How can you say that its not legal? When you sign that contract or piece of paper, it means you are acknowledging to all that is in there. Whether you like it or not, when you sign a paper you essentially are saying, "hay! i read this and I agree, here is my signature"...correct me if I am wrong...

Who can get regulation change done? Companies like Microsoft, Oracle etc...they have the bandwith and financial muscle to lobby and make regulation change happen....
IV can grab and influence media...let's just leave it at that....AND BOY WHAT A JOB IS IT DOING!!....HATS OFF TO IT....THE FLOWER CAMPAIGN WAS A GENIUS IDEA.....AS LONG AS ONE CAN INFLUENCE NY TIMES/WASHINGTON POST/NPR TO REPORT ON IT....THEY HAVE SCORED 100 out of 100 in their media blitz!

I am primary applicant on our 485 application. Mine and my daughters case doesn't show any LUD. But my husband's status changed to case transferred to local USCIS office. He was on H4 for 6 years and have not used EAD yet. No gaps in Visas. no law violatiobns. Prerry Straight forward case. Recently we applied for Online EAD Renewal.
Any idea why his case might have got transferred ? What should we expect next?

Do you have your I-140 approved and if yes, have you passed 180 days since you filed your I-485? If answer to both the response is yes, then nothing to worry about as you can simply work on EAD.
If you are still considering transfering H1-B, start looking for a company immediately. Small India companies who do H1 transfer can be little helpful in your scenario but watch out for crooks.

28.6% Each for EB-1, 2, 3
Divide this 28.6% into 4 quarters/12 months so each quater/month has some quota.
If divide into 4, each category has 7.15% quota in each quarter.
There's limitation for each country.
Each quarter, when a country hits the limitation, cut-off date shows up to make sure no more applicant processed for that country.
Back to the old time, unused quota after 4th quarter are going to trash can, despite there's cut-off date for certain country or certain category.
In 4th quarter of 2007, according to USCIS, To not waste the quota, they set every category current. In this case, they process your application randomly or according to the receive date to USCIS regardless your EB category or country.
So very likely unused EB-1 quota go to EB-2 ROW, not China/India/... if the country limit is hit. If the country limit is not hit, EB-1 quota is for EB-1 until EB-1 for every country is current. There's no EB-1 ROW quota or EB-1 India quota.
Hopefully, at the 4th quarter, they will push a big forward again(but please don't do current in every category again, that is a mess) to ensure the quota for the year is fully used and not going to trashcan. And that opportunity is even to everyone if they pick up the case with in the cut off date randomly regardless receiving date and country. Or they process it according to receiving date, FIFO, country not matters.

Hi,
I may know the answer, but I thought i would check.
Below is my situation:
1) I-140 approved in Jan 2008
2) I-485 pending since July 2007
3) I have a 2 year EAD
Now, if I switch my job and the new employer is not ready to transfer my H1-B, can I use my EAD to work(provided my I-140 is not revoked by the previous employer)
Also, any chance that I could keep my GC application alive? what will happen when my Priority date becomes current.

If they do that assuming 500K people apply for premium they can generate over 2.5billion dollars. Add to that all the investment this 500K people will make once they get their GC. My advice: Dont wait for GC. The world around you is moving very fast and US is one country that is left behind. At 31 I feel the pinch of not going for my MBA. I'm planning for 2009 in INSEAD or ISB. My PD is June 2007. I'm not waiting for the stupid GC. There are better places to go and life to live. One life make the best out of it.

There is no such status as "out of project". Based on the fact that you do not have a job and your employer is not paying you, you are out of status already. It is your employer's responsibility to pay you no matter you have a project or not. In fact, it is because of cases like yours that USCIS has raided those desi body shops and put them behind bars.
My advice to you is change your stauts ASAP to F-1 or if you are married, then to H4.
If the bove two options are not something you can do, please leave the country.
I already put a transfer in Oct 2008. since I am not sure about H1b approval of old company.
Its in pening status.
Out of project since one month.

I think you make some very good point about funding. I see some people complaining how a lot of members aren't contributing. I think it is plain naive to expect everyone to contribute.
People can be divided into three types:
1. People willing to fight what they percieve as injustice.
2. People who complain but do nothing about what they think is unjust.
3. People who accept injustice as part of life.
This isn't just about immigration. It could be any issue. Most ppl want someone else to do what's needed. They don't want to spend time or money. There will always be a few ppl who are active. If you belong to category 1, don't expect everyone to belong there.
The other aspect IV should consider is broadening the goals. IV has done good work but the core focus seems to be retrogression. Tens of thousands of ppl have cases rotting in BEC for 3-5 years they are not going to contribute to an organization that will put them at par with ppl who filed for labor in the last couple of years. It goes against human psychology.

That effort, although endorsed by the core group, got 88 people to vote, and was criticized in these very forums as being a waste of time, or not the proper way to do it. Of course, fast forward a few months and now look...
I also find it distasteful to have to read through threads that could be of some importance or value, but find that good chunks are just "Hey, look at me, look at how much I contributed"
So, since I'm all bitter and alienated , why did I actually contribute?
Every time I get annoyed or offended by someone's insensitive or cultural narrow mindedness, I try to ignore it and remind myself that that single person does not represent the values of the core group and this organization as a whole. It gets challenging.
Please don't flame me, I am trying to be honest

We should put end to Lou's lies. Let's be creative. We thought of the flower campaign, we all have higher degrees. There should be a way how to stop this guy. I think we are the only ones who can do it.
By the way, Lou's ancestors came to USA also legally like us. What is the difference then? Really the only people who have the right to criticize the legal immigration to USA are the native Americans. I know that this argument would never success with the general public here but I believe it's true.
I don't think that Lou's ancestors even had visas. They probably came on the Mayflower, went to Ellis island and were just allowed to live anywhere they chose. Atleast we came here with legal paperwork.
