As I had mentioned earlier, do not be under the misconception that just because you are working in a stable cash-rich comany and happy with your job, it can't get bad. Your company can move, downsize, close a branch or just fire you....given the current scenario, it will take atleast 5/6 years (if you are lucky and maybe more if you are unfortunate) to get a GC and all these years can go waste by any of the above happening

My GC process was started in 2001, my labor was approved in 2003 but since my company was closing the branch office where I worked, I had to move to the main office which was in a different state. Due to this my approved labor went down the drain. I moved to the state of the head office, meanwhile my company off-shored a major portion of the development office where I was working early 2005. After much persuasion from me the filed again but I had to either move offshore or take up a 90% travel job with the same company. Now, I travel and am away from my family during the weekdays. I have lived in USA for 6 years - legally paying my taxes, following all the laws and contributing to the society to the best of my abilities. I am currently on H1-B visa extension.
My wife is working for a company on H1-B. Her employer promised in mid-2005 that she would start the GC process for her so that we could have a backup. Till now her GC has not been started. My wife is in a dilemma of whether she should quit her job and join somewhere else. But if she does move to a new company, even they will not start her GC process immediately. Even if they do what is the point because of retrogression?
With the retrogression my GC could take years....sometimes I wonder if the stress, living in constant fear not knowing what is going to happen tomorrow, staying far away from loved ones, all these sacrifices is really worth it when legal workers like me who have contributed to the economy of America seem to have no value in this country.
Ragz4u if the above person process his labor application prior to april 2001 he should be qualified for 245(i).

Here is the dilemma.... The Idea is great...It can change our lives But if we sit on the idea for long it will rot So DO WE TAKE ACTION or LET US WAIT FOR CORE TO COME UP WITH SOLUTION. I would suggest we form a small committee or group of people who can brainstorm and come up with possible course of actions and then present the idea to core.
This is similar to House->Judiciary committee -> Immigration sub Committee
idea is to analyze the situation and come up with the best solution rather than waiting for
CORE to act on.

After all these posts your plan of action is to start a blog and send emails to Congress. :D
Is that all you can think of? I suggest you educate yourself first on how laws in Congress are changed. Talk to others who were able to change laws in Congress. Then find out how they did it, money they spent, time it took and people it took.
In this country if you want to do anything via congress you have to lobby. Tell me one bill in this country that was passed because someone created a blog and emailed congress.
Before laughing at others why don't you update your profile with your GC filing details??

Chanduv23 First - let me say I respect your outstanding and active contribution on this forum very much. Having said that, I'd say, you both conveniently missed the point in my post.
I am not arguing about who is ahead in the line to get the non-existent cake - please read my post once again and point it out to me where I said anything in such regard..
Frustration comes from the point that all the discussions take tone that all IV efforts are to help EB2 category alone. It is becoming frustrating for EB3s to keep reading posts and participating in actions when everyone keeps portraying IV effort as EB2 only effort.
I'd request you both to please read my post again.
All I have said is that message need to be made stronger that IV effort is for all EB community.
By responding with who's ahead in line type of comment you both are just ignoring the situation that already exists as of today on this forum wrt EB categories. I'd venture to say that if at all you're making that feel of eb3 left out even worse than it already it.

Like in the movies Rang De Basanti .. newer generation was compared to Freedom Fighters and like in Lage Raho Munna Bhai -we had Non Violence portest Heroes, I am seeing very comparble Heroes in the Immigration Voice Core team. Even during the recess, we were talking to the staff of a ton of senators. Most of the time the senators' staff are interested only if someone from 'their constituency' is also affected. We always say we have a ton of folks from each state, but nothing works like a real example.
For example, when we speak to say Senator Kennedy, it helps us to present the story of folks affected by retrogression and living in say Boston, MA. That way, the staff has some incentive to look into this and get hooked immediately.
Since time is short this time, we need all the stories from each state to make our case.
As promised, we will not reveal your story to media if you do not want to.
Though there is no harm to reveal one's name in media as can be noticed by the folks featured in the Roll Call article, Philly Inquirer and News Observer.
We will just concentrate on the crux how you are suffering because of delays such that even if your boss reads this story, he will not be offended or put off (Read our members stories in the three articles I have mentioned, none of it can get the IV members in any trouble at all).
At the same time we understand that you might have reasons to remain out of media and we will fully respect that.
But please send in your stories so we have a convincing story to make our case.....

I did write my story and then reread your first post, then thought to myself: my story is just similar to that Italian lady! The only thing different is she probably would have gotten her green card without much trouble, unlike my process.

what difference would it have made, if he just kept this to himself rather than disclosing it? how is getting this information out a great service to the people whose priority dates are current? its like saying, that guys...dont start dancing yet...its going to rain on your parade!

as many are aware, there was a huge rush to buy and sell pre-approved labors during july-august 2007, when all the priority dates were suddenly made current. Tens of thousands of labors were sold by fraudulent consulting companies to many questionable gc seekers, who hadn�t even started the process till then.
It is those substituted labors which are clogging the pipelines now. Just think, last month eb3-i stood at november 2001. Now it is completely unavailable. It can�t possibly be because so many pending labors with such old priority dates suddenly got cleared this month, and beneficiary of these labors filed 140+485 together. I seriously doubt that a candidate whose labor is pending since such a long time is even keeping that gc process alive. In all likelihood he/she must have moved on in life.
There is only one explanation. These labors were already pre-approved. It is the attached i-140 on these labors that are getting approved rapidly. And the subsequent i-485 petitions on these applications are depleting the visa numbers.
The reason of this post is not to start an argument about the ethics of labor substitution. It is just a fyi post to explain the seemingly inexplicable. The chickens are coming home to roost.

Jobs in America is for Americans. If at all it gets outsourced to your country then it is yours. But as long as that job is in my country, I will defend it and not let some Strive or Skill act take it away from me.
