Well, whether a merchandise can be returned after using, depands on the nature of the merchandise and the level of customer service provided by the seller.
If you are buying a TV or a home theater, you don't know if it is functioning properly until you use it. And returning it within stipulated "return period" is not only legal but also ethical.
Some high-end sellers will even guarantee customer satisfaction by allowing a return any time, yes any time if the customer is not fully satisfied with their product. There is nothing unethical about this. That is why these high-end stores charge you a premium in the first place.
Not allowing return of merchandise reflects the low level of customer service we used to get back home. Obviously that level of service expectaion has been engrained in us so much that we believe returning used merchandise, even when the customer is not satisfied, is unethical.

There will be only 25 - 20k Spill for 2010. Given that India and CHINA Eb2 can cross mid 2006.
It will take another 2 years for Eb2 to make C and then we can see Spill over to Eb3.
If economy improves and we start seeing labor approval coming Spill be going to less and creating more wait time.
Eb3 needs VISA RECAPTURE badly. Eb2 guys can wait for couple of years to get GC. but still 2-3 years in given economy is too risky. Bottom line is WE need VISA RECAPTURE in order to clean all mess.

I have a question regarding the I-693 Medical exam. it was mentioned that you will need to take a vaccine for MMR, Varicella, Tetanus and Hapatitis B. it was also mentioned that they will do a tb test and a blood test for HIV and syphilis. are these all the vaccinations and blood tests required or are there aother blood test required in addition to these??

Below are the list that I have from my lawyer to prepare my I-485 :

I have not seen any place where the change the rules of the Games inbetween..So for EB-3's of early 2000..we were expecting GC's in 2-4 years and EB-2 in 1-3 years..we didnt see any big difference here..ok we said we can apply in EB-3 and wait a year longer...
If we knew that DOL would suddenly change the rules..there was no reason for us to apply in EB-3..we could have looked for another job or convinced our manager to apply to apply in EB-2..if the situation could turn so dire as we know now..Now look at the new guys..they will never apply in EB-3..even the lawyers will advise thier clients to apply in EB-2..so the old intrepretation should remain for the older cases and new interpretation for cases when USCIS decided to change the interpretation...

for all those whose lawyers allow multiple filings: what are you filling in for I-485 Part 3 section A "Have you ever before applied for permanent resident status in the U.S"?
In my case both applications are proceeding in parallel and I dont know which lawyer will end up filing first!
The one you apply next should should have the option checked.
Word of advice:

I think the division of Eb2 and EB3 will be over when oct VB comes. Mostly Eb3 will go back 2003 or 2004 and Eb3 date may be 2002. At that time there will be unity.

I think if number of employees are less than 50 then 50% rule will not be applicable(according to 2007 proposed bill). It may be similar to that.
But are n't they proposing 50 % rule.. how can a small desi company afford 50 % US citizen staff ? That is why may be people think consulting companies will not work.
but what I think is it will make them less profitable. Very small body shoppers will go out of business. Med to large indian owner based consulting companies will be less profitable.

Lost in all this is the fact that Punjabi wants to sell his house not because he cannot afford it anymore, but because he wants to move to a different city to a higher paying job and can't be bothered to take responsibility for his failed real estate venture. He could have done the ethical thing and stayed in his present job and paid off his loan but he is choosing not to. And who does he blame for his situation? The concept of the "American dream". So the fact that he wants to shirk his responsibilities in favor of foisting his own debt onto the rest of the country isn't his own fault, it's the "American Dream" that's making him do this. It's not exigent financial circumstances that are causing him to foreclose, it is greed and shortsightedness (colloquially known as "The American Dream"). Greed and shortsightedness already caused him to go 20K under the water. And they will now make him screw up his own credit history. If someone cannot learn from one mistake, I say let him keep making mistakes. He will soon find out how difficult life in the US can be if you don't have a good credit history. As for the burden on us taxpayers, hey, we've been spending 10 billion a week for the past 5 years dropping bombs on people, what's a mere 20K?

I checked with USCIS by calling them and they still have no records for me in the system. They admitted that there are many who have not been entered and issued receipts even though the dates at NSC & TSC shows otherwise.
Adviced to be patient and call back in October 1st week. According to them its still not long enough for them to launch an inquiry to find these July 2nd applications.
My lawyer also says she can't do anything yet unless they say that they have filed everything they have received.
Again what a mess ...waiting for reciepts takes so long wonder when they will finally process the GC.
I know many 2nd July filers who have even received EADs.
I hope our patience pays off and they rewsrd it with giving the GC straightaway;).....wishful thinking.....
