If the Repubblican Senators will confirm its vote, the Filibuster will be impossible.
We will have 9 new senators, 7 dem, one Ind, and one repubblican.
Except the senator from Montana, all the news dems are favorable for the CIR., as well as the Indipent one. I don`t know about the new senator from Tennesse.
Also Kyl was talking about the original plan from Mc Cain (who will be a runner, which means that he needs the latino vote)-Kennedy, the one passed from the senate was little bit different. Let`s hope for the duck in anycase....

Do we really believe there aren't enough Americans to handle IT work in America?
yes. I honestly do. Having been through multiple recruitment attempts, at three different companies, in the bay area of all places: there are simply not enough qualified/interested american citizens available.
H-1b is not cheap labor. American companies prefer to hire H-1bs with US master's degrees or with substantial amounts of US experience. When they do hire foreigners, they do not discriminate against them by paying them lesser.
H-1bs are abused by desi vendors and the like who take advantage of the indenturing nature of the visa and also on the naivety of "fresh off the boat" people who newly arrive into the US and are unfamilar with US economy. They are starry eyed, still busy converting each dollar into their local currency and feeling happy they are earning relatively more and dreaming about paying off their EMIs back home, sooner. It takes quite a few months for them to settle down and understand US dynamics.

Lastly, we should not confuse the need for H-1bs as equal to the need for GC holders. Take the example of middle eastern countries. They use foreign labor, but they never grant them permanent status. That way, they do not get stuck with them in the event of a downturn. American could have chosen to follow a similar model. Use H-1b temps when necessary and send them out when they are expendable. They have no reaons to hand out GCs, like I said earlier. The benefit is all ours.
good point. However unlike the kind of work being done in the middle-east, there are a ton of companies in the US founded or co-founded by immigrants. There is a reason this place is called the land of immigrants. Handing out GCs gives these people options to start companies and many many of them do. this creates jobs, creates more intellectual capital, all within the US. In 6 years if you make a cook in Dubai leave and go back to Kerala (just picking a typical example) he is not going to do anything to compete with Dubai. You make these H1-Bs who have spent 6 years here (working on various products, technologies, ramping up, understanding customers, relationships etc) go back, they are going to start companies in India. Now all the capital stays out there. The same 5 products that could have been built in the US and sold to lots of companies abroad, will now have to be bought by the US.
If there is any kind of immigration that I think the US does not gain much from, its the diversity lottery and to an extend the chain migration that comes from family based immigration. EB immigration is a BIG win for the US economy.

This shows that the backlog is more than the numbers on USCIS website. People need to stop wasting time on tracking and spend time in their office work. Backlog means more business money for lawyers and trackers. IV is very small. Unless IV had hundreds of thousands of members, they cannot do lobbying like AILA or Microsoft. EB3 India and now EB3ROW is in a pitiable state. All those EB3ROW who used to be happy will now see the reality. Thank god I ported to EB2 but the dates for EB2 do not move enough. I think anyone who can should port to EB2 ASAP. This is the only solution.

a) Most banks have wiring fee ( $45)
b) You must fill up a wire application every time.
c) The bank which waived Wire Fee (suppose BOA ) sometimes convert $$ to Foreign currency right here at US,there by drastically reducing the Exchange Rate (once again they are private banks - we can't dictate their exchange rates)

Every one keeps talking of "H1 Transfer" there is no such thing... every time someone files a H1 Petition on your behalf it is a new H1 Petition the only thing that changes is the length of the approval period. The period already used in previous H1b employments is deducted.
Now as far as the I94 and AP, as someone said earlier, when you use AP, you are parolled into the US. Similarly when you apply for H1 you get a new I94 along with the approval notice. This resets your status to H1b with I94 validity set to the length of approval period

