Here is the same old Cockney reply from TSC on inquiry for my wife's case through my area congressman:
TSC is currently processing I-485 visas based on filing date order. There are a large amount of cases that are being worked and your case will be worked in receipt date order. With the limited amount of visas that are currently available between now and September 30, 2009, there is no guarantee that your case can be completed before the end of FY2009. It is estimated, that in general, your case will be completed between 45 and 90 days.
Thank you for your inquiry and please do not hesitate to contact us again if you have further questions regarding this case.
Obviously that logic is bull crap, otherwise I also won't have been approved. We have the same receipt date and everything...........I guess there is so much we can do....

Theoretically yes; because for a 485 to be pending for more then one year; then the labor has to be older then one year and/or the 140 is older then one year.
I think the situation that you may be talking about is where 140 has been revoked but 485 has been pending for more then one year. The law only talks about 140 and labor older then one year. If one tried to do it this way and uscis should question you then there is no legal basis of doing it.
That being said; I do know of a case where a person did get an extension even though the 140 had been revoked. Had to be a fluke and I wouldn't say that it is the norm; because there is no legal basis for it.

The name check takes 2 years anyway, making a mockery of fast processing times. Even VSC, which is the slowest, takes less than 2 yrs for 485.

I know a person who applied TIN number for their parents as they stayed in US for more than 180 days(that is technically possible as some months have 31 days, so if you correctly plan your paretns trip, people on visitor visa will be allowed to stay for 6 month or 183 days) . Also ff you talk to your immigration officer at the port of entry and convince him that an extra three days would be helpful for parents, he might give you 183 days visa.
You need to prove the substantial presence of parents in US.They have a formula to calculate that (total number of days present in current year + 1/2 of number of days in previous year + 1/3 of the a year before previous year) and it that total is greater than 180 days + some other technicalities(which are easy to prove), you can file for TIN number and file taxes showing them as dependents.

Find a new employer asap who can process H1 transfer. Otherwise use EAD if your 140 is approved. Also findout if your employer cancels your H1 once they lay you off.

I can back that one up. We received audit August 13 for 2005. Had to prove we are married & kids live with us. When called and spoke to officer she said it was an "INS flag"! Honest to God that is what she said. She then asked if we had applied in the last couple of months for 485's??? She knew all about the USCIS system and said one way of telling is if you file jointly at the same address each year then why would IRS be asking for proof of marriage and kids living there etc. She was great and confirmed they had received all paperwork. Had to resend due to liquid being spilled on copies.... Even H&R Block said it was INS based.
Then we get 4 out of 5 EAD's approved, but spouse gets RFE and it is proof of name change please resubmit marriage certificate!

Reason for asking is I live in NJ. And i got an appointemt with DR. Kim in NY as i know him through somebody else.
He is also more reasonable asking around 190/-

I have my I-140 approved from previous employer , and my labor for the current employer is stuck at BEC center. Can i get a three year extension on my H1b ? OR the I-140 has to be from the current employer?

Lets figure out the next course of Action for IV in the best interests of its members. Let's itemize each one of them and propose possible solutions. This thread is not for question / answers about individual situations but broad GC issues to be resolved by Govt/Congress/USCIS/DHS/DOL by way of proposing bills/acts/resolutions/amendments. IV must have done this but I didn't see an easy way of getting it.
First we could categorize them into different buckets such as that IV did for the forums. Just made up some to give an example. Some gurus on IV can suggest a better categorizing
Ex:
1) Labor
a) Allow one to get promoted instead fixing to of a fixed job position in the labor advt.
2) I-140
a) Allow One to file for two I-140's
b) Have freedom to change employer when I-140 is pending
3) I-485
a) Allow one to get married while I-485 is pending or after approval or provide some status to the spouse for whose I-485 is approved
b) Have the flexibility of filing multiple 485's so that one can choose the best one at end of the approval stage
4) Finger Printing
a) ...
b) ...
5) Backlog
a) Resolve backlogs from 1999.. so and so..
OR in the following format
