I bought a house in the year 2006 (2 years back as Punjabi did)....there were reports, news items, articles everywhere talking about the real estate bubble with data available by cities/states. So saying something like "what is the fault of Punjabi" is not fair as we are all here because of our "extraordinarily high skills". And where did the $200 K number come from ? In the city where I live, the average house price was $220,000, I bought a house which was worth $185,000. I knew my limits.
First of all I am not affected by foreclosure and nor do I own a property.
Now let me say this: What is the fault of Punjabi if his house price went down by $200K? He has a load which is not only more than his house value, he is also paying an interest on that loan. It is true that he has got into hot water but how many years will it take to make $200 K? Most of us are not millionaires here. It is true that he will suffer for a few years but I dont see why giving up the house is not an option. Why would he continue to pay interest and principal when his house may not get to the same value in his lifetime? I think foreclosure is a small price to pay in that light.

Looks like this year USCIS understood they need some money and accept some extra applications, which may be the same file I485 when PD is not current. and date might go to end of 2007.
Just a thought
If it is for applications money, they might as well make it current.
There are not many applications between Jan2008 and jan2011

There are two waves of movement going to happen for EB2 this year. One starting in May and the other starting in July.
The 12000 unused visa numbers from EB1 is not the total for the year 2011. It is almost certain that, this is the spillover from the first 2 quarters of 2011. Along with this, there are some numbers from EB2 ROW as well. The spillover will only get applied to all those countries which are retrogressed.
12000 visa numbers would move mathematically the dates to somewhere in Sept 2006 for India and China Eb2. The porting from EB3 to EB2 is still a factor, but that won't exceed more then 1500 (which are ready to be assigned visa).
In order to utilize these 12000 visa numbers, USCIS may possibly consider 15000 applicants so that they will get 12000 approvable, background check free and non-delayed cases.
So, i think for EB2 the dates could move to either Oct/Nov/Dec of 2006.

I checked some family based data and Date jumps 2-3 years once in a 2-3 year period and NVC gets enough files to work on for next 2-3 years , so dates moves slowly for next 2-3 years. USCIS learned lesson from July 2007 and may follow same approach what NVC do.
They might go upto 2008 or 2009 in advance this year or next year so they have almost 20-30 k Eb2 cases on hand which can last for year or two. USCIS needs some new cases to work on. All pre adjudicated cases are ready for approval so chances are there they can advance date so that they can get enough cases for next year's spill over quota.

Good to see that there is some activity going on our cases..i got the response form USCIS saying that "the case is pending at the USCIS office" dose this means they transfered the case to local office? or still at NBC..dose your message says that the your case has been transfered to "local USCIS office" or just "USCIS office"?..
My online status says transferred to USCIS office, BUT the mail I got in response to my lost application inquiry stated LOCAL uscis office and that you will be called for interview whenever they are ready.

both H1 were approved from the same USCIS center? the one which is stuck in PIMS, which service center it was?

For those who don't know, the first three letters of the receipt number in you I-797 H-1b approval notice indicates the service center.
Like SRC is Texas, EAC is Vermont, LIN is nebraska and CSC for california.
Please include this info too.

Just because some one said, VDLRAO predicts right, he has become a Psycic Guru here. Please stop this. Every one keeps saying , he predicts everything right. Did he predict, EB2 with PD2006 will be processed before EB2 with PD 2003. Come on Guys, Give me a break and stop this rubbish. What did he predict and on what basis. I dont have anything personal here, I appreciate him, taking efforts to come up with some number based on the calculation. But Please stop spreading this on every forum that He predicts right.

The details escapes me... at some point in the long past I was looking into what kind of questions employers should and shouldn't ask. If I come across anything again then I will surely post.
As far as EAD is concerned, the employers shouldn't discriminate. Especially if more than 90 days are left on it since that's the time-frame govt promises to issue a new EAD. The employer might feel better to work with a citizen or GC or a person of certain ethnic background or national origin. However, thats the kind of decisions the employer is not allowed to make. Employer has to accept EAD, everything else being equal. When the law is not followed and it harms us, we have to fight it back.
I realize employers sometime end up asking questions that they shouldn't like the obvious ones such as age and marital status.
Thats a good point about "at least 90 days validity remaining on EAD".
I am now curious to hear back the response that the original poster got back from CapitolOne.

i dont think the country makes a big difference, i have two friends stuck in name check (one was born in canada with an english first and last name). i think its the combination of the name, DOB and a crappy system

For those of us who have become "current" with the latest VB movements, I have some discouraging news for you: at least for the Nebraska Processing Center, the current processing date for an employment-based I-485 has retrogressed from September to August,2006. Only a small step backwards but a step backwards all the same.
It's still a step forward then not having an opportunity to file at all :cool:

So, even if USCIS now decides to stop processing/approving AOS based on the limited number of available visa - my understaning is that "we" are at least on top of the list and once visa become available again, the AOS will be approved - so, in worst case another three to four months wait? After five years of processing time(s) I can live with that...
Another question that came up was once the AOS was not approved, do you have to file again or does the current dis-approval have any negative effect on the process (except for of course the wait time)?

I called the members and most of the calls went to voicemail. Left a message urging them to support the bill. I also started posting this in our university Indian student Association group so that they can start calling. I thank IV for the telephone numbers.
