    Recapturing lost numbers is not a permanent solution. Per country limit 7% is ridiculous. We need to make sure we are not discriminated against by the per country limit. Its not my fault that someone from Europe doesnt want to come here and not so many from Africa or south america qualify for the EB visas.

    I dont think they will stamp like that...If you show only AP they stamp I-94 based on its expiry says AOS pending or If you show only H1-B visa on PP they stamp I-94 based on Visa expire date..

    But showing both at POE doesn't not give any value and also it might confuses IO..

    Meanwhile, my lawyer today emailed & confirmed that the h1b will be valid even after using AP to travel and one can also renew or transfer the h1b. Even after the current I-94 expires obtained using AP, if one has still valid EAD or H1B I-797, he/she will be in status. However she also said that this is tricky situation and she could not find any CIS memo.

    HOPE THIS WILL STILL SOLVE MANY PEOPLE'S DOUBTS.

    Now I see no reason why anyone should NOT use AP to travel. Why should ANYONE waste money and time for restamping and take a small chance???

    However as "Ramba" said in post# 27, it is still a small chance as no one knows what is exactly the CIS rules.

    I guess you are talking about premium membership like wsj etc. I am not sure a free exchange of ideas can occur if we put our membership for sale by restricting access to some parts of the website. IV will lose some of its sheen and I am not sure the tradeoff in membership $ is worth it- dunno just doesn't feel right in the gut

    February 2006 - Every time I visit Silicon Valley I'm reminded of a simple fact: American businesses lead the world because they employ talented people. From the top executives at companies like Apple and Cisco to the science and engineering students I'll speak with Monday at San Jose State University, Americans sit on the cutting edge of technology.

    We have less than 5 percent of the world's population but produce almost a quarter of its wealth and enjoy the highest per capita income of any large industrial economy. Americans receive more patents than the citizens of any other country, have the world's best university system, do most of the world's basic research, and take home the lion's share of Nobel Prizes in the sciences.

    As many people working in Northern California's technology sector have realized, however, we can't afford complacence. China and India together now produce at least twice as many engineers as the United States. Both have fast growing populations and high-quality universities. In search of profits, companies have begun to outsource more low- and medium-skilled jobs to these nations.

    No amount of funding, furthermore, would allow the United States to catch -- much less exceed -- China and India's combined production of scientific personnel. We just don't have enough people. Even at our own universities, foreigners earn an ever-increasing percentage of degrees in the hard sciences. Some remain, but many end up taking their valuable skills back home. American companies, meanwhile, have thousands of scientific and engineering openings that they can't fill.

    If we hope to remain the world's pre-eminent economic power,/ we need to produce more scientists and engineers and train them better. One recent study, indeed, found that 85 percent of income growth stems from technological change.

    While every American deserves a high-quality education, we need to target additional resources on the most talented students to ensure America retains its competitive edge. In particular, we need to provide an incentive to all of America's bright, driven low-income students who want to pursue careers in the sciences. Right now, far too many talented students from poor backgrounds drop out of college or shift away from hard science because of the expense. It's bad for the country.

    One program that the president signed into law earlier this year takes the first major step toward fixing the problem. The SMART Grant program, which I developed, will focus assistance on students in science, math and strategic foreign languages who earn B averages or better during their junior and senior years of college. Next year, the California State University system estimates, more than 3,000 students systemwide -- including many at San Jose State -- will benefit from the program. Many will have their tuition payments eliminated entirely and the numbers will rise in coming years as the program attracts more people into the sciences. Thousands more students in the University of California system will also benefit.

    Of course, tuition subsidies alone can't ensure that we'll have enough talented workers. In the coming months, Congress will consider the president's proposals to improve K-12 math education, increase funding for basic research, support high-risk/high-reward applied science projects, and make the research and development tax credit permanent. Fiscal realities, of course, will play a role in any final decision as Congress examines these proposals.

    Silicon Valley companies already do an excellent job recruiting America's best and brightest. Now the government needs to build on its efforts to increase the ranks of homegrown scientists and engineers.

    He quipped me back saying that he is aware of IV and IV is NOT "like-minded" group but "Money-minded" group of people, keeping on asking money all the time....Definately, its sending wrong signal...


    Yes...Now you see the problem of over-agressive campaigning for contributions..Also the problem with members fighting over money with core team and vice-versa...

    This is the answer for your friend....
    Well...Organization does not run on thin air...raising money is essential....
    The organization has no option but to ask for money...This is going to happen anywhere you go....At least we are working for your benefits...It is not like we are asking you to write over your assets...It is minimal contribution....This is a fraction of your car insurence bill....a fraction of your lunch money for a month.....price of a tank of gas.....the rewards would be much greater .... This is one investment in your future that would give you returns in 100000 time of your investment..... and it is highly recommended...

    K , I see two views by two different types of folks.

    View #1: This system sucks. Its not fair and just. America is a great country and land of immigrants and we chose to immigrate here. Lets work on this issue so that I myself and folks such as myself now and going forward do not have this problem. I will do what ever it takes. I personally feel that regardless of the outcome, it gives immense self satisfaction to commit to meaningful cause. Others might not feel so, but all of us believe that this problem needs to be solved and do what ever we can do.

