Most employers pretend as if they dont know anything about retro, whereas they have employees in their own company in that situation.
Lot of people do not know what they are gettng into, a lot of new H1b applicants go look for employers promising Green Card carrots and switch jobs only to find out at a very later stage that they are retrogressed. Same with sub labor, lot of people switch companies as they get sub labor, just to find out later they cannot apply 485 due to retrogression.
A lot of people still don't know what kind of mess they are in. I tried explaining this to a lot fo people who do not understand, and they never made an attempt to understand, thats the reason why IV still has only several thousands members where those affected by retro is in lacs.
My only advice to you is "think positive", "put a lot of effort in your skill and job", "stay put with latest news", "Help IV" and be careful with employers or lawyers or body shoppers

One simple and effective way to increase membership is to get your spouse informed and registered.
I know my wife has just as large a network as I do, so that is one more avenue to get the word out.

I have similar situation - I applied for 140 in July 2006. My daughter will turn 21 in July 2007. As I have applied for 140 before she turns 21, she is safe for GC, but will loose H4 status when she turns 21. As per my lawyer's advice I have applied for her F1 so that she can stay and continue her studies in US. When I become eligible to apply for 485, she can be included in the application - but, not as a dependent of H1B holder.
The date of petition - Is it the date one applied for the Labor Certificate, or the date of submission of I-140 petition?

Only US citizens can file for a K-3 visa. Geencard holders will have to bring their spouse on a non immigrant visa (HI or L1) or under the F2A catogory for family based immigrant visa which is heavily backlogged.

My I-140 was approved in June.
Even as of now- the processing date in NSC for EB2-NIW is Feb 07.
My EAD was approved in July, has the NSC processing officially reached my RD? of course NOT! It's still stuck on April 16th.
The dates are a joke.

I was in a similar, but slightly different, situation. I got my 3 year extension while my previous extension was still valid (a couple of days left).
So at the POE, the officer gave me on the I-94 a date that was 3 years from the date of entry (that's the max their system was designed to handle) and said that since I have the visa on the passport, the next time I reenter I would get the later date on the I-94.

dont worry about actual salary being higher than LC salary.
i had the same issue last year...my bonus put my total salary over $50K than what was listed on the LC. i checked with my lawyers and they said that was fine.
Just curious - Have you heard of a case being rejected just because the salary was higher than the original LC ?? (Assuming job title/description are same or similar). I think it will be almost impossible for them to reject just because is higher!! Govt. cannot dictate the upper limit of salaries (in private sector).

I received receipt nos. from CSC. Later i received EAD also. Today i received mail from USCIS stating that my case is transferred to Nebraska. :(

Does anyone kn ow if the 485 receipt is required tog et FP notice?

Yesterday evening even my case got transferred to local USCIS office . I have LUD on my I140 for today.My daughter's case is still with old LUD.

Anyone can throw light into this one. Can we track APs now for NSC.
NSC is receipting late and also their AP documents are mailed very late. Please let us know when we receive our AP document after getting the receipts? for eg. 10 days, 20 days etc..
It will help lot of us who want to make some travel plans.. [some like us are eagerly waiting for past 4 yrs!!!]

They should also allow people from Backlog Centre (PD 2001-MARCH 2005) to file 485. Looks like they really cant make any impact. How many more years to wait just to file 485 ? Oh Gosh....

The dates for H4 I 539 renewal are struck at 14th June 2007 where as most of people who filed their renewal's have already got it. These dates are meaningless.
No. That means ALL cases filed before 14th June07 have been processed. You may have filed on July 1st might have been processed, but this has no relevance to the previous statement.
That's why I think all the 485s filed before July 27th 2007 at NSC have undergone some processing, if not completed.
Problem cases, those which may need RFEs may get notified in the coming weeks.

I don't see a reason why you want to campaign, is it just because this months visa bulletin didn't make you happy?
Sending flowers and telling USCIS how to fix their issues will not help. We must stop and think first before we ask them to do this and than.
Good to see the count already three (here) in just 30 min of posting this idea (IV's one of the peaceful ways). So I am sure there will be huge response. Please spread this message as much as you can, and see if we can gather a good #.
ALSO we will have to wait for IV Admin to approve this, as I am just a junior member and dont have that capacity. WE MUSt start one more campaign.
Please spread this among your friends and make a difference. On this INdependence eve, lets work in the same lines as those great people did. We may like one leader or we may not like due to their approaches. But one most common thing you will see in all is UNity in what they did and strength came from there. What we are asking isnt that big a deal to fix. Simple admin fix
