Does it make a difference ?
- If you go to Canada are you really going to be working ? You are going to go to Law School and get your degree in Law and becoming a Lawyer. So you go to Canada and study and 3+ years later become a Canadian citizen come right back in US on TN visa. Unless you don't want to abandon your Chinese citizenship.
- The July 2007 - 140 are showing signs of approval. So you get the 140 approval and then use AC21 to hang around the US and complete your Law degree in Boston. A few years later you get 485 approved and you are set in US. The complication comes is that you have a GC filed as EE and 485 might become questionable or maybe not (if you become a smart lawyer :) to defend your own)
So from the options that you stand today, if in next couple of months 140 is approved, ask your lawyer can you use AC21 and go to Law school or will there be complications. If not, stick around here.

The pattern of RFE's on AP's are from those cases applied at NSC >> CSC issued Receipts/EAD/AP >> 485 back to NSC.
I got an RFE for I-131 for both myself and my wife. They have asked for absolutely everything (I-485 receipt, I-140 approval, I-94s, I-797s, marriage certificate, Passport copies etc). As my lawyer said "they have thrown the kitchen sink at you".
I dont even know why - but the amount of documentation they have asked for seems absurd just to issue a travel document.
BTW - my EAD from the sample application was approved!

why can't everyone request the USCIS to send it by Fedex or UPS, assuring that we will bear the special charges.

Hi friends,
I am from south east Michigan just like everyone else here standing in the never ending line of gruesome and crippled immigration system.
Let us come together and help IV achieve our goals.
It is high time, that we ask for what we deserve. And it wont come unless we stand up for ourselves.
thanks....

I have used AC21 and have not sent a letter yet to USCIS as it is optional and that is what my attorney recommended...that is to wait for an RFE (I have changed address as I moved to a diff. state; chances of an RFE increases)
That said, I am wondering that with a G28 representation on the files with USCIS, if I send a AC21 letter all by myself (without attorney), will it be honored by USCIS ? I am comtemplating of doing this as I wanted to prempt the RFE thereby saving precious time (when date is current) and the money that I would have to pay my attorney when the RFE reaches him (I would rather he reply to an RFE but want to give my best to avoid it)
any ideas ?
Yeah, yours is a good thought, Murthy law firm charges $2000.00 for Ac21 case and then representing you through 485, any RFE takes $250.00.

I agree with you. I was bit tense to see RFE email since it is my first RFE. I will try to avoid giving urgent words.
Thanks anyway for your reply.
I gave you a thumbs up for accepting that it was unnecessary starting this thread. What you did is something that is completely missing on this forum - a little bit of humility would be so nice out here.

Hey folks,
The proposed bill to give green card to PhDS does not include all the PhDs. PhDs listed as STEM(Science engineering technology majors) are only eligible through this bill in current form. Graduates from pharmacy, medicine, veterinary medicine, animal science are not listed as STEM. I am sure there are many more majors not listed as STEM. I think we should write a letter to congressmen about this anomaly. And I encourage non STEM PhDs to represent their concern so that we can unite and represent our concerns to the congress men. immigrtion service department has listed the subject codes fall under STEM.
You have to browse through the following link to see code for your major. http://nces.ed.gov/pubs2002/cip2000/ciplist.asp.
once you know the code for your major you can go to http://www.ice.gov/sevis/stemlist.htm to check weather your program is listed there as STEM.
good luck
It is very comprehensive list. It covers every field. Graduates of pharmacy, medicine, vet medicine etc are not PhDs. They have to go through special programs to get that degree.

I heard that NSC is 45 days compliant in processing EAD. Is this true? I think it is not. Knowing NSC, it could take approximately 90 days +/- 30 days.

Hi,
My attorney received an EVL RFE for my I-485 case. My PD is 2007 EB3 so I don't have any hope of getting GC but I guess they are just pre-adjucating my case.
Here is my situation - I filed my !-485 in Aug 2007 and changed job (without filing any AC-21 paperwork with USCIS) in April 2008. My attorney had looked at new job description and given green signal for change. My entire immigration history of 10 years in US is totally clean with no gaps and with all work autorizations.
Now, my concern is that the letter that my attorney has prepared for my current employer to sign has lot of legal lingo (AC-21 language, lot of CFRs, info related to my LCA and I-140) and has some language to the effect of supporting my LCA and I-140 till my GC is approved. It also states that my current employer was able to afford to pay my salary since the LCA date. My employer is fortune 5 company so money wise there is no problem but my concern is that they may not want to sign such a lengthy (wordy) legal doc without consulting their Immi attorney. I don't have much time to respond (only 8 more days). So if my employer takes long time or tells me that they can not sign it, I want to be ready with Plan B. Can someone suggest what should I do?
1 - should I prepare a simple document with job duties, responsibilities, start date, salary etc that my employer will be willing to sign. So at last moment I can atleast get that signed. Something will be better than nothing.
2 - Should I / (bigger question is can I) ask USCIS to give me more time to respond to RFE?
3. Provide simple letter from employer with an affedavit or something stating that the new job is same / similar as the old job.
Sorry for a long post and thanks for any suggestions.

Regardless of what your employer is doing on your behalf, you should be proactive and take appointments with law makers. You should be prepared to show that you didn't do anything wrong and now you are going through personal hardships because of this delay. Since you are willing to provide all the paper works to USCIS they should have no reason to delay adjudication. You should emphasize the fact the your application is subjected to undue delay for no fault of yours.
According to my employer, he is going to the Senators office tomorrow to talk to them regarding my case. Got an appointment some time this week to see them on Friday. I dont know how far this is true. They already wrote a letter to them 2 weeks back. This is what my employer says. But I dont know whether he actually contacted them or not. He said he will give me further info on monday. I have to wait and see what he comes up with ( truth or some other new story) on Monday. Then I might decide to move on to a diff employer if nothing works out.

Why do they get the FP and Medical if they are going to expire. Why not when they are ready to give the GC. That way they can save time and money for millions of applicants. I guess that is what they do not want to do.
Technically speaking, you send your I-485 when they are "ready", which means, your dates are Current, you are eligible for a visa. Beyond that point it is supposed to be a short administrative delay, which unfortunately is extending to years...

I guess EB3 will finally cross 2001 barrier in the next bulletin.
For Eb2, it will be like the new EB3. Just too many cases were filed in EB2 after 2005.
Good luck to everyone.:)

And I'm sure being promised a cut of the winnings didn't hurt either. :P:shh: if it makes you feel better most of the cash goes to funding open source projects which take up most of my free time, but Sirisian did play with the helicopter I got.
