It appears that most of the one sided agreeements mentioned above are not legal. For eg if in ur offer letter u have 2 weeks of notice period from your side and company says they can termniate you without any notice period then its not legal.
I think only 2 side agreements are legal and all other agreements even if you sign are not legal.

I will next month. Using same/similar job. And also, my lawyer said that we do not need to send AC-21 letter to USCIS, wait for the RFE, if any. So don't worry and enjoy this small freedom.

There is a section in 485 application to list your spouse and dependents. Talk to a good lawyer to see if you can still add her. Or you can live in india until you figure out a way to bring her here on student visa or something.

I have a question for you. I had lost my birth certificated and fortunately my father was visiting us so I get an affidavit signed by him. My mother is no more and my siblings are in India. Would there be a problem as I sent an affidavit in lieu of birth cert with just my father's signature? Please let me know.
Uncle or aunt's affidavit would have done as well. But you cannot send just one.

Today I called. Automated phone system didn't provided me option 3 and 4 after "keep listening to updates on case" step. It's said invalid option. Second try again I think used 3,3,1 which takes me level 1 CC. Luckily level 1 guy asked few questions(last name, first name, receipt#, dob, A#, etc, etc.) and let me go to Level-2. Level-2 again asked me for same info (last name, first name, A#, etc, etc.) but told me "call after March 10th 2008". So not much success. What a wastage of time. :(

sanjay , prinive - believe me folks, a lot of pushing is needed, not everyone are proactive like you and me. I guess you are in the tri state chapter - you can see for yourself, how many members are active and how many are not. I am also just like you all - the core trusts me to be a chapter lead and I do want to do what best I can - I will be very happy if more and more people come forward and carry things forward.

I have applied for H1B extension with my original h1 company (a consulting firm) and due to some pending queries regarding the h1b applications in general for my company, my h1 extension was in pending state with no updates. (I applied around Jun 15th 2008).
Later in dec 2008, I applied for h1 transfer with a new firm, and got a RFE on Jan 7th with similar requests... My lawyer asked me for all my W2's since 2005 (my original h1 start year), pay stubs for the last 4 or 5 months, and letter from end client, prime vendor and myself stating job responsibilities.. I have collected all this information, and they are going to respond to the RFE this week. I hope all goes well...
I have EAD to fall back in case they reject it. But seriously, I was never out of status, or unpaid (unless while on vacation to india or elsewhere).. came to US in 2002 for masters and worked on CPT/OPT for about a year before starting on h1b in oct 2005.

Please explain what is student status and 221g. You mean , if you are student of any intitute in US, while your I-140 is approved?
I was here on F1 first and then converted o H1. I went for a H1 stamping after about 5years. Student status refers to the status of the F1 visa. They usually track it using SEVIS. My bad luck since SEVIS was not up that day or my name was not showing up since I was a pre sevis grad enrollment. 221g is a document they hand out if they cannot issue a visa due to lack of documents or need to no further administrative processing like verify employer/status on a visa etc. You need to either appear again before the consulate or they get back to your later. My case was a nightmare and I dont plan to ever go back again to India period. Guys do your research on the web regarding 221g do travel plans accordingly!

1. You just need the receipts to travel not the Ap approval perse.

2. If your H1B petition is still valid, you are OK, if you notice the botton part of your petition is your original I94, so you are covered with that.
Petition does not help if you don't have a visa and one wants to travel, Visa is for entry and I94 is for staying in country
3. according to my attorney CIS will take 45 days for the RD to deliver the I797 notice to you home, so if you applied the last days of July, by the 3rd week of September you will receive the I797 notice.
As note my attorney was president of the AILA last year and her husband work in the CIS, so some how the info is trustable.

Every one are highly educated and highly skilled and there is always needs to be difference compared to other forums. Actually after Moderators started monitoring messages one person is putting abusive languages in comment section of the Reputation of many posts as those are unnoticed unless the person complained. I welcome red or green dots in reputation but abusive words in the comment section are not acceptable to me.
It may not be possible to micromanage everything. But moderators are taking prompt action if anyone reports abusive languages.
in that case it ...we should have a wall of shame section & tag members...;)
but the point is how much of micromanagement can u do on a "free" forum!
