressing to see the attitude of some of these guys !!! There have been so many threads explaining the difference(or indifference) between the qualifications of the applicants.
The suffering has been equally bad or even much worse for the EB3 applicants. I am an EB3 2003 applicant and my suffering has been equally painful. The campaign should be about fair treatment to every applicant, not alone EB2 or EB3.
Any campaign will only be successful when we try to do something together.
If you yourself are belittling the EB3 applicants, why do you have higher expectations from the American Citizens/Government.

We are trying to address a specific issue, which is about blocking approvals when dates are current, and for that, we are using this current fiasco as an example. The USCIS memo specifically talks about EB2 india, china applicants on hold. Since EB3 was listed as U, we cannot do anything about it. If both EB2 and EB3 were current, I would have given a call to both. There is no belittling out here. the Circumstances are like that.
EB2 and EB3 are working together in the visa re-cpature.
This is a separate issue, but will be useful when visa re-capture is successful.
