Congress has begun a 10-day recess. The House and Senate are scheduled to return the week of February 27. When they return, the Senate Judiciary Committee is scheduled to take up comprehensive immigration reform, probably beginning March 2. On March 27 this bill will be brought to the floor of the Senate.
www.immigration-law.com also posted information about Comprehensive bill suggesting that on 02/16/2006, the Executive Business Meeting of the Senate Judiciary marked up the Comprehensive Immigration Reform bill. We have not yet found the mark up document. If anybody is able to find this document, please post let everybody know.
There are two pieces of Innovation/Competitiveness bills that are being considered:
1.) Protecting America’s Competitive Edge Acts (PACE)
This act is based on Augustine report. This act is sponsored by Domenici-Bingaman-Alexander-Mikulski. There are 60 Senators who have endorsed this act. This act is being supported by Craig Barrett and other hi-tech industry leaders. The link below provides the summary. Section 314 of the education part of this act contains some of the provisions for Employment based immigration.

Just that they provide slightly different solution to the situation where PACE provides for additional funding and slightly more aggressive than NIA. Of course yes its for our interest BUT don't forget that its against a violation. Tomorrow if the same organization brings resources in H-1B/EAD/GC/Citizenship we are not going to complain about it ... because its within whats allowed by the law, I think thats the purpose of having rules ... to have a fair playing ground ... think abt the havoc/chaos these companies could create by bringing people without any visa (illegally across borders) and talk about 'closing the doors and me not brought up that way', do you think that anyone including you would support that???. Here the purpose of L-1B visa is misused and blindly violated, so lets move in the right direction, we are not asking all L-1B visas to be banned BUT to investigate the abusal of that visa category and we are just pointing out the incidents where we think its getting violated. Lets see who is on right/wrong side. We'll leave the decision part to ICE/USCIS/Other agencies involved.

yes, but july 2007 VB and the subsequent USCIS change related to approving cases with pending namechecks added a significant number awaiting for approval. Then a couple of months back USCIS woke up from slumber or had a shot of 100 proof single malt, re read some law and decided that the overflow allocation should be changed. The result is that there will be next to nothing for EB3 (for that matter EB2 will also have less overflow available) as they clear the backlogs, i doubt anything besides a recapture in the short term and a significant rehaul in the long term will work...i hope i am wrong but EB3 I and C are in for a long wait.

For last 10 years EB3 took numbers equally from EB2 and EB1. Even when EB2 was retrogressed EB2 numbers where made available to EB3.

I am not talking about calling cards. ALLVOI is also a VOIP service like Vonage and has the same deal on free US calls etc. However, their India pkg is much better IMO.
Hows ALLVOI quality compared to Vonage for India calls?

Hi Guys,
I have a concurrent filed application (140 still pending) dated back to Oct 2004 and another I-485 application from July, 2007 from different labor but a recently approved 140. My current EAD & AP is based on the first 485 (Oct 2004) which are due for renewal in next 4 months. Now I want my EAD/AP to be based on July 2007 I-485 (second one) since underlying 140 is approved. Here is my dilema:
1. When I renew EAD/AP should I check that its renewal or initial application option.
2. How can I make sure (atleast try) the new EAD/AP will not be tied to old 485 but the new one (will send the new 485 receipt & 140 approval notice).

There is no concept of "multiple EAD and AP" assigned to single person as far as I know. So it does not matter what " you want" what matter is "what USCIS wants". And so far what I have heard (From professional and wellknown lawyers), multiple 485 filings is the last thing you want to even think about because USCIS does not like it and at the end of the day what matters is "What USCIS wants" so talk about that to lawyers as well so down the road you would not end up any delay or problem by USCIS due to multiple filings.

I saw this link Murthy's email too. The total pre-adjudicated cases in the chart is matching with the total in the document. Well now there are more un-answered questions:
1. Does all other pending 485 include employment based ? If yes what % are employment based ? Obviously we do not have any country specific data on these.
2. Is there any way to know whether individual case is pre-adjudicated or not ?
USCIS has fooled us again. No good statistical analysis can be done on incomplete/inaccurate data. I am going from hopeful to hopeless again. I am EB2-I Feb 2006.

