I got RFE to submit employment history and AC21 details. My previous employer had file I-129 for my H1 and this triggered the query as per RFE Letter.

How can your previous employer can file I-129 for your H1B when you are not working for that employer? or you meant to say Your previously filed I-129 was amended so that some one else can use your H1B. I dont understand your RFE issue here

Ok check it on theextreme bottom part of your I-140 approval notice.. which shd say approved from TSC/NSC/VSC.. see if you see A number there.. if not I will tell you the alternate method

I raised SR on Aug 12th..No Response Yet...
Infopass appointment said that my file got assigned to Examination officer on Aug 4th...Not sure if Examination Officer and IO are same or not...
But the real kicker is i got second FP on July 26th, 2010 for Code 1...I didnt see any LUD after second FP...I am guessing this is where i am stuck with second time name check or back ground check verifications...
Also is it good to go for DHS 7001 form right way...i mean ombudsman request...
Donot worry about FP....2nd FP is not absolute must.....there are too many approvals without 2fp. Just hold on and you will get the mail outta blue.

My prediction was more on the long term like 5-10 years horizon. REITs have lost almost 70% of their values, but that's because asset value has gone down. If you want to gauge the returns look at the dividend yields on REIT which hasn't gone down that much. Besides due to free fall of oil and credit crunch we have deflationary pressure affecting the rents.
I don't think deflation is going to last very long, and sooner than later inflation will come back. and rents will go up. The enormous spending that is on card along with the money printed for bailout will eventually lead to inflation and dollar decline. Though I would rather have a deflation, signs tell me it is going to be inflation, call it my luck I have often been on the wrong side of the table. Look out for 50% REIT dividend yields in next 5-10 years.

On what basis you are saying that Oct'2008 PD will be similar to Jun'2007. Didn't you read the note in Sep'2008 VB that PD for EB3 category will retrogress further.
If you cann't support EB3 community then at least don't misguide people here. EB3-I is in severe pain right now and people like you can't understand it.
The EB-3 the Visa bull is talking about is that of EB-3 other workers not for general EB-3 category..
In Jul07 they gave away lots of Visa to EB-3 so from earlier years they may not be much EB-3's left..I am guessing..so it may actually start off at Mid of 03..

late last month my father passed away and I had to fly back to Australia to attend the funeral. My lawyer and I were already in the process of preparing my i485/ead/ap. They arrived at the service centre on may26 and I left the US shortly after midnight on the 27th ( talk about close). My lawyer told me that as long as I was present in the US the day that the Service centre recieved my applications, I was ok. I also had my L1 re-stamped in Sydney before returning.
So based on my experience, no you dont have to wait for reciept of filing, just must be in US when filled.

Finally we got our receipt numbers today from the Check Images. Our Application reached USCIS on 07/03 by USPS Mail. Don't know who signed it. Have been waiting for it patiently. All our receipt numbers start with SRC so from Texas. My I140 was approved form Texas and there was an LUD on the I140 on 07/28.
All the best for whom ever is waiting for the receipt numbers. You guys should get it pretty soon.

There are laws and there are exceptions. Basically there are no Laws when it comes to Immigration. USCIS/DOS can do whatever they like.
Look at Jul'2007, people with EB3 PD of 2004 got approved and people with 2001 are still waiting.
Look at EB2 approvals these days. People with 2006 PD are getting approved and people with 2004 PD are still waiting.
Can somebody explain how PD in each VB goes backward? Is it possible to get new applications with older PD in between? Don't they have computers with all the data where they can see how many applications are pending?

I dont know why everybody started to spit on ohio law firm. They just pointed out some news that they got from AILA, right? Lets hope its just a rumor and USCIS doesn't proceed with this revised thing. I am pretty sure that wont happen. Dont worry guys, but dont blame everything on ohio firm. I saw this on several other law firms too.

If you want to change the employer with in 180 days of filing 485 - there is a risk involved. If your 485 approved with in the 180 days then you will get in to trouble. If your 485 is pending more than 180 days - irrespective of when you changed employer before 180 days over or after 180 days over are does not matter - and you will be safe.
If you change your employer with in 180 days - then you have to pray to the GOD for not getting approval with in 180 days of filing.
I think it answers lot of lenghty questions either one way or the other.

I am really surprised by the meek response...what is wrong with everyone?? We have just abt 54 letters so far and almost 200 members online right now !!!
If you are reading this but have not written a letter yet, please answer one question for me:
What is the least effort that you can put towards your immigration?
If you cannot write or type a letter, i'm afraid you don't belong to the "Hard working, highly skilled" immigrants that is being referred to in the letter.
Please send me a Private message with your name and deatils and I can write up and post a letter for you....its is actually going to be for me as I am benefitting from this campaign...i don't mind if you get the benefits in the process.
I have the capacity for 3 hand written letters per day...and I am dead serious. We need numbers and a meagre 100 letters are going to get lost amongst thousands of letters that are received at Whitehouse everyday.
People got used to Drive through mentality.

The real message in this thread is that you should check what is required by the countries you intend to transit BEFORE you buy your ticket.
It seems to me that an individual should take responsibility for his own actions rather than trying to blame a particular country for a long established requirement for a transit visa.
Maybe you can help the Brits to add more questions to their Transit Visa form from 111 to 1011.

This is the reply from Attorney Murthy on a question asked on Murthy chat about filing two employment based I-485's for the same beneficiary (not the husband/wife situation).
"Generally it is safer not to file 2 separate 485s since it can confuse USCIS since they may assign two separate Alien or A numbers to the same person. This could end up delaying the person's I-485 approval down the road or create a security delay in many cases with multiple I-485s generally we recommend one case to be filed as an AOS and the other for CP if possible."
After much research on this, I tend to agree with this answer above (not the CP part though). As per my latest information from a lawyer who does multiple filings, the processing delay can be significant due to this. Looking back, wish our community had more information on this and more real examples of people who have done it. It would have helped members who were unsure if they should do multiple filings.
Anyways this thread will be useful for future I485 filers.

I completely agree with your last 2 lines. But I don't agree with the even dividing of the number into 5 categories of I,P,C,M,ROW.
Let's take an example. Suppose for some odd coincidence....the first 8000 odd EB3 apps that USCIS processes starting Oct 1.....none are from I,P,C,M. Suppose First 2500 are from Uk, next 2500 from France, next 2500 Germany and the next 508 from Pakistan. Now the number for ROW at this point would be 8008. Now they get another app from UK next. Will they refuse to process that app as the ROW figure had reached? Then they will still process more than 2500 for I,P,C,M. Won't that be unfair to UK applicants.
As I have said a couple of times now, and so have a few others - ROW cannot be capped at X/5. Due to the high demand from I,P,C,M....it likely gets a MINIMUM of (100 - (7 X 4)) X EB3 cap.
That was a ateempt to establish a "fair assumtion" so It may be wrong. But simultaneously you also should not assume FIFO within EB-ROW as you tried to explain as we really do not know whether USCIS follows FIFO.. Bottomline USCIS, by law, can not exceed 9% limit for any ROW based countries (Britain, pakistan,...) as well.

My husband's petition is from a reputed company, and its an L1 blanket petition... the petition approval date is somewhere in Nov. 2007... does this mean that it would take a long/short time to update in PIMS?

I would like to file my 485 by myself and I believe I can do all what is necessary. But problem is attorney was handling everything so far. Now it almost reached a point that attorney fees for 485 will be too much to chew. My question is how to handle this situation, like convincing the attorney and he handing over all the papers etc..
