    The LAWSUIT has immense WINNING POTENTIAL.... Instead of losing in court of law and make that a NEWS in major mainstream media GOVT agencies wrap up mistakes in this way. This method works everywhere , so that the noise level remains low.

    As the lawsuit progress they may offer Financial compensation ... anything can happen if you can Prove that you have been beaten financially for a wrong announcement... I mean if you can show receipts between June 13th and June 30th and that document is a requisite in 485 application anyone can claim compensation ...

    That's how american JUSTICE system works for citizens ........

    My I485 is pending, recently I have changed my address online. I also recieved confirmation letters for this address change.

    After 2 weeks of address change, USCIS issued an RFE. I have not yet received it, but I just want to prepare for this.

    What could be the reason for this RFE? Is it common?

    seriously dude..whats urgent about this? why do people create new threads with words like urgent, please help, etc etc, when the matter is not even urgent. This is a public forum, if its really urgent case, i have seen lots of people including myself, pitching in and giving their advices. And also, if it is really an urgent issue that you can't wait for responses, you need to be talking to the lawyer.

    now coming to your case, i have no reason to believe that your case / question is urgent. You changed address and you got an RFE. you can respond to RFE as long as you are in the same/ simlar job description or whatever the RFE is for. You do not even have the actual RFE with u yet. Tell me whats the urgency about this. Infact if you just follow my posts, i have also posted to a thread that deals with responses to RFE's. I am wondering whats the need to open a new thread with URGENT as the thread name.

    I hate to tell this, due to posts and threads like this, people who really require help with some urgent issues, their posts gets ignored. Please understand that this is a public forum and understand that I am just using your thread to send this message to everyone who does this. Nothing personal against you. Hoping you will understand..

    My 6th year H1B is expiring on April 28, 2008. I applied labor through PERM on October 2, 2007. I got the audit letter on December 3, 07. This audit letter does not state anything about the issue of the audit letter. However, the sentence �The job duties and/ or requirements are beyond those defined for the job by SOC/ O*Net code an Occupation Title provided by the State Workforce Agency� is highlighted in this letter. The letter also request for Business Necessity Letter and Recruitment Report. My case is the EB2 case for a Project Manager position with a minimum of 2 years working experience. A couple of programs and knowledge in the field are also required for this position. At the recruitment times, there are no applicants applied to this position. The company has approximately 16 employees including me.

    I�m very confused and not sure what to do because my lawyer refused to answer any question. In my case that the Labor Certification is still pending (under audit) and my H1B is expiring in April, I wonder if I should start taking vacation now or go to work in another country for approximately 6-7 months and come back later to use the rest of my H1B until October 2, 08 to meet 365 days period? After October 2, 08, I can then start filing the H1B Extension for 1 year. Or should I wait until my I-140 approved and come back around October 2, 08 and do the H1B Extension for another 3 years? Or should I stay in US until April, 08 and take vacation until October, 08 and then comeback around October, 08 to file H1B extension? Also, do I still have to be employ full time with my current employer during this whole period? Can the job only be part time? Also, do I have to get pay the whole time from my current US employer during this whole period? Thank you very much for your help.

    nobody complains about somebody getting green card getting in six months, infact I know somebody who got green card from india onmployment basis, the problem is people who have waited for 6 years or longer feels the pinch, because
    they have followed the law just like the guy who got in 6 months , and they see no light at the end of the tunnel, and frustration to certain degree amounts to anger.

    chilllllllll enjoy the system, this is how the system works, like it or not.

    look I have been here for 10 years and I kick my self everyday for not getting card, if I played my cards right I should have been worrying about citizenship now :)

    many of are here for good reasons of our own deed and situations which are beyound our control, 9/11, immigration politics etc. the best way to get around this either to follow some lope hole such as labor subst, L1 etc, or fight the system thru IV, or just simply wait,

    complaining that someone else is getting greencard is nothing but childesh and I hate to say this as it comes from a "Highly educated" guy like who did is MS from US :D

    My point of view: Recession or No Recession - If u r strong enough and a needed resource, therez no way they r gonna lay u off --- Again just my POV.

    its not that simple. were you here in 2000-2002 also? When the whole company is running into major losses complete department and locations get wiped out. Does not matter how critical a resource you are. If the people at the top decide to scrap the product, the team goes with it. Thats how companies like Nortel, Lucent etc manage to go from employment figures of 100K to 30K in a couple of years...

