not sure about the banning part, but i do agree that it is causing us to loose focus and unity. I feel many are leaving because of these EB 2 vs EB3 posts.

I have been owning for 7 years now. I bought the first one in 2000 and sold it in 2005 - though most of 2001 and 2002 were in recession, I still made 200% of what I invested. But do not see house as an investment. For me i want a place when I retire. If it appreciates its good.
I have my mortgage with penfed.org. They have the best rate available. They are slow though - do not expect them to close within 30 days.

IMHO, this is a legitimate website as I have been getting updates from them regularly and they are a supporting group for illegal immigrants path to legalization. As per the email I received today, anti-immigrants have sent 693,437 faxes to Washington this month to oppose reform.

The customer rep said that I am in legal status pending my H1B petition. I heard about the 240 day rule. Through my research I learned that I can work and stay in U.S until 240 days of I-94 expiration. After 240 days I can not work, but can stay in U.S peding H1B petition. I am not sure how far this is correct. My companies attorney says that I have to wait or go through the senator to see if your case moves. Aren't we legal as the case is pending. Mysterious laws of USCIS to cover up their own faults.

Even my spouse's GC which is approved on Aug 3rd which was sent back undelivered.
We called the 1 800 number and opened a SR.
But we didnt have any thing after that.
The case status went to initial review after that.

Is there a conspiracy, first there was delays in the processing of the EADs, now there is delay in the production of the EAD cards...
Are there more RFEs happening too?
My EAD renewal took almost 90 days to get approved, and my employer was ready to let me go if I did not get the approval before my EAD expired. Just made it with 2 days to spare.
Why every discussion has to end with donate - why donate? What IV has done so far? Where the money goes? EB2 vs EB3... etc. Stop hijacking threads.

I am not saying we shud do anything forcefully. I am saying, that if we have to show IV's face as being multicultural and since we Have members from all over the world sharing ideas on here anyways, might as well show the media that aspect.
In my opinion, if general public/law makers see faces from all over the world complaining about the GC system, it would have more impact.
If a core member/moderator can comment on this, that would be greatly appreciated.

i am on my 3rd year of waiting for name check to clear, i hope the congress woman does something about name checks too. That nightmare is worse than anything at USCIS, there is no one who has been able to help or expediate with name check, even the congressman i contacted said they can do nothing about it besides ask for a status.
There are over 339,000 people stuck in name check - this is done for naturalization and 485. I can bet you this will be the next battle because a lot people who have filed 485 will get stuck in this black hole, where this no accountability by FBI to individuals because the "client" is USCIS and last quarter there were 400 law suits (Writ of Madamus etc) to force USCIS and FBI to do their jobs. It would be best if setting time limits for name checks are included in IVs goals now itself. No point in jumping from the frying pan if one is going to eventually land in the fire. The name check snares a lot of Indians, Chinese, middle easterners, russians etc. Most people stuck in the name check have never been involved with the law - go figure the algorithm FBI uses to trawl the ocean bed!

That is equivalent of approx 22 miles. I doubt there is anybody is bombay that drives 35 km one way on a daily basis. But in the US living 10-20 miles from work is not bad. People in my office drive about 40 miles one way without blinking an eyelid. Some drive even more. Plus the cars that they have in india have smaller engines, smaller capacity thereby better gas mileage.
So for people who say gas is a non issue, think again.

When I was hired last spring, I was not told about GC retrogression by my employer. I beleive they should have explained in graphic detail and if they done so I would not have left a good job and my home in Canada to move to an American nightmare.
I recently discovered that I have at least a 5 year wait as an EB-3. My teenage daughter will be too old to get a green card as a dependent and my wife is seriously depressed about not being allowed to work.
How many other people are as P-Oed as I am and is there a class action suit here?

At the worst you can say that they are ethically wrong...
They have no obligation to explain anything to you...

They will not get I-94 for more than 6 months. You need to do following things to claim them as dependet(s) -
1. Extend their stay beyond I-94 i.e. 6 months.
2. Get ITIN number for them. (I am not sure how you get it on B1/B2)
This is the primary reason, immigration does not give more than 6 months I-94 on B1/B2 and avoid extending their stay....even if those are genuine reason(s).

Thank you for the info. You might be correct. But there is no way for us to know that our application got transfered or not. I am just assuming this is the case for me so that I can feel better and not to worry for a while. I filed on July 19th to NSC. 140 approved from NSC.

With regard to HSMP issues in UK some Indian Minister (I think PC Chidambram...) made a public comment a few days back and the political establishment in UK took notice.
For US, people need to write to India's PM Manmohan Singh. If 50,000 letters go to him then he will talk to Bush and something can work out. NRIs anyway have a lot of say now in Delhi unlike 10 years back when they were totally disliked. Just wasting time on chat boards will lead to nothing. Even Microsoft and Intel are unable to convince politicians here. It has to come from a higher authority with whom there are mutual stakes involved. It makes no difference whether they allow concurrent filing of 140/485 or not IF YOUR EMPLOYER IS WILLING to pay extra premium processing for 140. IF not , it makes minimal difference (2-3 months delay). Earlier this year, people were getting 140 approved on 6-8 weeks average without premium fee.
If your date is not current:
This rule makes 0 difference. File 140 and wait for approval while your date moves forward. Once its current, file 485.
If your date is current: File 140, regular processing 2-3 months and then file 485. If you can get premium processing done then it would be 15 days and then file 485. Either ways, you are delay in filing 485 by 2-3 months. In the grand scheme of things, its negligible. It would take even 2 months for your lawyer to get the paperwork straight for filing 485.
So please relax, this new rule that does not allow concurrent filing of 485 and 140 is not earth-shattering. Its a revenue generation move. And its good as long as revenue stays in USCIS as they do need revenue to hire more people to process files faster, which is in our own benefit. mallu is right. H1B status expires immediately when a person stops working. An employer is required by law to notify the USCIS about a lay off and the USCIS revokes H1B as of that date. There is no grace period, so the only chance to preserve H1 status is to find a new job and file H1B transfer BEFORE the lay off. Preserving I-485 is a different story and you are in a good shape regarding GC. Just find a new job, use EAD and stop worrying about H1 status. It does not worth the hassle and you may not get any benefits from H1.

Many of the eb3 people with earlier pd are in the current mess because lawyers thought eb3 was the safe way to get gc! Now, we are stuck and they are making money of us!

It only makes me wonder how many more applications with PDS older than 2001 (substitution or not ) from India are still pending :( . Good luck to all of you guys who has PD older than mine (Sep 2004 EB3), unless you are out of the queue I dont get mine :)
