My guess is that it will move a bit more faster than last year. Note that Apr 22 was the hump day (been dealing that that day right through labor certification phase), after that, the movement was steady. The Nov1 showing up twice is due to exhaustion of the numbers. I am expecting a steady march going forward.

I am sure we have many pplicants with PD in 2002 and 2003. I would be surprised if PD moves beyond April 2002 in FY 2009.

I don't think I agree completely. I called all of the lawmakers for the CHC campaign, and while you are right, I spoke to the assistants, they were all polite and promised to pass on the message, which is what matters in the end.
Lawmakers know that we do not have voting privileges yet, but they also know that we are contributing to this economy far greater than many. I do not remember the source or the thread, but this question was asked before about an online petition, but ironically, that is shown to be not as effective as phone calls.
If you ask me to sign a piece of paper, I might do it even if I am only vaguely supportive of the idea. But I will certainly not take the trouble to call (or better yet) go to the senator/congressman's office and present my case in person unless I really beleive in it.

That is exactly I was thinking. My first confusion was why the hell people want to check CP dates and create the false thread but then I realize they must not be around/ in the process to realize that CP dates != AOS dates. Some times CP ones equals but not always. Let's hope those equals to AOS dats this time.

When I call NSC they tell there status says whatever is on website, Only thing she did opened SR. And I have not heard anything on that....I took info pass ...same thing...The lady on NSC says she can not even see my Priority Date ..

And our community thinks that someone is listening to their phone conversation about how to raise money and lobby for the legal immigrants?????

We advice not to use this template and form. The message and the organization sending it for their advocacy agenda is very important. Even if you change the wording, people will hardly read the letter. They will look at the organization that sent it and its agenda.

I dont work for consultant and yet I relocated last year. I admit its less frequent when you work directly for a company. I work longer hours not because I am told to, but it makes me feel more secure in my job by doing so and by making myself more useful than neccesary. WHy? coz I cannot change employer and keep my greencard process intact and continual. Its has to be started from scratch. Not affordable. Hence the longer hours. Is it forced? No. Is it fair. Absolutely not.
Finding a local to marry is not an option. Why? Firstly, many of us are already married. Secondly and more importantly, if you marry a local with the intention of obtaining immigration benefits, you are breaking the law. I dont mean to say that marrying a local is wrong, but it is illegal if you are doing it only for immigration benefits resulting from marrying a citizen and you could lose that greencard if things go haywire. To quote Shushterman, an immigration lawyer and former USCIS employee: If you are caught doing something illegal by USCIS, you are better off robbing a liquor store than marrying a local with intention of greencard. USCIS may pardon you if you robbed a liquor store, and still give your greencard but not if you married a citizen with intention of immigration benefits.
Now, coming to rights and privileges, privileges wouldnt exist unless you had the rights. Privileges granted by Government to public are based on rights. The intent of the H1B program is not to bring people in the country in "Anticipatory mode" as you put it. The intent of the H1B program had always been for US employers to hire foreign skilled workers "On-Demand" when no american is willing, qualified or able to do the said job. Prior to 1999, the visa cap was 65000/yr WITHOUT the extra master's degree cap we have now, and still visas were never totally used up for any year, certainly not on the first day. It is only after the advent of the IT consulting companies hoarding visas in "anticipation" of future jobs that the problems started. Without any restrictions on this kind of abuse, no amount of H1 visa increase would be sufficient. They are talking of raising visas to 130,000 right? Based on the FY 2008 applications, those visas would be used up in TWO DAYS!
IMHO, the intent of the H1B program is equally important than just loopholes (or not) in the letter of the law.

The argument about anticipatory mode will not sit well with even most in this forum. The program is supposed to be on demand..If the visas are running out on first day, then the blame does go to the the anticipatory applications that eat up visas from actual engineers who have a job offers.
Sen Grassley is somewhat right...however, without any parallel reforms in the EB process, all his speech did was come across as simply anti H1. If he is really concerned about the H1 program and its potential benefit , he should be equally be concerned about the H1B employees who are in the EB Immi limbo. So far from his track record, I am not inclined to hold any hope that he will equally pursue EB reforms.

