Guys,
We saw the September bulletin..
We knew what to expect..
But we were all a little hopeful to see some miracle happen.
And we were doing this every month.
NOW comes the count down we all were waiting for the last few months. Oct bulletin. In that, most of us are expecting some good news.. But what if it moves 3 months forward.. What if it moves 2 years forward. Then it will stop there for next 1 year, while we check every month.. Then it moves back.. Do we want this..
Its not going to make much difference to most of us here.
THIS IS THE TIME TO ACT NOW. We must all do some campaign may be flowers, may be cards, or I donno.
I have written today to all the six members or reps to help us, but a bunch of mails will not help. JUst imagine if all the people in waiting sent the letters. Imagine 100,000 mails going to each of them, or 100,000 flower bouquets going to all.
Please please, lets act now. These small fixes cannot help us. If they want to put any quota limit, that should be at the main entry level whatever the non-immigrant category. Not at the other point when people start applying for GCs and suffocate here. We dont deserve this.
Please Lets act now., ONce again.. We did it in the past and it helped..
We need to do it again... Together we can do it. Together ONLY we can do it..
EB2 guys and others who got approved: . Please dont forget what you went thru. Please put more efforts and help all in case you can .
Sri.

I work for a reputed American consulting firm with 30000 emp globally. I am EB3 India and missed the July 2007 boat. After trying from last 2 years, I finally convinced my employer to file my EB2. I have a 4 years Engg degree and had 5 years work exp in IT before joining this company. I already worked 6 years in this company. Our Lawyers do not want to use any of my preious experiance, rather they want to use "Bachelor's degree and 5 years of progressively responsible experience" in my current employer as I received promotions in the past to became a Manager. I have doubt in it. but they are one of the most reputed law firm in US and I do not think I can question them in regards to immigration rules.
What you guys think? Will it work?

After listening to both the shows, this week as well as last week, I am wondering if it was worth the effort for IV to participate in Debo Kotun's show. Here is my personal comments about the participants and the shows.
Debo Kutan: He did a pathetic job in moderating the shows. He not only spent about 25 minutes talking about his future shows(prior to beginning of today's show), but also repeating the same information from last week and pretty much asking the same questions. He was more interested in talking about his immigration decades ago and how he got his GC in one day, blah blah blah...Also, he mentioned that he was going to get Sen Kennedy & Sen Brownback to participate in today's show..but that was probably some publicity talk to draw more listener's to his show.He repeatedly questioned us to go back to our countries and solve our own problems and as well as theirs rather than trying to understand the root cause of the current situation. He turned out to be very ignorant of the immigration woes and did not seem like he had done any research prior to conducting his shows.
Swadha: She did a good job of explaining her situation and the difficulties she was facing due to the retrogression despite her excellent credentials and qualifications. Thanks to Swadha for her efforts in explaining her current situation due to retrogression.
Carl Shusterman: As popular, qualified and expert he is in the field of immigration, he just turned out to be very ignorant of the ground reality. I was as surprised as Swadha, when he mentioned that people with advanced degrees can get their GC's in a year. Despite having 2 advanced degree's I am still waiting for more than 3 years to be able to apply for I-485. The people most affected by this retrogression are citizens of India and China, not someone from Monaco or Namibia. He was more interested in promoting his Immigration firm and his website. Wish he had been more vocal in explaining the broken immigration system, rather than gaining some publicity for his firm.
Stuart Anderson: He did an excellent job explaining his research studies and how the current immigration laws are affecting the economy and its long term impact, if the immigration system is not rectified soon. Thanks to Stuart for his expert comments and explaining our situation in a wonderful manner.
Rajeev Khanna: He did a good job in the last weeks show, explaining our situation and the broken immigration system. Unfortunately, due to Mr. Kutan's terrible job of moderating, he did not provide much opportunity for Rajeev to speak this week. Thanks to Rajeev for fighting for our cause.
Aman Kapoor: He did a commendable job last week, explaining about IV and its efforts. But due to lack of Mr. Kutans moderating skills, he did not get much time to talk today. Thanks to Aman for organizing and providing an opportunity for IV to discuss about the legal angle of immigration reforms and the difficulties faced by people like us.
Jay Pradhan: Due to technical difficulties, Mr. Kutan could not include him in last week's program, but he did provide him an opportunity this week and explain his case. Jay did an excellent work explaining his situation, current backlogs and also answering some of Mr. Kutan's questions in a very logical manner, like the way only he can do. I wish Mr. Kutan had given more opportunity for Jay to talk and explain the broken immigration system. Excellent job Jay. Hope you get more opportunities like these to discuss about our situation and shed more light to the general public.
Overall, it was some decent publicity for the problems faced by legal immigrant community, though I wonder if it was worth the efforts due to the pathetic job of Mr. Debo Kutan. Hope we can get to participate on more knowledgable/popular talk shows and showcase our problems.
Carl Shusterman was misleading when he said that Indian with Masters could get a green card in 1 year and then he corrected that to 2 years. He should see the plight of so many people here.

