What you are seeing is a case of 'socio-economic' osmosis. Problems of this nature has been debated across many nations of the world. How you handle these issues goes to the core character of the nation. Shooting 'intruders' is perhaps one way of looking at it. Then such a solution cannot be undertaken by a 'super-power' who wants to hold moral superiority in the league of nations.
A few 'simple' cases of water-boarding people thought will not have any repercussions. How wrong those people were. Similarly, police torturing 'intruders' and defending such actions does not make it right. It just erodes the basic character of the entire country. Would you want to teach your own kids as to how to treat such issues ? Shooting, shackling, water-boarding etc ? Please do not give a flippant reply, do think about it before you hit the submit button.
Socio-economic solution along with a sensible immigration policy has been found to be far more sensible as compared to a pure enforcement policy. It has been proved over the years that a pure enforcement policy which many nativists support to be economically unviable. Minutemen patrolling the borders to Gov. Perry's multi million dollar border cameras, have proven to be ineffective and economically unfeasible.

From february 2004 (expiry date of i-94 card) until april 1994 it looks like you accrued unlawful presence. The unlawful presence stopped when you filed the 485.
The unlawful presence was wiped out when you left and re-entered usa (the 3 year bar didn't kick in because the unlawful presence was less then 180 days).
You will be fine.
Just be truthful that you filed 485 before; you had divorce and all the employers that you worked with. Only thing they can get you on is if you try to embelish or hide things even though they were forgiven when you left and re-entered.

Your stories are pretty compelling. Could you please send me an email with your stories at shrey@immigrationvoice.org so that I can collate it together?
Others, please send us your stories by using the template in the first email. It would really help our cause.
Most of us are on this forum because of the injustice that the current immigration system perpetuates.
What is even more frustrating is that we are chasing this so called American Dream during the most potent years of our lives and literally wasting our lives away.
Employers indifference, incompetent lawyers and pathetic para legals all add up to make our best years the worst. I always used to wonder how come there is not one single place where all hi tech workers can discuss their issues and work together.
The illegal immigrants have orgs like La Raza to support them, pro bono lawyers working for them and senators and reps listening to them. We are just starting to realize that we also can work together and get ourselves heard. Being highly-skilled should NOT be a handicap for us!
I just hope IV is that elusive orgs for legal skilled immigrants...

I disagree, On IV homepage and website there are so many links of appeals. Just issing another appeal will not make a difference. I do not think a lot of us really need a greencard. A lot of my friends these days tell me not to worry about greencard after having EAD.
IV is our only hope. If you want you can contact AILA or your lawyer for help and see if they can help you. I bet a lot of us cannot even have the courage to blame our lawyers who take our money and give poor service. Just because IV core is like us and we can write anything, we feel free to blame them.
I disagree with the OP and feel that the fault is in the community. We do not really want greencards that bad.
The appeals are only for recapture of visa. They are not about USCIS's random acts and unethical practices. They are not about what USCIS has been doing for the past two months. What use is recapture if it is not issuing GC's or doing that randomly or not doing that at all . Think about it:
1. One can have his PD current for 2 years and not get his GC. Meanwhile, he can loose his job and not get a similar one. All his steps go into drain forever.
2. He cannot do any other thing like open up a business.
3. He cannot get a house for the fear of being rejected.
4. He cannot even do his present job confidently. For example, I have somebody trying to abuse my situation in my office and I cannot give him a hard reply simply because my status is hanging in there.
And yes, we do need GC's but the first step is not getting GC. The first step is to make USCIS accountable, ethical, efficient, honest and transparent.(All these things are missing in USCIS) How come a person with PD 2003 is waiting and the one with PD 2006 get his GC ? IV should raise questions on this. (Not all method involve money..I have given an example of writing letters and sending pamphlets)

2. Is it acceptable ?
3. Would such actions if done to US citizens be acceptable ?

The picture you paint is very morose and depressing (and I sympathizes with you, so please do not get me wrong) and we hope that this whole situation that all of us are in turns out to be a bad nightmare and we wake up to see some hope again.

Have you tried contacting post-docs (usually EB1 or EB2 NIW, non-IT folks) at universities pursuing research who are affected by retrogression. I think you can find a lot of people on the IIT forums that float around the web. I am sure we can find really successful(well almost) with sorry stories and restrained in career advancement due to EB retrogression.

EB3 quota for this year was exhausted a long time ago. We are not going to see any overflow into EB3 until EB2 has unused visas left at the end of the FY year. Letz just hope that the date moves forward when the new quota starts next month. It was Nov 2001 before it became unvailable. Now that they have quite a few pre-adjudicated applications, they should be able to better forecast the dates it needs to move when the new fiscal year starts. Or, they might just move the date to Jan 02. Letz see in another month what the future says.

The phenomenal experience of actually doing something positive to solve our problems is - but I am just acknowledging the great enthusiasm that was vibrating with our members - they realized the gravity of the situation, the opportunity that was within their grasp and wanted to make the best use of it. Hats off to you guys!!