Do you really think that all EB3 people are no US-educated? EB2/EB3 is dictated by job requirements and not the actual qualifications of someone. I am graduate of a top ranked US university but applied in EB3 since my job didn't require M.S and my company didn't want to manipulate the job requirements.
I am sure there are many more like me who were qualified for EB2 but applied in EB3.
If this is the best you can come up, I really hope that this was your first and last post.

All of this nonsense .."i pray someone does something for EB3" is going to get no one anywhere !! Fight for comprehensive immigration reform or HR 5882 recapture BUT for god's sake Do not blame the EB2 - India people who have played by the rules and are in a favorable position today relative to EB3 !!

Please have some of these comments linked to the main page. But believe me "barking dogs seldom bite." Such people will ultimately sap your energy. Could you please let me know when was your visa appointment and how many days it took before you got your passport. Mine was 6th Dec and no update from consulate yet.
It took 7 working days for me to get the passport back. My wife also applied for H1B and it took only 2 days for her. I think it differs by case and how complicated your situation is. The reports in murthy said they should have every information after 2004 in PIMS database. Any query for the record before 2004 may not be present and it takes a couple of days atleast to update the database if a query is made. It's better if you have atleast 10 days time after the visa interview.
The officer questioned me about my employer in US during the year 1999-2000. So it is entirely possible that they may check your old H1s/L1s etc., So plan accordingly to avoid any further grief.

This might come as a surprise to some of you, but someone needs to say it out loud. GET A LIFE FOLKS!!!! there is more to life then EB, GC and all. it seem all we desi's can think of is how to get a green card so we can live here with peace and never have to worry bout getting laid off or anything.
Few points:
1) having gc is a privilege not a right.
2) US has every right to choose whom they want to have in their country.
3) If getting PR or citizenship of a western country is the goal there are many countries which have a fair point based system.
4) Considering the number of fraud's committed by Indian body shoppers and people who use them, i am not surprised USCIS is extra careful when it comes to Indian applications. Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing :)
5) have a back up. i came here in 2001 as student and have seen it all. I am on h1b since 2004. i knew we have too many people whose sole aim in life is a American GC. to avoid becoming one of those who check processing dates first thing in morning, i applied for Canadian PR, got it in 8 months and i am not even gonna bother applying for labor, i-140 and all those precious life controlling documents.
Wake up friends, you have options. Don't let your life depend on you application status.

Hi,
I am also struck in the same situation. My Interview was done on 7th Dec and so far I did not get the passport. Vfs website says "Your passport has not been handed over to VFS. I sent an email to 'ChennaiNIV@state.gov'. Got a reply that application is under process will be processed soon.

My appointment is 6th Dec 1400 hrs, and today consulate CSR confirmed that VFS will have the passport tomorrow. I will check with VFS tomorrow and let you know.

It seems that some of us want to fight, but don't have a dedicated thread. Instead we have been hijacking other useful threads.
What I propose here is a FIGHT THREAD.
Yes, this is a copycat idea from FIGHT CLUB
How we go about:
1.) Establish a dedicated thread - just for fighting.
2.) At a pre-determined time (of day or night), fighters login.
3.) They start fighting and all posts/fights will be restricted to FIGHT THREAD only.
4.) Fight ends at a specificed time.
5.) Fighters take a break until the next schedule (may be daily or thrice a week)
6.) Fighters donot desecrate other threads, if they do, they will be banned from FIGHT THREAD.

Lets lay down the rules.
Rule#1 There are No Rules
Rule#2 There shall be No Rules
Rule#3 There will be No Rules
Its freestyle.

Should I say that all of you those who bought homes and are having a life bought a home with 0% down and interest only loan so that you can save your taxes now and if your GC does not come through in 5 years, you will walk out with out any loss as you made hefty deductions and haven't paid single penny towards the mortgage and simply go to Timbuktu or Krakovia. I will not!.
Thanks for calling me a hypocrite with out reading the whole answer. I was just giving a hypothetical example on how one can talk about others life and practices in life sitting before a computer. Thanks for your clarification on whom you considered XYZ because lack of GC has stopped them from buying a home. I will respectfully disagree with your opinion that GC is not a non stopper for every one and there is a significant contingent out there who dont want to buy a home without a GC and consider it risk. Opinions differ and yours is taken. Again, You in the above hypothetical example does not refer to any one in person.
