gc_chahiye,
I don't know exactly what AC 21 regulations are.I just want to follow any best Lawyer's advice in this matter.
h12gc
Your GC is your responsibility. Better to know all AC 21 regulations and act accordingly. Lawyers do goof up. I suggest you take conservative stand unless you are ready to take any risk. Personally I am risk averse as far as GC is concerned. Think whether the extra dough or career change is much needed for you.
The job title Technical Recruiter itself is like painting target on the shirt and going into the field. I think RFE is guaranteed.

I see an update on jan 24 on this bill to grant 55000 visas for advance degree holders from DV lottery. Does this mean progress? Rest of the immigration bills never make it to the sub committee.
Jan 5th Referred to the House Committee on the Judiciary.
Jan 24th Referred to the Subcommittee on Immigration Policy and Enforcement
Interesting...looks like this bill is moving faster than we'd think...it would be interesting to see where it ends up. Also, it appears that this bill does not talk about giving the DV visas to existing EB-X categories but instead to create a new EB category for STEM graduates...not sure, but that's what it sounds like.

I have sold a house in US while being physically in India. All you need to do is give a notarized affidavit to your Realtor and you don't need to be on the closing table. There is always a solution to worst case scenarios. Dude do some googling and you'll know what I am talking about.
You need to live in that house for at least 5 years to recoupe the commision/closing cost. Will you pay the loss if someone needs to sell the house suddenly due to immigration.

whoa
I did not know it can be that bad
r u working in the USA now?
yes I am working in the bay area.
Back in 2001/2002/2003 I have seen many friends having to return to India (from the bay area) because they could not get another job. All the desi consulting companies that everyone bashes so often? they are the saviours. They are typically the only ones who hire in those times. All the big companies will have hiring freeze's and massive layoffs.
Its already started in the US (Sprint:4k, Lehman Bros 1300, Motorola 7500+1600, applied-materials 1000) but this is the mere tip of the iceberg.
Its starting from the financial sector:
http://news.google.com/news?q=%22cut+jobs%22&sourceid=navclient-ff&ie=UTF-8&rlz=1B3GGGL_enUS230US230&um=1&sa=N&tab=in
but will probably spread all over.
The real mess will start in Q3 (thats when we'll know if we are really sunk or some last minute stimulus is goign to keep this recession short and quick). Most probably this time its going to take much longer than 2001/2002 to recover. Back then the dollar was strong, there was a huge fiscal surplus and inflation was not a risk. This time none of those things are there and stimulating the economy is going to take much much longer. Also, to an extent in 2001/2002 it was only tech that imploded. The rest of the economy (& consumers by extension who are the main drivers of the economy) was ok. This time its widespread, consumers across the board are hit.
The July VB was a huge blessing in disguise for lots and lots of people who will be able to maintain status even if they are jobless for a few months. Back in 2001/2002/2003 the option was to be out-of-status of return home. Many chose the latter. This time they can atleast get a job offer from a desi consulting company and keep looking for some consulting gig.

Basically to retain the PD you should have the copy of the I-140 approved and you could retain the PD. Having said that, different lawyers have different interpretations when you switch jobs and retain the PD. Basicallly some lawyers say you could retain the PD even if your old employer uses it for another person after revoking yours, while others say you can't retain PD if your old employer revokes your I-140. However if your old employer willn't revoke your I-140 then you could definetely port your PD with your new employer. If you employer is hesitant to give, you could try asking him other ways if possible for H1B stamping etc.

gimme_my_gc, do you have EAD?
If yes then.. you are NOT out of status...only worry would be Annual W2 salary of your needs to be around gross specified in Labor..
Hi All,
I just joined this site today and wanted to get some input on the following situation:
My current situation is:
Working for a company ABC
completed 6 years on H1 and currently in the 7th year extension
Green card in process for more than a year - Eb3 with PD Jun 2002, I-140 approved
Can extend H1B again in about 6 months, for a 3 year extension
The question I have is , if one has a valid extended H1B for the 7th year and beyond, what happens if one were to lose their job during the extended H1B period, without getting their GC?
1) Can they continue to stay till the end of the extended H1B period by applying for a job with another company?
2) Or should they leave the USA as the first 6 years have been completed without getting a GC, and the extended H1B period would become invalid as soon as they lose the job with the company that processed the extended H1B?
Any input is appreciated. Thanks for your time.

Here is my situation, someone please suggest me:
I am using EAD to work for my GC sponsoring company and I got laid off. My HR says that they are going to inform USCIS that I am no longer working for them. HR also says that they won’t cancel my approved I-140 and going to rehire me once I get the new project.
My question:
When I joined them there is information to USCIS.I just filled I-9 form and gave it to the company, no information to USCIS. Now when I got terminated what is the need for the company to inform this to USCIS? Anyhow I am going to join them once I get the new project in couple of months. Is it a new law? Will there be any problem at the POE if travel outside US and come back using AP? Is there any chance that USCIS sends me RFE?
Thanks In Advance

I was just thinking, the wastage of visa numbers we see, is that basically due to the per country quota. The rule that no country can have more than X% of GC's in a year, would mean that even though there are visa's available, they cannot be alloted due to that per country limit.
Anyway the smaller number of application is good news.
-AD
thats not true...ac21 is under suspension because eb3 row is retrogressed...once its not, the ac21 trickle down of visa numbers applies.

Indeed, what an ironic day... we have two headline news items concerning Indian Americans...
The Good: A 35 year old Indian American is tapped to head the $700B bailout fund...
The Ugly: A family of 6 dies in LA in a murder-suicide ...
What does this say?
Neel Kashkari, Kashkari, an Indian-American who was born in Ohio, is one more example of how Paulson has drawn on former executives at Goldman to staff Treasury. Paulson also leans heavily on former Goldman Sachs executives Dan Jester, a financial institutions banker, and Steve Shafran, who focused on corporate restructuring while at Goldman

I got an RFE for I-131 for both myself and my wife. They have asked for absolutely everything (I-485 receipt, I-140 approval, I-94s, I-797s, marriage certificate, Passport copies etc). As my lawyer said "they have thrown the kitchen sink at you".
I dont even know why - but the amount of documentation they have asked for seems absurd just to issue a travel document.
BTW - my EAD from the sample application was approved!

which category do u belong to EB1/2/3, which country, what ur PD.
based on that i can tell u whether u should keep ur username as optimystic or change it to "pessimystic"
As another member already indicated , I already mentioned my PD, country and EB category in my post.
Anyway, I had already waited 7 years in the GC process before recently coming across this forum and choosing this handle name when joining. Guess you could say that I was prepared to dig in and stay for the long haul if required which is why I chose that handle name. A few ups and downs/ forwards & backwards (even if in years !) in the priority dates won't deter me much now :).
Although, I could just be drunk with euphoria of my PD becoming current in March and blabbering away pompously. So don't you steal that login (pessimystic) away from me ! I reserve the right to choose it if and when I feel so :)

For adjustment of status you should be in a Valid H1.
Incorrect
If you get your EAD before Setp 16th then you can use this to work and you are safe.
Correct. However if you have H1 extension pending you can still work for H1 employer without EAD
If you dont get EAD you are basically out of status.
Incorect.
The person is in AOS Pending status.
So I suggest get your H1 Renewed Right away using Premium or regular processing.
Again this is my analysis check with your lawyer.
See above in Blue.