Applications were sent to NSC on July 19th' 2007. I got my receipt numbers today and all three numbers (I485, EAD & AP) start with WAC ### ### ####. The online status for the applications say that the 485 application was transfered to Texas Service Center and the EAD & AP applications were sent to Califorina Service Center.
Also just fyi, my I-140 app. is pending at NSC since Dec' 2006. So now I am all over the country :-) Don't know its good or bad. Any idea anyone?
Best of luck to all....

how dumb must someone be to get banned from a free website..;-)
You are also on the radar.
Here are some of your sample messages to other members.
IV has better things to do to help its members and this cause than tolerate members who are disrespectful to others and do not bother about this effort.
Let other IV members judge for themselves what is right and what is wrong.

I think you can get a letter from employer stating that they can not employ you any more. I am not sure if they issue a letter to every person that loses the job. Just make sure that your intention to work with the sponsering employer is documented somehow .
I have an idea here ... just write an email to your boss or HR stating "how good company has been to you and how they helped you with your immigration process and given a choice you would rather work with the same company"
Take a printout of all these emails and save them if you still have a chance. You can use all these to prove if you run into any problems during the naturalization process.
Apart from these things collect the news paper clips or company wide emails that talk about downsizing. These things should help you to prove your intentions if there is a query about your intentions at the time of naturalization.
If you think company will survive for 5 or 10 more years , just keep in touch with your HR
I got a letter saying they can not give me my job back dated 5 days after my approval.
I show up told them I was approved, they say sorry we have not sold anything on those 3 months, we are doing bad, cannot take you back.
They dont have any problems with it and I can wait 10 years to become a citizen if that is what it takes.

We cannot predict the future but we can predict with some given statistics!
If people who got their AP from NSC could just menion how long it took for them to receive ap document it would be statistical and we can there upon make some judgements !!
Noone is asking for exact dates from USCIS. We are all still very much in a limbo and this is just for getting some heads up!!

For 3-9 years, it is a good news.
For 10 and 10+ years, this is already laws in place in terms Social Security benefits. Hope that this does not worsen. Presently, retirement and some other benefits are available to foreign nationals such as India, if 40 points are accumulated.

how is it determined how long the EAD will be renewed for? If there are no fees associated with filing the renewal, then it probably doesn't matter.
Its the courtesy of USCIS and highlighting of our problems by IV made USCIS to issue cards for 2 years... there is no requirement that it should be as such... in general any EAD unless its L* is generally issued for 1 year with exception of C09-employment category where they are issued in looking at Priority date [ofcourse there are other exceptions like asylum... etc] if they dont get biometrics from their repository at the time of printing , they waive some of the features like fingerprint, signature etc.

what kind of logic / law is here, if you are a US citizen you can marry and bring your spouse, if you are on pending 485 you can bring but if you become LPR you have to wait for 5 years......
Is there any background for this restriction......... looks stupid to me.
Well H1B can bring their spouse using H4 .. so I guess GC holder can not bring their spouse .. I guess this is a hole in the system.

Let us get opinion of others on this. Should we write to law-makers to address this issue. Atleast these kids should not suffer. If they have got their most of the education here in US, they should be be given permnent residence before they go to college.

Denial reason Source of the Wage entered wrongly
ReApplied Date:02/18/2010
Approved Date:02/25/2010
H1 Story(Premium Process):
FedEx Delivery Date: 03/04/2010
USCIS EMail Date:03/15/2010
USCIS Received Date:03/12/2010 (According to Email)
End of Day 03/16/2010 Status online:Acceptance(desc says received date is 03/15/2010 )
Approved Date:03/17/2010( USCIS Email received by 03/18/2010)
Looks like we need a month time to transfer our H1 though.
Are H1 is Really in a speciality Occupation?
When we apply 1st time they are asking all the documents which is fine.
When we apply Extension they are asking all the details with Paystubs, client letter.
When we apply Transfer they are asking all the details with Paystubs.
Unless theyUSCIS) make a rule like H1 can work for any employer we suffer a lot and feel like slaves which is bad. There are lot of mental pressure when we deal with any H1 suff(new H1,H1 transfer,H1 extension).
The problem of changing employer you have to hold your current employer untill your transfer is approved. Also the Transferring company they need to wait for one month.
