PTO is a new one for me. Paid Time Off??
You can work with the new employer while H1B is pending, for 240 days as far as I know. There is premium processing if H1B doesn't come on time.
3 days without pay is not a gap in employment if the employer-employee relationship is maintained. Don't worry too much. Even in normal circumstances, it takes a few days to relocate.
Yep. Paid Time Off (PTO) - This will allow me to get regular checks until PTO is exhausted.
Actually, my question is it LEGAL to work for the New employer (After filing H1B Transfer and getting the receipt) when on PTO (Paid Time Off) with current employer?

July 23rd filer. NSC>CSC>NSC. Did not get FP notice and will be travelling to India this friday for 2 months. So called up Customer service and opened SR for both me and wife on December 20. Got appointment for me for Jan. 16th but nothing for my wife in the first week of Jan. Then a week ago got a second set of appointments both for me and wife but now on Jan. 18th.
Anyways, reported to USCIS office in Des Moines today (Jan. 16th) per original letter. Wife accompanied me and I had all the appointment letters with me. Explained to the security guy (a very nice old gentleman) about the situation with upcoming travel, etc. He went and soke with the USCIS manager and she was gracious enough to allow my wife to get her fps done with me. Was out of the place in about an hour. They had a new machine installed and the person from the machine manufacturer was demonstrating how to use to the local staff, so we were all guinea pigs. Scanned four fingers from left hand followed by thumb, then four fingers from right hand followed by thumb, this was followed by each finger individually rolled across the scanner, then took FP of right index finger and asked me to sign (similar to a credit card digital sign box). Took a photo and that was it.
One piece of interest to people who for some reason missed theit appointments and forgot to reschedule. I was informed by the security guy that there is a grace period of 87 business days after your initial appointment date for you to walk-in and get your fps done. However, you need to call the center to find out what day of the week is alloted for walk-ins. (It is Wednesday for Des Moines office).
If you have multiple appointments for different days (like I had), go to the earliest one if possible and get both the notices stamped with the stamp indicating that biometrics were taken on that date.
Cheers!

I can understand the anxiety. I have similar concerns but you cannot do much when your luck is involved. No matter the amount of scrutiny or verification you do on your part, if your luck is not good, there may be rejection. But they will not reject, they will issue NOID. You have time to appeal etc etc.
So chill out. Enjoy AC21 (the bill was passed to provide relief, not give more tension).
Do not worry too much about what can happen tomorrow. Enjoy today. Enjoy this month. Enjoy this year.
You are a MI Chapter member and you have done the right thing (supporting IV). Have faith in IV and continue to support IV. I am sure the days of seeing the freedom is near.

Shouldn't the processing move quickly because of non-availability of visa numbers, the apps are reciepted anyway. Are they pre-adjucating I-485 applications?

Call the office and tell them you did not get the answer to the questions and issues you raised and want to speak with the person who handles immigration policy matters. Follow up with this person. Letters go to junior staff and issues get lost unless you contact the senior staffers and seek appointment from them.

I applied my first H1B extension through my company in June 2008. On 11th Feb, I received REF. I am very much tense about it. Since I am out of project. I got cleared my I 140 with this company in July 2008.
I applied H1B transfer(Normal process) also in October 2008 to other company . This one is still pending.
I am very much tense about my status. Please suggest me what to do?
Is it better to answer to RFE for first company?
or
Can I do PP with second company? or else any better thing?
Thanks
Vidya

Yes there is a security check at I-140 stage, it is not FBI name check. No one
know what this check is and who gets subjected to it or it is just random. I-140 stuck for 1.5 years without RFE makes it quite likely that your petition is stuck in this check. Take a look at this:
http://www.immigrationportal.com/archive/index.php/t-193663.html
Best way to find out is, your attorney raise a service request with USCIS.
Thanks CanadianDream. Your words are encouraging. I will check with the lawyer. The reason we want to file another I-140 is just to safeguard the H-1B status. I am in my 5th year.
BTW, I have another question. Do they do security check for I-140 also? I never know this. I thought FBI check is only for I-485. My I-140 has been pending for 1.5 years so far. NO RFEs. Nothing. Every time my lawyer calls USCIS, they say it requires additional review and since no REFs are give, adjudication should be forthcoming.
Are there anything we can do to get the status on the security check? How long usually does it take?

I have a total of 15+ yrs exp in the IT industry out of which 8 yrs in USA. I am also an EB3 :) BTW I have a 4 yr engg degree from a small college in india :p
Count me in too
I am totally pissed off with this system. The only wrong step which i took was applying in EB3 when i had three years of experience. Now i have a total almost 10 years experience in IT and still waiting like an illegal immigrant for GC.
PD : EB3 SEPT 2002.

Thanks for the link. I looked at it before I posted my case but I don't think it was a mistake by the customs officer. He specifically told me that he cannot stamp the date of the future I-797's expiry date (Jun 2010) and asked me to contact my local office just before the current visa expires. My current one expires June 04 2007. The future 797 is valid from June 05 2007 till June 04 2010. But my visa stamping in the passport is till June 04 2010.

Do you have WAC or LIN numbers?
Got following email today on my daughters case today. NSC July Filer. EB2 I Mar 2006.
All our cases show this status now.
Any idea what happens next?
Current Status: This case is now pending at the office to which it was transferred. The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now pending standard processing at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address. We process cases in the order we receive them. I personally need more defination of
'Employment-based or Other: 110,786 '
it is defining a narrow set of applicants. Are they ones whose 485 is stuck after filing 485. or are they ones whose 485 cannot be filed and only have 140 approved ?
This means applicants that have already applied for I485 and have not been approved. It has nothing to do with the people who are waiting to apply.
The whole thing is just a big PR scheme.

You don't need your PD to be current for EAD/AP
I think he might have meant that the 485 was prematurely filed too.

That is expected based on the number of I140s that would have been approved and ready for adjudication. Also, with priority dates moving forward, more applications from earlier dates come into play and the processing dates move back.
Hopefully, they start moving forward soon and go over the July / August 2007 hump.
With USCIS what isnt odd! :).
I managed to find the NSC processing time archive from AILA - http://aila.org/content/default.aspx?bc=1016|8767|6739
See the 485 EB based processing timeline.
12/15/2007 - 04/24/2007
01/15/2008 - 07/19/2007
02/15/2008 - 07/30/2007
03/15/2008 - ?
04/15/2008 - 07/11/2007
05/15/2008 - 07/14/2007
06/15/2008 - 07/28/2008
This means that even processing dates go back and forward like priority dates! I dont think the July status is posted yet, but this definitely is interesting.
