Hi,
The plight of legal immigants has been lost in all the noise and focus on illegal immigration. There are about 500K legal high-skilled immigrants from around the world who are presently working in the US legally on a temporary work visa issued by the US Citizenship and Immigration Services and in the queue for a permanent resident card also known as Green Card (GC).
There are only 140K GCs given per year for all employment based categories and the employer who sponsors the immigrant has to prove that the job cannot be filled by an American Citizen through a lbour market test. The 140K number is also used to count the spouse and children of the high skilled immigrant. So in essence there are only about 60K high skilled immigrants given a GC each year. Also there is a per country limit of 7%, so only about 5000 GCs are given to high-skilled geal immigrants from each country. This has lead to a huge backlog in GCs especially from countries which send may high-skilled immigrants like China and India. To make matters worse the Congress authorized about 250K illegal aliens a one time waiver to adjust status in the year 2000 and those numbers come out of the regular 140K per year granted to legal high-skilled immigrants.
All this has resulted in a expected wait of "8-12 years" for getting a GC for a "Play-By The Rules" legal high-skilled immigrant. Add another % years after that to get US Citizenship. Seeing these kind of numbers many talented young engineers , scientists and doctors are moving to other countries in droves. No one would like a wait for 15 years to become a naturalized citizen. America is losing a lot due to this Retrogression (Backlog) in GCs, especially when there is a global competition for Talent. The only ones who have patience to stick on is those who have already been in the waiting game for
years and have a lot at stake to leave it at this stage. And for those that chose to wait in this manner life is hell. For 7-10 years they cannot change jobs, cannot get promoted or even change job roles within the same company, cannot get transferred to a different location in same company. Any of these events will mean starting in line all over again. Also their spouses cannot work and they cannot buy homes or make other investment decisions due to the uncertainity, many who have kids in college have to pay higher tution.
I am one of these stuck in this GC hell for the last 9 years, I came to the United States as a student in 1995 to pursue graduate studies in Engineering in a top-ranked university. I have been employed legally in the US since I graduated in 1997 and been pursuing the GC dream for the last 9 years. The end is not in sight and if Congress does not pass any relief I expect the wait to last at least another 5 years.
What does it take for congress to pass some relief? Just some simple relief measures
1. Increase the numbers of GCs to 250K per year temporarily for 2-3 years to alleviate the current problem.
2. Allow to recover unused GC numbers from previous 5 years to be used to alleviate the current retrogression.
3. Do not count spouse and dependents towards the annual number
4. Do not count against the annual cap count certain high-skilled immigrants who have a advanced degree from the US and have worked in a high-skilled job legally in the United states for 3 years .

It would be a smart choice to accept those application, but based on USCIS recent behaviors, I really doubt their decision makers have that intelligence to make such a smart choice.

I think my original question still remains unanswered.
1. I do not have my I-485 receipt notice(I do have the numbers though)
2. I do not have EAD/AP(Employer did not let us apply)
3. I'm already in my 7th year of H1. Current stamp expires in Sep'2008.
Can I invoke Ac21 somehow?
I would suggest that you apply for EAD/AP yourself without lawyer's help. I think you can just use receipt numbers.

I am wondering if people go with the lawsuit route..will USCIS create an interpretation of the rule that..180 days STARTING FROM the date the PD was current...
With that said..I am not sure if May VB will retrogess ? / Remain same ?/ Move forward...in the end its too much volatility on their part and THEY SUCK as an organization...
Sorry for the hardlined words here, but i am sure many people stuck in the mess especially from old PD's - who first got stuck in the BEC mess and are now left nowhere due to the fiascos that they create...sheesh...

A lot of times.. companies use this bugaboo of job desc etc.. Those that want to promote you badly enough will find a way.. First of all.. What your job title is v/s what labor is filed under is not directly related.. Secondly you can have matrix responsibilities that span across 2 bands etc.. So lot of times it's an excuse to not have to let you down hard way.. always easier to blame on that "damn immigration queue"

e-filed on 19th April and got the confirmation receipt by post on 23nd April. After that no updates. Anyone facing this issue?

Some Background:
My employer filed for my residency in 2008. Per my employer, my PD is Jan 2008 and my I140 has been approved. My 6th year on H1B will be over in August 2011.
My questions to Attorney Reddy are as follows:
1. Can I switch employers now and retain my old PD?
2. Since I do not have a copy of the I140, would the employer be able to withdraw my I140 application?
3. Will I be able to get a 3 year extension on my H1B with the new employer based on my approved I140?
Please let me know. And many thanks to Ms. Reddy for providing this great service to the immigrant community :)

In central NJ, I called over 9 Doctors and only two of them had an appointment before July 1st -2nd week.
One is Dr. Neil M.S. Estrella in Clark, NJ. Appointment was available for Monday June 18th. But the fees for the exam plus vaccines is $430. The second one is Dr. Marcel Stern in Piscataway, NJ 08854. Appoitnment was available for Thursday June 21st. The fees was more reasonable at $350.
If you're in Central NJ, Hurry, Hurry Hurry.
P.S - If some of you get other appoitnments in NJ, post here so that others will know and not waste time calling other doctors.

Are the processing times according to the notice date or the received date ? Mine are 4 months apart.
It is based on Received date but some are saying that CIS is not really following that but in "THEORY", its the RCVD Date.

As per AC21 rule, it is from Receipt. However, let's put some practicality into the matter. Some IO's interpret the rule wrongly and used Notice Date instead. So what will happen? Your GC denied for wrong reasons and you file for MTR because it was USCIS mistake. If you're willing to take the chance, then go. If not, better use Notice Date for practicality purposes and to avoid all the hassle of MTR, etc.

Really... Selling a house takes longer and in some places its six month - a year. When you are detained at the airport, you can not list your house and sit in the airport for a year. Think before what you post.

I didn't send a certified mail but I have a reply to my email saying that they didn't received the statements from the Insurance Company and we can still report those missing wages without a W2 from the company.
Can we use this as a proof of contacting employer requesting for a corrected W2?

Yes, make sure you give your employer the benefit of doubt by sending the documents via certified mail and acknowledgment received/delivery confirmation.Make sure you mention that you need it amended to file for taxes and will be forced to report otherwise. Follow that up with an email via delivery confirmation option to make sure its been received. If nothing happens from your employer in consultation with your tax consultant file a complaint.
