    gc_chahiye, Thanks for your response. So, can I be on H1 with my current employer, A, and on EAD with my new employer, B, simultaneously?

    Also, employer B might be able to start me on H1-B (my preference--just in case)--though as you said, B will have petition my new H1 for concurrent filing. My other option, of course, is to wait until Feb '08--though I'll miss out on a month's salary from B (not a biggie in order to not have any potential issues).

    There are a few lawyers who say this is possible, but the majority consensus is that using EAD with even one employer invalidates your H1.

    Dont worry about a months salary at this point. If you want to maintain H1, try to delay the H1 transfer a bit so that you complete as much of 180 days as possible with your current employer.

    Catch22 - Seems like u hv touched the surface now.

    It's more deep-rooted, even to an extent that the two Countries are sharing the "acquired" Citizens (thanks to the dual Citizenship format). It didn't amount to the Indian Govt saying " Give me back my elite. I just lost it" and the US Govt saying "Sorry, it's our gain and for keeps". It's all part of an elaborate and acknowledged process (creamy situation for the individual) .

    US needs the Skilled force and matches them up with opportunities (some other countries have the force in abundance and are overwhelmed). At no point in time should the force be subjected to undue hardship, especially if a process can be remedied. Immigrating is tough. Alongside, a host of collaterals get pledged by - families, roots, skills, labor, career, merit, all towards one goal. It's a conscious decision that an individual involved makes and backs it up with his credentials. If these credentials are deemed meritorious, the process starts (in a mutually acceptable manner, if there exists a provision). If rules get changed midway affecting those collaterals, you raise it with the concerned. In this situation, I give this much to the Indian Government - it's for its people (doesn't mean to say that it lies in wait to net a wings-clipped bird). It would honour your decision and look into your cause, if justifiable. In the same vein, the US Government acknowledges merit and talent and has laid out provisions by which it welcomes the same. Hence, the process.

    Word of caution: It's also in the way that you put across your viewpoint

    I am not sure what makes you feel that India is overwhelmed with talent that they have to request America to take in some of these folks. India is not a war-torn country that America has to take in Indian refugees.

    BTW, America does not recognise "Dual citizenship" or acquired citizenship or whatever. To your point, even if India and America were moving towards closer co-operation, the Indian Government can only ask America for increased "temporary" visas (H1B) for free movement of 'Services', per WTO. Certainly NOT lobby for Permanent Resident Status for its citizens in a foreign country. Sorry, my friend, your rationale is too utopian for me. I, unfortunately, live in the real world.

    P.S: My previous post was more rhetorical. I did not mean to hurt or harm anyone.

    Wow. No offense prophet but your post would make all my english teachers turn gray. ;) Took me about 10 minutes just to understand it! Hope you don't use that kind of language on the site you are designing - or they might not take you seriously.

    But back to topic - you will get hired for a paying job based on a combination of your talent, knowledge, and experience. Show them what you can do or have done. I've seen some amazing sites done by first-timers and some pretty crappy ones done by folk who have been flashing for awhile. Sites and site designers come in all flavors.

    Did you join them on H1B and then move to EAD? Did you change your I-9 form when you did that? If you didn't, as far as they are concerned, you might still be on H1B and so they might feel a need to inform the USCIS. If not, well, there really is nothing in the rule book that says they have to inform the USCIS that an EAD holder left employment.

    To all Bachelors

    1. you can files your I485 and later add your spouse if the dates are current or you have the priority date.
    2.You can apply for EAD during I485 and at the same time can be on H1 unless you don't change an employer using EAD.
    3.Unless you add your spouse to I485 process..you have to maintain your H1 status as your spouse will be on H4.
    4.BY any chance your I485 is approved before adding your spouse(present in US)..you have 180days to apply for your spouse.
    5.If your I485 is approved when your spouse in outsite USA..then you have to go for consular processing.
    6. No one exactly knows if the PD will remain same or not.

    So anyone about to marry or planning to get married,talk to your attornies about your situation and take a decision.

    From what I understand you can only and still will only be able to file I-485 when your PD is current. Now, if you belong to rest of the world EB2 the moment your labor clears your PD is current so you can file at the same time I-485 and I-140. In future you will have to delay the filing of I-485 for the three months that I-140 takes to clear (if your PD is current the moment the labor clears).

    You are making an assumption that an approved petition is an indication of a valid status for the entire duration of extension. This may or may not be true after the I-140 is revoked.

    That's why you have to be quick...Before your earlier employer revokes the petition...(that takes some time..) you got to get a new labor and a new approved I-140 and after that they cannot throw us out technically...
    The whole thing is a mess..

    Any number lesser than 800,000 is good for us.. doesnt mean all is well.. we have to continue in our efforts with IV and we could have a better breakthrough..

    Anything less than 800,000 is good... even a few hundred thousand less :) There's still a lot of work and patience required but a good news is a good news nevertheless.

    Infact today is my 2nd day at my new job. I have decided not to inform USCIS. And I am in process of hiring a new lawyer , since my previous company paid for my GC , the company lawyer asked me to go with different lawyer for all my future needs.

    I will hire a lawyer and plan to file G28 form in this month.
