That sounds like a good plan, but I didn't see a provision for people applied for I-485 and waiting for their dates to become current to add their spouses ? ( Disclaimer : I'm not one of them :) ) How is that going to get tackled ?

How do you come to these conclusions what congress intended. AC21's main provisions were to recapture unused visas for certain years; extend h-1b beyond six years; allow someone to change a job after 485 pending for more then six months; allow unused visas to be allocated to oversubscribed countries on a quarterly basis rather then in the fourth quarter.
I came to the conclusion just based on section INA 202 (a) (5) (A). Nothing more nothing less. You came to funny conclusion of "quaterly basis".
EMPLOYMENT-BASED IMMIGRANTS NOT SUBJECT TO PER COUNTRY LIMITATION IF ADDITIONAL VISAS AVAILABLE- If the total number of visas available under paragraph (1), (2), (3), (4), or (5) of section 203(b) for a calendar quarter exceeds the number of qualified immigrants who may otherwise be issued such visas, the visas made available under that paragraph shall be issued without regard to the numerical limitation under paragraph (2) of this subsection during the remainder of the calendar quarter.
You are critizising H1B indians and their employer screwing the system which is not relevent to what we are talking here. If you feel so, then attack who ever spoiling the system and regulate those. Instead you are trying to justify your interperataion is right and what DOS is doing is right. I will be the happiest person if they ban labor subsitution and ban desi consulting companies or H1B dependent employer participating in GC sponsering. Then this mess might have not happened.

Sorry to hear your inlaws trouble. It happens and sometimes concidentally it will be worst. Till today, they was a huge communication gap exists in Air line industry. Need to overhaul. But they ignored it or took it very low priority who knows. Nowadays I prepared to board airlines with a mindset of expected delays and questioning my self what happens if it is a major delay. (be preapred with prepaid cell phones, accommadations, food, medications, rental car etc.,)
Similary USCIS also need to streamline our case approvals and Visa dates. Need to overhaul the communication gap. World emerged and advanced on Intenet technologies but still big communication or new communications gap exist :(

I googled to find any cases similar to the one I have now, by no luck.
My wife was out of status for more than 6 months while she was on H1-b by not working. To put her back on status, my attorney advised to make her go out of the country and come back on H4 visa. Her status now is H4 and has maintained it since the last entry to US. I have maintained my H1-B status since 3 years and got paid for every day.
Is it possible, my I-485 is approved (primary applicant) and her I-485 denied (dependent) due to her prior out-of-status on H1-B? Her current status as mentioned in the I-485 forms is H4.
Please advice.

Yes, there is a possibility of I-485 denial for dependent as it is at the discretion of the adjudicating/immigration officer. Having said this, any denial can be appealed using a MTR. It can also be referred to the board of immigration appeals.

Is there anyone here who took a letter of completion from the school to apply for the Masters Cap and has got H1B. or cica versa.
Guys please share your experience. I have applied the same way and I am wondering what my case result would be. I took a letter of completion from the school as I completed my degree requirements early and applied.

abolish per country limits on EB visas will back fire us because of diversity issue. We should propose some thing where there is no controversy to reject and that's is recapture 200K visas and EAD/APO for 3 years

But seriously growing your own vegetables is a fun activity. I have not done groceries in the last few months (exceptions being junk fast food, yoghurt etc). We grow vegetables all year round. In fact we have excess of most vegetables we grow. Try it, its a lot of fun!
And good luck to all EB2 and EB3 folks - we've seen good EB2 movement and we hope we'll see more movements in both EB2 and EB3 in the days to come. Till then, Happy gardening!!

I grow different kind in my backyard. It all depends on the size of your backyard and which zone you live in states. I live in virginia. By this August end /september first week summer crop will end. I grow tomatoes(30 plants), Mint, snake guard, water melons (15 plants), cantaloupes(10 plants), carrots, okra, spinach , chillis. Its fun and hard work too. You need to dig the soil, mix with top soil or garden soil and cultivate it. Every week fertilize it. This is my first year gardening. I have around 3000 square ft of back yard. i do not know what to do with that. I cannot maintain Lawn in back yard. So I decided to grow vegetables.
I am eagerly waiting for my fall garden..I am planning to grow tulips,beets,cilantro,carrots,potato,peas etc., If I can get same space for garden In India and work place just 3 miles from home , I can happily go back to India.
