You are making an assumption that an approved petition is an indication of a valid status for the entire duration of extension. This may or may not be true after the I-140 is revoked.
That's why you have to be quick...Before your earlier employer revokes the petition...(that takes some time..) you got to get a new labor and a new approved I-140 and after that they cannot throw us out technically...
The whole thing is a mess..

It only makes me wonder how many more applications with PDS older than 2001 (substitution or not ) from India are still pending :( . Good luck to all of you guys who has PD older than mine (Sep 2004 EB3), unless you are out of the queue I dont get mine :)

My wife recieved AP which was approved on 30 Aug. They approved mine on Aug 31. I have not recieved AP yet. My attorney advised to wait for 30 days.

What happens to an employee at any company who has done something positive but has been caught abusing his colleagues a few times. He gets warned by HR first and then gets fired right.
We have lot of things to focus on to get relief for our community and there is no reason to tolerate this behaviour towards fellow members.

If President Bush believes that EB reform is in the National interest of US then it will be done.
For example the nuclear deal with India was pushed hard by Bush and inspite of all opposition by Non-Proliferation lobby the Congress overwhelmingly approved it just because it was perceived to be in the US national interest. Even though it completely undermined US position vis-a-vis Iran and North Korea, President Bush successfully convinced Congress to not only change domestic laws but literally forced the entire Nuclear Supplier Group consisting of 15 nations to bypass all international rules and norms just to make an exception for India�s case. All this was done just because it was in the US national interest and India�s too.
Bottomline:
Is EB Green Card reform in US National Interest?
Is Hi-tech labor export in India�s National Interest?
If the answer to the above two questions is Yes then anything can be achieved. Politics can create strange bedfellows and nothing is impossible in politics as proven by the nuclear deal.

I spoke with USCIS again this morning and this time got hold of a more helping IO. She said it should not pose a problem and NBC should be able to approve I-765 and I131 from their end it self. Also my future employer's immigration team also said it should not pose a problem.
I am still concerned and I shared my concerns with future employer. They graciously agreed to transfer the H1 which is a much safer bet now.
I have done couple of H1 transfers in the past. But this is the first with AOS pending and I-140 approved. Is there any thing different or gotchas that gurus want to share.

She says that only H1B expenses should be paid by employer. Period.
I have written a check to USCIS for my H1B application fees.
It may be possible that the rules changed after I wrote the check in 2002.

how long usually the deadline is ? if it takes ~ 2 weeks for the letter to get to the lawyer I would guess the deadline would be at least 6 weeks???
if there's not enough time do you think we can ask more time? e.g the case of asking additional experience letter from a friend/employer outside the country.

I applied on Dec 21st and case is still pending.
I wonder why they are not updating the processing times page lately, it is still shows Feb 15th as the updated date rather it should have updated on mid March.

I-485,EAD, AP applied on 24th July, RN received today,PD May 2004 EB3, I-140 already approved
2nd labor in PERM applied in early 2007, got it approved in May 2007, I-140 applied in PP in June and approved with the same PD as EB3 I-140 i.e. May 2004
Now, my attorney is going to iterfile my EB2 I-140 today and according to him, my I-485 file should be updated in 3-4 weeks. Has anybody got it done before? If yes, please share.

The oldest available evidence that lists the names of both parents should be submitted."

Ok, so my PD got current (EB3 India). What next?
Optimystic -- is your PD current?
IF you have a current PD RIGHT NOW...AND submitted your I-485 on or before June-July 2007... AND have an approved I-140
(i) they are sweeping through all the files to find such files because if you filed your application in June-July 2007, 180 days have likely passed since your name check was submitted to the FBI. Name check request are made within weeks of generating a receipt for you.
(ii) they plan to complete this sweep by March 10; UNLESS visas run out, they plan to process such cases in approx 60 days (hah! like I believe them).
(iii) within the set of applications with current PDs, they apparently process in order of RD. Not sure if this is within the EB preference and current PD or across all EB preferences.
(iv) Some cases are approved without any changes in LUD i.e. that amazing email arrives before without any prior LUD changes.
IF you don't have a current PD, I have nothing to say except best of luck to all of us...the situation is pretty grim. The movement of EB-3 ROW will mop up most of the green cards left this year.

This is encouraging. chandu, I read somewhere (mostly on murhty) that CIS will be publishing new AC21 soon and it is expected to be more stricter. Is this just the speculation or any other indications are received?? any idea? I am afraid that what will happen to people who already have used AC21 by following what currently exists???????
