This is encouraging. chandu, I read somewhere (mostly on murhty) that CIS will be publishing new AC21 soon and it is expected to be more stricter. Is this just the speculation or any other indications are received?? any idea? I am afraid that what will happen to people who already have used AC21 by following what currently exists???????

Dear IVans,
Now that the SEP VB is out, what does this indicate in terms of

- visa availability in the coming months

USCIS efficiencies :D : They are not efficient. People with PD in 2002,2003,2004 are still waiting and that are in 2006 getting released. Where is FIFO and efficiency in their process? No transparency in their process.

The dates are a joke.
Seems like they are just a diversion. to keep our minds occupied so we don't bother them with the real issue at hand. I can only say that whoever devised this system is a genius, albeit an wicked one.

i would be happy if every one has same playing field.. i am a pharmacist and for pharmacist they need Pharm D to get license which is equivalent to Ph.d. in US and we are still in EB3 and i think every one will agree that demand of pharmacist is much more than any other field...

The OP might be a person who needs EAD very badly....you know, to start earning for day to day living....
Receipts can give you sense of security in terms of your application but for those without H1 or L1 and expecting EAD, EAD can give them job and earnings.
I must agree - both are important..it is just each one of us have different cases and circumstances.

this article does nothing other than to raise FUD. Out of whole USA population this article says that 7000 births were from foreigners. and then it assumes

words like 'Many', 'could' are used to justify the 'research' someone has done.
of course it forgets that most of them could be foreign workers long term work visas.
The cost of average medical birth in hospital is above $50k.. do you think people have that much money to pay for it ? If someone has $50k to blow on medical expenses then probably they don't need US citizenship.
Secondly the article propagates the 'anchor baby' myth. A person can only sponsor the parents when they reach age of 18.

My 140 got approved yesterday! Just 7 days after they received the response to the RFE. :D
Btw, someone asked abt 3 yr or 4 yr degree. Mine is 4 yr degree.

You are correct to the 'could' part.
Let me begin my explanation by stating my position on debt default:It is bad, it' NOT worth it and don't ever do it. With the explanation that I will be providing below, I don't want to sound like I'm encouraging debt defaulting, which I'm absolutely NOT. There are severe consequences for your credit, if you default a debt.
So, with that accusation out of my way :), let me explain the logic behind why I think OP is ok. Only thing that is in OP's favor is statutory time-limits, he had dodged the debt bullet for 5 years,afaik, creditors including the collection agencies lose their right to take him to court for a debt older than 5 years from the first date of default. Unless, OP makes some kind of partial payment now, which will bring the debt to current. At this point it will be a mistake for OP to do that. Collection agencies force him to do that mistake with all kinds of scary tactics -- He got to have a thick skin to settle the debt with whatever he can afford once for all.
Secondly, collection agencies buy debt in bulk, like 1000 defaults at a time. Collection agencies go through a rigorous screening processes, including threatening phone calls, attorney-letter-head notifications etc, for each debt, even before they can take it to court. When they could not talk to him or trace him or find any utility bills of him for 5 years, they would just consider him as MIA. Unless this guy is a rich dude with Hummers parked outside his mansion all the time Or has couple of rental properties on his name, they will not risk further investment on this particular debt.
Like always, my 2 cents.
I stand by my suggestion that OP must seek help from a Govt or a not-for-profit Debt Help or the best thing is to seek Attorney's help if you can afford. Don't go to the collection agency or to any of your debtors first.

The creditor (or collection agency) can take you to court. If you don’t show up,the judge rules in favor of the creditor and against you. However, this judgment is just an acknowledgement that you owe the money.
In order to collect another court date must be assigned to perform a ‘writ of execution’. If they summon you for this, and you don’t appear, they may issue a bench warrant for your arrest.
If the amount is small enough, the creditor may just write it off (with impact to your credit history). But if its big enough they could go down the legal route.

i-485 was filed on 6/2007
between december 2006 and september 2007 company got worst and worst also real estate market. Some people kept saying it will get better. It never got better.

Anything less than 800,000 is good... even a few hundred thousand less :) There's still a lot of work and patience required but a good news is a good news nevertheless.
any news in Good News. Now with 480,000 less applications it even a better NEWS. But I aggree our efforts needs to continue towards reform. I believe even if they only change law regarding Counting Family members in Visa numbers. That will work very well for us.

After all these days it appears many people are still not clear about the difference between 485 processing times and priority date movement.
The two are completely different entities. When USCIS talks of backlogs they do not mean backlogs due to retrogression (PD unavailability). They are talking about the number of applications they received and the time it takes for them to process them.
When USCIS says it will clear the backlog by 2010, it means applications filed after that time will be processed in a timely manner (in less than 6 months). It does not mean that all the 485s before that time wil be approved. It only means these 485s will be processed and thrown into a cold sorage bin to be looked at again whenever the PD becomes available.
When retrogression started in 2005, EB2 India jumped forward by 6 months each visa bulletin. The reason was namecheck delays combined with the problem of Labors with Old PDd languishing in BECs. As both these problems have been eliminated now and also many EB3 filers from that time are switching over to EB2, it is highly unlikely that one will see wide movement in India EB2.