Anyone thinking that there will be a bill passed in near future that will overhaul skilled immigration process needs a reality check. Now I am not discouraging anyone from trying, I am also suffering through this mess and in no better position. The reasoning behind my assumption is following:
1. Lawmakers serve America and Americans. In theory anything that passes must look like it is serving their interest. Most laws/actions MUST look like it is helping Americans directly or indirectly, more so in an election year. That's why with less than 60 days for election it is not wise for them to spend time in enacting and debating laws that helps immigrants. It simply makes no sense.
2. You can argue that helping skilled immigrants will help America greatly and there is an urgency to enact such laws. Unfortunately no matter what media says, there is no such urgency seen by either law makers or their advisers. The reason, being there is no mass exodus for skilled immigrants, I know a few who have gone back but most of us are still here waiting for visa bulletin evey month hoping that some miracle will happen some day. Even if there is a mass exodus, there are enough people in India/China/Eastern Europe who will be more than happy to be here and do whatever we are doing. Simple law of numbers.
3. It can also be argued that America is not producing enough talents in Science and technology and hence we should throw a red carpet to anyone who can buy his way through the MS program from an American university. Unfortunately for us, a lot of us are doing mundane jobs and do not make a big impact in the economy the way techies used to be in late 90's. The best and the brightest are well taken care of (read: EB1/NIW) even today, for the rest us there isn't a desire nor a need to expidite the process in any manner. It will only help us, and we don't matter.
4. There isn't much shortage of skilled professionals, definitely not of the proportion that 65,000 visas are gone in 2 months. The only shortage I see is of numbers of "Visas". Although it is hard to find good people in technology but that problem cannot be solved by making that number higher. I am not sure what's the reason.
So what can we do ?
In short we are just a John Doe seeking better life which unfortunately isn't there in our home country. We should enhance our Skills (NOT skill bill) and help ourself to do well in anywhere. One thing is use 3 years extensions to chnage jobs and do well.
We can also align ourselves with H1B lobby/Healthcare lobby and request to file I-485 without visa numbers. That will at least stop some of the indentured servitude and our spouses can work.

Why should an H1B pack his bag in zero days when he loses his job ? ( He doesn't even get time to sell his house, take care of his kid's education etc)

For all practical purposes, the date on which it was recieved is your RD=> Receipt Date. The postmark date has no relevance except for records unless USCIS explicitly states so ( which it did once in 2001 http://www.uscis.gov/propub/ProPubVAP.jsp?dockey=89a5f3cee754ad0499e55e731191f 360).
485 filings are strictly Receipt date. I am still searching for the uscis link and will post one as soon as I find one.

I'm getting married in August and my wife will be here in Sep/Oct. My PD is pretty recent - May 2007 EB2 (India). I'm planning to file my 140/485 (concurrent) and maintain my H1B for now and also bring my wife on H4. As long as she wants to be on H4, I'll maintain my H1 and once my PD comes CURRENT again, I'll file her 485.
Now, I've heard that my 485 won't be approved before my date is CURRENT again. Once the bulletin releases and if my date is CURRENT, I'll send my wife's papers to USCIS immediately. But it seems like I can get FP notice even before my dates become CURRENT. That case, my FP and other stuff might finish early and my wife's late. Does this affect her case in anyway as there is every chance that my 485 gets approved early and hers late. Will she be "out of status" because of her 485 pending and mine approved.
What do you suggest ??

I have talked to IMG sales rep, he said they won't cover for pre existing conditions. He also said that as far as his knowledge is concerned there is no company out there that covers pre existing conditions when I asked him about it.
My final assumption is that any insurance we buy anywhere, just covers illnesses that are developed after the coverage starts.
Any corrections??

Believe it or not, I know a consultant who lives in one of those "guest houses" where consultants who come from India are housed, and there is a guy who lives there whose job is to cook, clean and buy groceries for the housmates. HE HAS A GC APPLICATION PENDING! And people like me and many others who truely deserve to be hired and retained in this country are facing an uphill task of getting through the GC process.
That cook guy came to the US with a Bachelor degree in commerce, called B.Com. He hasn't been able to get a project for 4 3 years now. He doesn't get paid by the company. He is just a freeloader living there.
Imagine how many suck "cooks", "maids", and gas station employees might be out there clogging up the system!

The expiration on the new I-94 after using AP is 1 year from the time the AP is used and not related to AP expiration date from my experience.
The I-94 date I received was 6 months beyond my AP expiration.

service cntr lady said that they sent the applications back. They do not use overnight Fedex like you and me,they use regular mail.and it could take 4 wks too ..so will have to wait again for this? rejection and then refiling the same stuff?
She just said that to get rid of you over the phone. Lot of people have called USCIS and no one heard of any rejection notice being generated. I think we should be okay!
