Here is what I guess people are scared of
Every company has a lawyer on its payroll so they can easily start some court case to harras you. In this country you do not have much support except some close friends and may be far off relatives. So even if you know that you have done nothing wrong and have solid case the idea of hiring a lawyer and fighting a legal battle scares a lot of people. Plus every one has a job and family responsiblities and they cannot devote time to all these things. Say you are now working in New Jersey and your old employer is based in California and files a case against you there what will happen will you have to travel to california to represent in case? what will happen to your job and expenses etc. I am not sure if these are valid concerns but just thinking of this will dissuade a person to gear up for any kind of fight.

By the way "pointless" is one of the those people who have been leaving comments like "chuteya" when giving red dots.
How do I know that ? a regular member may not be able to view this information but certainly moderators can.
So the intentions and very credibility of this person ("pointless") is in question!

its clearly written in Sep'2008 bulletin. However, seems like EB3-I wont' get any of it and all numbers will be given to EB2. we loose again.
Its all EB2.
They even can't think logically that 5+ yrs of difference between EB3 & EB2 makes EB3 automatically same as EB2 as per their qualification definition.

There is vast difference between US and Indian housing market crash. India RE market will not collapse like here. There may be a melt down or small correction. The simple big reason is demand for housing in middle class due to economic growth. Based on population density, US is 9 times bigger than India. Lot of land in US. But housing land is so limited in India. So there is always demand. Second reason, there is no sub-prime lending in India. Third, in India, housing loan is based on cash worthiness rather than credit worthyness like in US. So we may not see such a massive foreclosure/bankrupcy in India to bring the price down considerably like in US.
However, now the prices or extremly high, such that it can not be affordabe to people other than NRI or IT folks. 1 crore houses are very common now. Based on US economy it will definitly come down. It will be depend on how hard IT/outsourcing bussiness gets affectd in future.

For me I have to renew H-1 visa every year wich will be same as EAD/AP. Each time I would go for H-1 visa I will be stuck for security clearance making me stay outside US without work for unknown number of months which is the worst experience that can happen to anyone not the grey area of AOS.
But to get EAD/AP I do not need to step outside US neither do I need to wait for security clearance and I hope to travel home when I want.
So to me EAD/AP is better than H-1visa.
If I get EAD/AP can I go for H-1 stamping?

H1-B has the following advantages under certain conditions.
1) If you are not yet married, you dump H1 and you are dumping the ability to bring your future wife to US immediately after marriage.
2) Some states give driving licenses that is valid until the EAD expiry or H1-B I-94 expiry. With H1-B, your hassle of DL renewal is reduced to one third of EAD based.
Its preposterous that USCIS does not allow LEGAL prospective permanent immigrants using EAD to bring their spouses!!

I found this only today.. I do not work for this employer since Jan 2008. On EAD now.. 46 days passed since the date mentioned.. not sure what is this about..
Current Status: Case reopened or reconsidered based on USCIS determination, and the case is now pending.

When I was asked to resubmit documents after the interview (via drop box), the consulate said they will need 6-8 working days from the date of receipt of the latter. They indeed took only 7 working days.
Also, I believe they must already have done PIMS verification in my case since they asked for additional info 16 days after the interview. So in total it took them 29 days ( incl weekends)
In your case, it doesnt seem they got enough time to do PIMS. It is hard to
estimate the delays.
Good luck though buddy....you will be fine.
Following is my case....please help me make a decision on whether to see this through or not submit passport and just travel back on AP...
Chennai consulate H1. (transfer from F1-OPT-H1).
January 2nd - date of visa interview. Asked for additional info - 221g because I have a Phd in biology
January 6th - submitted additional information. research. publications etc.
February 1st (friday afternoon)- status updated to 'send passport' on chennai consulate website.
My concerns are -
1. How long does it take VFS to return passport, if I submit passport on Monday, February 4th?
2. Would I still have to go through the PIMS verification or should I assume the consulate has already done this because they have asked me to submit passport?
Please help if you can. I have already rescheduled my tickets twice...

I completely agree with Logiclife and the goals IV has setforth to solve our problems. There is only so much one can achieve with limited resources under which IV operates.
We need to have a set of priorities and work on that one step at time. Though I have not been to DC, I can understand what IV is going through to get us some relief. The least I can do is contribute for our cause and thats what I am doing right now.
I wish people had some common sense and better understanding of the bigger picture(& issues) before they get involved in finger pointing and asking for more.
Everyone, please be patient and support IV whole heartedly and financially so that we can atleast attempt to fix the broken immigration system. Though I am VERY optimistic that we will achieve our goals in the near future, but I would not regret even once, if we failed. It is better to try and fail than not give it a shot at all.

I don't think it is correct. There is no requirement in H1B to look for American first, if nobody found then sponsor for H1B. It is there in GC process for labor market check. H1B law is not having tougher provisions to not to misuse it. So, thats that reason, some are misusing. Its like Labor substitution. Previously, there is no law that says you shouldn't substitute labor, but now we have it. It is about changing H1B law to reduce fraud.
But as someone said, increasing H1B fees is not the way of controlling fraud. They should decrease the fees back to $360, just application fee, but correct the H1B law so that only people really need it will get the visas.
The intent of the H1B program is not to bring people in the country in "Anticipatory mode" as you put it. The intent of the H1B program had always been for US employers to hire foreign skilled workers "On-Demand" when no american is willing, qualified or able to do the said job. Prior to 1999, the visa cap was 65000/yr WITHOUT the extra master's degree cap we have now, and still visas were never totally used up for any year, certainly not on the first day. It is only after the advent of the IT consulting companies hoarding visas in "anticipation" of future jobs that the problems started. Without any restrictions on this kind of abuse, no amount of H1 visa increase would be sufficient. They are talking of raising visas to 130,000 right? Based on the FY 2008 applications, those visas would be used up in TWO DAYS!

I think it should have minimal or no impact on your GC process. Somehow you can get gc. But what is the impact of case in your personal life that is more important. If you have an asset or money those are under risk. But if you have very less savings what they are going to achive by sueing you. Also did you have Insurance? Then they might put you and your Insurance company in lawsuit. Then your Insurance company may fight for you. If they win the case and court ask you to pay 1 million dollars then you can file bankruptsy protection and come out if you have very less money. Fighting is always better option than giving up. But again it is individual's decision. As you have option of going to India. But no such option for Americans