    We have many in our company went back to India after applying 485 or with pending labor, their GC process still in progress

    but they choose to goto India mainly becuase of uncertain GC process

    I myself have a good offer from my company which I am pondering on, I am stuck here for a while to finish my masters

    if I go back to India, it could be that I might taking many more jobs, as I need to train and build a team in India and replace my team here

    oh well, I am sure there are stories similar to this we got to find it, we need to show losing one skilled labor could also mean losing many more

    Press coverage in India is an excellent idea. I think this bloody american press is biased. We should all write to Indian press and highlight our issues in strong words. If we can get 100+ letters to TimesofIndia, HT, IE , NDTV, Deccan, Hindu, etc, we can highlight the discrimination and indentured servitude to the young Indian generation who has high hopes for USA. If 100+ H2B workers can stage dharna in front of an embassy/white house why cant issues of Indian people get highlighted? Lets us show the job here in the same light as slavery in middle east. I am sure David Mulford will be ringing a few phones after that.

    "Representative Elton Gallegly (R-CA) introduced H.R. 133, Citizenship Reform Act of 2007, which would limit citizenship by birth to children born to at least one permanent resident or citizen parent."


    Does this mean that if we do not have green cards our childern born here are not citizens. Am I understanding it right..


    This requires a change in the constitution and I do not think it will ever pass.

    Thanks for the link. I looked at it before I posted my case but I don't think it was a mistake by the customs officer. He specifically told me that he cannot stamp the date of the future I-797's expiry date (Jun 2010) and asked me to contact my local office just before the current visa expires. My current one expires June 04 2007. The future 797 is valid from June 05 2007 till June 04 2010. But my visa stamping in the passport is till June 04 2010.

    If you are on EAD before leaving US, you better to continue the same status. Their might be a situation for USCIS considering giving up your AOS, if you enter US on H1b while you were on EAD before leaving US.

    frankly this is a drop in the ocean.
    we all know that the process is broken. we all know that we face long years of waiting because of retrogression. ask BEC filers how bad things can become suddenly. ask people whose name checks have not cleared in 3 years.

    we have our choices. we can wring our hands about who gets receipt notices first and whose ead comes faster. or we can try to be the grassroots organization that immigration voice really is (rather than exclusively an info forum for tracking dates) and stand up to petition for reform

    these are just today's irritants. with 1 million applications at various places in the line, there will be many more tomorrow.

    please choose wisely.

    Ok I have started exploring other alternatives but still I don't want to let go my efforts which I put for completing couple of subjects so I went back to U21 global and they said that they can give me degree from University of Melbourne, if I opt for it. So now I want to evaluate getting degree from University of Melbourne is ok? It seems they just now got AACSB accreditation.

    However I am not sure the online program will have AACSB accreditation.

    In fairness to the OP, he/she said that "...while TSC filer are getting ead adn AP as SOON AS THEY GET RECEIPT...." (emphasis mine).

    He/she didn't mean to say that NOT GETTING any receipt is good as long as you get your EAD.

    No Hard Feelings...as some body said earlier Grass Is Green on Other Side..
    You can't say "In-Justice" because of diff priority..NSC thought to let every body get receipt first then work on EAD's and AP's. So they are issuing those faster.
    TSC is working on both parallel.

    Same people they would have been on other side of situation wud have said that It's better to receive the receipt first than EAD.
