If you want to change the employer with in 180 days of filing 485 - there is a risk involved. If your 485 approved with in the 180 days then you will get in to trouble. If your 485 is pending more than 180 days - irrespective of when you changed employer before 180 days over or after 180 days over are does not matter - and you will be safe.
If you change your employer with in 180 days - then you have to pray to the GOD for not getting approval with in 180 days of filing.
I think it answers lot of lenghty questions either one way or the other.

When you say "according the our calculations", and you can only come up with years (& not 1 year, 2 year), you have obviously not done a very accurate calculation/guestimation.
I wouldn't put too much stock into it.
There are two years (2006 and 2007 ) from 2006 to 2007 and you know language of all lawyers, so he is not wrong here too. I bet you if you can convince him to say 1-2 or 3 years.

in my case i got no slip..whenever i call consulate new delhi they say still under admin processing ?? my lawyer checked with DOS..DOS had sent approval on jan 25th..still under proc at embassy !!
NOT SURE WHY ?? this delay is ??
i maybe forgetting..but which consulate did you go to and if new delhi then what was the description(looks) of the VO ?

I had both a valid visa stamped on my passport and AP. But my wife did not have a stamped visa so I showed her AP and my h1. The immigration inspector said that you both have to use AP to enter. I argued with him a little that I can use my h1 when it is valid but he did not agree and said that I am trying to do a fraud. Well I did not argue much and let him stamp my I 94 with a parole stamp till 01/26/2007. I have now filed for my extension.

Why do you think so...coz I'm in that state. My spouse who is the primary applicant got the card and my application is still in review ???

If a family member's derivative adjustment of status application has been pending in excess of 30 days from the approval date of the principal applicant's Form I-485, please submit to cisombudsman.publicaffairs@dhs.gov:
�DHS Form 7001;
�A copy of the principal applicant's Form I-485 approval notice;
�A copy of the Form I-485 receipt notice for the derivative; and
�Any other evidence that is pertinent to the case.
In your email, please note in the subject line: "Unapproved Derivative I-485."

Thats is waht they say.. But their actions always show that they are against ALL immigration. Some of us have been looking at them for a while now. As you can see, they DO NOT support the letter campaign.

dude, how many immigrants/H1/L1/GC/Gc->US citizens work for google/Msoft/Yahoo. And if you are naming these corporations as the benchmark of success/technical excellence why do you not listen to what they say about visa programs?
In addition why have these companies set up big shops in India. Although the innovations didn't happen there and there are several valid reasons for that, but just the fact that they have big footprints there means that they are able to find talent there.

"Thank you for your e-mail.
Our records show that your visa was issued today, January 31. You
should be receiving your passport/visa soon.

Add to it, all other items people do to get attention for their case and think that by sending an email or a phone call from Senator or by a lawyer, the officer will realize his mistake and quickly open the file and approve it. If you look at the responses people post to their inquiries, you would see that most responses are standard. USCIS is not just approving 140K greencards but more than a million greencards, hundreds of thousands of H1 and other visa types, EADs etc...every year. Greencards do not get issued on the day date gets current. It is not a automatic process. There is lot of human work involved and many people do not understand that or spend time understanding it. They would rather waste their time either on useless task of tracking or calling customer service every single day.

My father tried to get a Non Availability certificate but they told since the birth is registered they can't issue one and that they also won't change the name...:mad: (after the incident where that MP tried to sneak people into Canada they are very strict it seems)

Yes, it was based on the State you lived. One other thing, you may want to check with Customer Service, since when are you have been actually considered a PR. If they have considered you as a PR since 2008, it is good for you, you will be able to apply for Citizenship sooner

can you pls provide some detail info .. I will be going to India soon and need to get my visa stamped ... if I can make sure that the H1 info is there in PIMS beforehand that will provide much comfort ...
also regarding your H1, is it a fresh or extension or transfer ... when was it approved ... appreciate your inputs ...
I called the Nogales (mexico) US embassy and they were able to look up the PIMS system using the petition number.
I hope the PIMS is a "centralized" system. So even the consulate in India would be using the same.
