My wife is applying H1B this April 1st against 2007 year general quota and via regular process (not Premium Processing).
Currently she is on H4 with valid I797 (expiry date end of Oct 2007) and expired visa on her passport (June 2006).
She plans to visit India this June and get H4 visa stamp on sometime June 2nd week. She will be returning sometime end of August.
Do you see any problem in visiting India and getting H4 visa stamp (based on the current I797 or I may get an extension by June) while H1B application is pending? What will happen to the H1B approval as it will have current I-94 number? Do we need to go again to India and get stamping after October 1st for H1B?
Or need to wait until August for H1B approval and get the H1B visa stamping instead of getting H4 stamping on June?

The bulletin is 2 years old (if that is considered old, given the GC standards). However, no new bulletins have followed to void it. Unless I have been advising with the wrong lawyer and wrong GC applicants (many), there is no such thing as I-485 Approval before the name check is completed. Any third party would like to comment?
Of course, they will not "approve" your 485 before your name check is cleared. You misunderstood me or I was not clear. What I meant is this: if your name check is not cleared but all other work on 485 is finished (which I think I equated to clearing the 485 in my previous post; sorry), they will tell you on phone (if you inquire) that your 485-related stuff is complete, but we are waiting for the name check. (Also, they will wait for your PD to become current).
My main point in the original post was that if it takes them 2 yrs to check your name --- the name-checking process runs concurrently with the 485 process --- then the 485 is bound to be complete by the time your name check is cleared. The processing times of 485 can be gauged from the VSC (or relevant center's) bulletins. Those proc. times do NOT indicate the processing times for the name check. If the name check happens before the 485 process is cleared, great! If not, you wait for the name check; lots (and believe me tens of thousands) of people belong to the second group. Since this forum mostly has people stuck in the process at earlier stages, you are not going to find too many people with that kind of experience here.
So your respected lawyer is technically correct, but what he/she is saying can be very badly misleading!! One gets the impression that clearing the name check happens automatically with completing work on the 485 by USCIS.

I am GCBikari and I approve this message. You are saying you ran out of savings and in next paragraph you're talking about investments!! Anyway what I did was list out all minimum payments (rent/mortgage, car, utilities, groceries, gas). This gives the money needed every month in worst case. Then multiply by 6 months. Keep that amount in bank or a locker (now a days difficult to trust banks also!!). Then go for what others talk about like 401k, Roth IRA.. You will have a better start once you know how much you need per month to make a living on bare minimum.
My recommendation would be to build at least 6 months of emergency fund. Open an account with ING Direct or HSBC where they pay decent interest rate on a savigs account. Build the emergency fund first.
Once you have sufficient foundation, then I'd say start building investment foundation. If you employer has 4o1K plan, then start putting pre-tax dollars upto the maximum contribution at employer matches (generally it is 6%). If your employer doesn't have 401K plan, then open a ROTH IRA and start investing in low cost mutual funds or index funds. Vanguard is generally the best place to get low cost, no load funds. Once you max out both 4o1K and ROTH IRA, then start looking into opening a taxable individual investment account.

That is a sociological topic not immigration one. A person making his choice to try to settle here in USA or in India has nothing to do with this website. This website is for people who have already made a conscious decision to try to settle down here and obtain the Greencard asap which is the first step in that direction.
Making a choice between USA and India is something you have to do before you decide to contribute or join this organization.

And movements like "taking back our country" rallies are held - taking the country back from whom? taking the country back to which century? He has to even circumvent appointing people to head agencies to avoid republican stonewalling!
Third, if Obama's popularity was high, one can accuse him of trying to do nothing to keep his approval ratings up. But that is not the case. His approval ratings are low..
By saying this, I am not saying that he has done everything right. But we need to know the ground realities instead of coming up with statements like he is not doing anything for us. He is stonewalled everywhere on every issue! For us to bring our issues to the forefront, as some one suggested, we need to get the media to understand our problems and ask the right questions. They do not need to be notarized as long as they are self-attested. Scanned copies are fine. Retain the original with you in case the CIS asks for it.

My attorney prepared the EVL for my employer to sign. I have handed that over to my boss who has sent it to HR for review. This letter has lot of legal lingo and information related to my LCA and I-140 e.g.,
"We acknowledge that, according to the Immigration and Nationality Act (8 U.S.C. �1154 and 8 U.S.C. �1182(a)(5)(A)), ............"
"We acknowledge that <my name>'s immigration petition filed on <I-140 filing date> listed his job title as <my LCA job title> and <my name>'s current position is in same or similar profession...."
So my concern is why would any employer sign this letter without knowing anything about my LCA, I-140 etc (I had changed job about 240 days after 485 filing). So my current employer may have issues signing this letter.
But my attorney insists that this letter (in same format) needs to be signed in order to respond to the RFE. My thinking is that all this lingo and stuff related to LCA can be eliminated from the letter so that my employer is more comfortable signing it.
