Dear IVans,
Now that the SEP VB is out, what does this indicate in terms of
- future VBs
- visa availability in the coming months
- awareness about visa wastage
- dates becoming current for most EB categories
- light at the end of tunnel for most of us
- USCIS efficiencies
Pls share your thoughts. Thanks!
We will know for sure after Sep 30. If they don't waste any visas then it is a good sign.
But if they do waste visas, inspite of all the leeway, requests, advise, whatever they have been given, then God help us.

Thanks for your kind reply. Yes this amount of 40K is what i saved from my salary after my employer deducts taxes via withholding. I am confused because I read that you have to declare any foriegn accounts help while filling for taxes here in US. I made these trasnfers to my dad's account and I dont have any NRI account. I am not sure if I will fall into this category and have to declare all this. Thanks again for your help.
You dont fall in to that category and as several members mentioned you dont have to pay taxes for remittances as you already paid tax while earning it.

I was with Swede and the Polish guy at the rally. I myself chose IV over other organization precisely because the diversity and the common ground IV embraces--they represent the true American Dream and the fundation of Democracy.
The diversity: IV was initially established by a group of Indians, but it has a welcoming attitudes toward anyone who has suffered, is still suffering, and will suffer from the broken system.
The common ground: IV clearly estabishes that English is the language for the forum (at least the main forum). By setting the language, the IV sends a message of welcome to all who share the American Dream. By including individuals across countries of origin, IV recognizes the nature of the Great Melting-pot and shows that we have the ability to be inclusive, tolerant, and work together on a democratic basis.

There are 2 things that you need to do and take time..
1. Apply for FBI fingerprint clearance .. You can take fingerprints in your local sheriff's office on a standard FBI form and then send it to FBI.. takes about 2 months.
2. Apply and get IELTS english score.. I think this has become standard now..
I had attached all the literatures that had been published on Finance and technical journals. In addition, I had US education with Masters. Still, they asked me to appear for IELTS.
If you native language is not English, IELTS is must.

My understanding is that I-140 has to be approved to interfile. That's how it used to be anyway (you could not file I-485 concurrently). Anyway, interfile is not automatic so why the lawyer cannot file a second I-140 is beyond my understanding. Interfile exists so that you do not have to refile I-485, but it's up to you whether you want to do it or not.

I got my FP apt on 12/14. There was no lud on my 485. I had opened SR for fp in october, but didnt help. Then I used the POJ method to get hold of IO at TSC on 12/7 and she created one for me, the notice date on FP says 12/7. Hope this helps.

I would advise you to look at RFE very carefully, Sometimes they issue RFE that may read to include more than one kind of proof so you may be able to submit alternative proofs such as affidavits, wedding pictures, wedding invitaion etc. I am just throwing an idea here.
I got a chance to take a look at 140 RFE that was issued recently. The language used was pretty broad for certain kind of proof they were requesting. You may have a chance to submit alternatives.

Ok, so my PD got current (EB3 India). What next?
1) I dont think I can expect that my PD remains current in the next Visa bulletin as well. The dates might retrogress again...right?
2) When will they open my case for adjudication? Will it happen within the month of March? Will ALL cases eligble to be opened in a particular Visa bulletin month are GURANTEED to be opened atleast to determine the next step (like sending it to namecheck, FP etc ) for that case?
(Dont tell me nothing is GUARANTEED with USCIS :) . I mean to a reasonable levels of the word 'GUARANTEE' ! )
3) What further factors/queues/backlogs determine when a case will be opened for adjudication when the PD is current and I-140 is also already approved & FP done.
4) Namecheck - The new rule of auto-approval/clearance past 180 days.....when does the 180 day count start from?
--- Receipt date of I-485 application OR
--- Date when the application is opened for adjudication following the PD becoming current for that person OR
--- How can one find out what their namecheck status is? If we are past 180 days, is it safe to assume that we are cleared on Namecheck?
5) Will anything at all happen in my case during the remaining of this month Feb? Like pre-adjudication of my case etc in anticipation of my PD becoming current in March (as you can see by my IV handle name....hihgly optimistic :) ) ....
6)Should I be watching out for any LUDs this month or don't even bother until March
I hope the other IV brethren who might have already got their GCs and other Gurus/experts on the forum can probably shed some light on these questions, the time lines/milestones involved etc

I wanted to get an idea how many EB2 guys would be willing to visit DC to meet lawmakers to help out our EB3 brothers. Unquestionably all EB3 should be willing to visit. This is the chance to show that IV is indeed one.

I received an RFE too in Nov 1st week. It was about the evaluation. (It was submitted earlier but still) Lawyer mailed them the required document and now the status has changed to "We received your response to the request on Nov 14th and the case processing has resumed".
How many days does it take them now to make a decision? (Btw I am EB3 and my 140 submission date was Nov 2006)

The dates for H4 I 539 renewal are struck at 14th June 2007 where as most of people who filed their renewal's have already got it. These dates are meaningless.
No. That means ALL cases filed before 14th June07 have been processed. You may have filed on July 1st might have been processed, but this has no relevance to the previous statement.
That's why I think all the 485s filed before July 27th 2007 at NSC have undergone some processing, if not completed.
Problem cases, those which may need RFEs may get notified in the coming weeks.

If Applicants receive a 221(g) notice with a questionnaire asking about job experience/edcuation backgrond, that is usually "additional administrative processing" associated with TAL (Technology alert check). thsi takes around 30-45 days in most cases. Other 221(g) reasons could be just for employer/document verification (which is what it seems in your case).
Timelines are varied but in most cases peopel get approval in a month or so. But the wait is nerve-wracking. Just stay positive and be aware that these checks are happening frequently nowadays.
Once you get your visa and travel back, please join in IV's push to get I485 (3rd stage of green card) filing without current PD. spread the message among your friends/colleagues.

If you find any company breaking the law, abusing the system or 'exploiting' immigrants as anti-immigrants allege, you must take action.
DOL USCIS must be informed. Search the forum and you will find resources how to do it. Unless we all take steps, there will be few bad apples that will give a bad name to the entire system.
I think it was Mahatma Gandhi who said that a person who accepts a bad deed and does not take action is also equally responsible as the person doing it.
IV strongly condemns anyone breaking the law. People must report it to the authorities. IV community must work on protecting the rights of the immigrants and support anyone who is willing to go against companies that break the law or 'exploit' immigrants.

I opened 2 SR back in Oct for FP. My wife got FP in December whereas I got a letter to basically wait. I'm the primary and still waiting.