    View #2: Some people come resigned with the idea that they will be looked down. Now My question is what do you want to accomplish on IV if you do not want to work on the issue, If you do not want believe in the core principles of this organization. If you think that immigrants are treated like dirt and again if you believe in that and because you are an immigrant in this country, you should have been putting up with a treatment like dirt, do you have an iota of self esteem?? Seriously, If you really believe what you are saying why do you even want to be here now? or why do you even want to have a backup plan that will again make you a immigrant some where else?? $$$ over ride self esteem Huh? In the name of discussion you want to shape the opinion of people who do not talk much. Kudos to your agenda. You keep spitting out your rhetoric that immigrants are dirt but cannot make arguments that hold water for a single second.

    I compared the president to show that immigrants and sons of immigrants can have a life that is quite opposite of what the OP said. Just because you or some one you know treated some one bad does not mean that every one treats others the same. B T W, There are others in congress who are born out of country as well and there are governors born some where. stop smoking too much

Did some one say that you have to get a life because you chose not to do so? Yes, there are many other countries that have smoother immigration process. Every one is welcome to explore them and you did. In fact, IV wiki has sections dedicated for immigration to other countries. You can chose to develop them or can chose other wise. Just because you have explored other options and found some thing that suits your situation does not mean every plain jane can and will find one. You expect the US congress to get its act right, modify the immigration system and have all of us walk on a red carpet. That would be ideal. Even I will love that. As that is not the case and some of us has chosen to work with the US Congress, you consider us folks who dont have a life. It comes down to the difference that you dont want to work on this issue and have things served on a silver platter, while many of us want to work and fix this issue. Rant as much as you can but all of your arguments contradict each other

    Should I say that all of you those who bought homes and are having a life bought a home with 0% down and interest only loan so that you can save your taxes now and if your GC does not come through in 5 years, you will walk out with out any loss as you made hefty deductions and haven't paid single penny towards the mortgage and simply go to Timbuktu or Krakovia. I will not!. Just because you chose to buy a home and have a life does not mean that others dont. Every one lives their own lives. Those who dont buy a home live a life of their choice. Stop judging people. GC was not a risk or hindrance to you in buying a home but could be for Joe the Analyst. You might have deep pockets, Joe the analyst might not or have other commitments. Coupled with the lack of GC, his risk might be more than some one else.

    I doubt you will get a reply for your honest and valid concerns :)

    I have been a IV member since 2006 . I have seen the ups/downs . donated money , sent letters , attended rallies and done whatever has been been proposed . But I see that many senior members who had the drive to motivate people are not sending or being part of any messages or threads at all and that is exactly why the movement seems to be losing steam .

    The standard response that I see to any question is "have you donated money ? " . "Don't ask for anything till you have donated. " this is followed by some some red dots which normally works to silence the questions. People will be willing to donate when they believe in the movement . I remember we collected $ 30,000 in 1 month before the rally there was huge thread with all the donations . People were charged up and the money came up automatically . I am willing to donate but to be brutally honest I do not see the same level of motivation as was there in 2006 / 2007 days .Please use this as a wakeup call and not as reason to vent your frustration on me .

    There are many senior members who I do not even see any more . Members joining in late 2007 or early 2008 will not know any of these guys .

    Aman Kapoor . He is the founder of IV . I have not seen his messages since the past 3 years almost . Where is he ? Is it too much for him to send a greeting in New years eve motivating the members ? It takes just 2 minutes .

    Mark Bartosik :- He was supposed to the spokesperson for IV .The guy with the MasterCard sign for immigration . I have not seen him for quite some time now
    Where are the other senior leaders like
    a) Walden Pond
    b) There was a this British Girl from San Jose ( had a handle which had name like Rose or something )
    c) Niloufer Bustani from Dallas. I see her once in a while but very sparingly .

    The others even I have forgotten completely.

    The only leadership/core that I see is Pappu and no one else . If you have a country where the prime minister shows his face only once in 4 years , how are the people supposed to believe in that movement ? Please don't reply with a message saying what have I done or why can't I contribute money ? I have done that I am looking for leadership to show us the way and motivate us . All campaigns don't need money donations( Letters , calls , faxes etc ) . We could start with that and then drum up support and momentum and then the money will start flowing in automatically . There has to be a synchronized campaign organized by the leadership and all I see is everybody putting their eggs in the basket called spillover.

    Thanks guys for all the posts. I guess I have a little ignorant question. If I am married does my wife need to be here for me to file her 485. I am getting court marriage done in July 2007, and hope to file my 485 as soon as I have my marriage certificate, I am sure will be filing in July, but my wife won't be coming to the US till Jan 2008, which is when we have will have the ritualistic wedding. Does she need to be here for any paperwork. She could come on H4, but her parents won't let her stay for long. Does she need medical tests as well from civil surgeon when I file for her? I am hoping she can come in Jan on H4, and then get her EAD along with mine.


    Yes she needs to be here to file I-485 and then she can leave and stay there..

    It is completely unpredictable. Actually when you file I485 USCIS does not process FIFO(They are supposed to). For example there are 10k gc are left for the year. First they will process the applications which are cleared FP based on PD and receipt date. Always risk is there when filing without marriage. You are safe till USCIS starts process your application. When they take your application for processing then you cannot add your spouse. Also if CIR decides to process backlogs faster then also you will be in problem. Best option is if your marriage is already fixed do it within 3 months and file GC before PD is backdated. You need not file July first. You can wait till Jul15 to see next VB and decide.