And to make matters worse, this jerk married a Mexican woman. He is alway behind Mexico and Mexicans for some reason. Imagine that, he lives in NJ, has a several acre house, makes 7/8 figure salary and then teaches American middle class a lesson to avoid goods produced in China/Mexico/India. Avoid them because they add up to trade deficit of USA, avoid them because those countries have stolen jobs from middle class Americans. Why doesn't Lou Dobbs stop using software written by some Indian/Chinesse guy? Why doesn't he stop eating at a place where in the kitchen a Mexican guy is making his meal? why doesn't he stop using Japnesse cars? Why doesn't he quit eating Pizza....afterall it is Italian food? Why doesn't he stop driving on interstate highways...part of those were made by African Americans. I am asking Lou Dobbs to show me his grand father's VISA/I-94 when he came to the USA, on a ship, half starved, half naked from some european country and never went back! This guy blames mexicans/legal or immigrations for this country's broken health care system. My Point is more long term - in the shorter term no major change can happen to economy even if Barack wins but eventually Economy would be stronger under Barack's leadership. He also stressed that he would stop "JOBS BEING SHIPPED OVERSEAS" which means companies like TATA or INFY or some Chinese company taking my Job ( or any American's Job ) away from US to INDIA or CHINA. If you are planning a future in US - you would not want your US job taken away by your brother at INDIA or CHINA and Barack will make sure that doesn't happen.
The Bottonline is he will create tons of Jobs at US , so unemployment will be very low , average peoples will be happy and however loud ANTI-IMMIGRANTS scream and shout no AMERICAN will pay attention. Our EB reforms will Pass much easily and we will be able to able to lead a much happier and content life with GREEN CARD.
Once again my Point is definitely Long Term - in the shorter duration Barack has to first fix the Mortgage Mess and do something with Iran by taking help from EUROPE.

Actually I thought they will not accept flowers. But for courtesy and humanity touch they are forwarding. Because of these atleast flowers have some purpose without wastage. This campaign will not have any impact on functioning of USCIS as they are following law. These mistakes are common in every Government organisations and time time mistakes are being corrected. Even congressional hearing happens and finds mistake they will prevent future mistakes like this. It is unlikely for affected persons to get relief immediately. But Many persons will get relief automatically on oct 2007 when DOS sets Cutoff date. I expect cut off date for EB3 2003 or 2004 and for EB2 2005.
I just felt that they did something that most people would not understand. I think the mess today is the result of a series of missteps they took. They not only mismanaged the whole green card thing but also mismanaged the public relations. Hopefully, they have learned from all these dramas. :cool:

The OP is great. He has created a new id to discuss L1 fraud. Will he be creating one id per issue... recapture, H1B abuse, outsourcing, backlogs?? wow!!!
Not sure why he wants his/ her identity covered up. This shows how good some of us are in trying to make noises in the dark and not doing anything about issues in hand.
In all, I still don't understand why L1Bs cannot work at Client site. I am sure that the L1 petitions specifically ask for Client site / work location. If Client site address is mentioned, the USCIS does approve the petition. If it is against law, they will not approve the petition. I know this for a fact since some of my friends are on L1.
Regarding my identity cover up... I have mentioned couple of times abt the seriouness of the situation as the other party is a multi billion dollar organisation, second please add all the reasons why ICE/USCIS/DOL provides anonymity and whitsle bowler protection to people who brings these kind of violations to their notice.
Regarding working at client site... Yes they do get approved for working at client sites BUT with the condition that they would be working directly under the suprevision of their managers and NOT the client managers (they don't qualify for consulting assignments). Also these L-1B visas are approved for working on speciality skills NOT on common technical skills (like java/.net/DBs/Prod Support etc). Next time read your friends L-1B petition carefully and you could find all these details over there.. also verify the L1 reform act of 2004 (published in this thread).
Regarding retrogression... Your salary is not your personal choice, it is governed by market factors. Company makes the final decision whether they want to pay you what you ask for and whether they need your services. Your client can easily send your job to India if they can hire someone here for 3 months. Most likely that person is going to be back with the job after 3 months.

I work for a major system integrator and I have seen client come to us and say, X did not perform well, give us the money back or provide Y number of free consulting days. These are additional advantages for going to TCS/WIPRO. I have seen at one client place, they offered 10% of the resources free. So if client took 50 peopkle, they got 5 more for free. Can your company do that? Dont make hollow claims of BS if you are just a simple developer.

Here we are discussing about a violation by companies using L-1B visa resources and we think reporting this to the agencies (ICE/USCIS) and making awareness amoung clients doesn't harm anyone who does their business within the legal frame work.
No we are discussing YOUR jobs loss due to L1 misuse. You were sleeping until it hit you and now you suddenly want sympathy. BTW, I feel sorry for you that any guy from India can come and do your job. Most guys who come on L1 are freshers with not much skills. Thats what is needed for the job then.

Your salary is not your personal choice, it is governed by market factors. Company makes the final decision whether they want to pay you what you ask for and whether they need your services. Your client can easily send your job to India if they can hire someone here for 3 months. Most likely that person is going to be back with the job after 3 months.

I 485 question

I am applying for AOS on a EB basis. My wife will apply along with me as a beneficiary. Unfortunately she worked on H1B for another company without notifying USCIS and on a different job capacity. What are the chances for her I485 to be denied? Do we have to mention that in I485 form. She is currently on H4 and is not working. Thanks.

When her employer applied for H1B means that he notified USCIS & got approved! She will be fine & she will get her GC along with you. No worries.
