I applied for my H-1B extension and got an RFE asking for contracts and client letters for the requested period i.e., for the next 3 years.
I see that they asked for client letters from you ... but did they ask for the next 3 years? and if so, did you guys reply the RFE with a client for 3 years?
I have been working at the same client for the last 3 years, through a vendor. Mine is a small consulting company. The client has been extending the contract in 6 month increments and I could get a client letter for the next 6 months only.
Same is the case with the contract.
I could not file for 140/485 in july, 07.. so do not have the EAD safety net.
Please advise.

JOb title/Description is significantly similar. I will inform USCIS. I am really glad we have this option so we can make choices on what is the best place to work for us rather than get beat up by fate and long timelines and stick to someplace where one is not happy or progressing anywhere. My downside is I have to sell my house :(

Folks - one must also realize that talking to administration and getting things dione costs a lot of money through advocacy and IV needs a lot of money.
So please be generous enough to contribute to IV - we need a lot of funds in these times when we really needs help

I think the Kodak has alot more problems than just AA problems!!!
And any time a product drops by 50% in 1 year its normally not a good sign

I played around with the 14n at Adorama. Also I have been at DPR Kodak forum gathering user experiences. For its price, its a great camera for its targeted purpose.
There are two problems for me. There can be major magenta fringing at back-lighting and low light conditions (What will happen for shooting one hour before sun rise and after sun set?). You must shoot raw and do significant digital dark room work.
Complaint: Even the D70 has spot metering, 1/500 x-synch, 30 - 1 / 8000. Cmon, Canon, at least put the d*mn spot-metering on the 10D-II (if not 12mp, FF, ... for $999.00)

How can you say that its not legal? When you sign that contract or piece of paper, it means you are acknowledging to all that is in there. Whether you like it or not, when you sign a paper you essentially are saying, "hay! i read this and I agree, here is my signature"...correct me if I am wrong...
From legal point of view, its 2 parties agreeing to a contract (by signing) however unjustified it may look. Maybe some part of the wording may be legal some may not be...

What will be my status after i file my I485?
My current I-94 will expire on 16th Sep 2007 (on the day my current visa stamp in my passport expires and my current H1 B is set to expire Mid April 2008).
I am planning to make a trip to Cannda or someplace to get a new I-94 as soon as i get my new passport (i had sent it for renewal on june 2nd). But i am a little worried about my status if i am unable to make the trip.
So my question is what will be my status after 16th sep 2007 (once i file for I485 (first week of July2007) and my I-94 expires on 16th Sep 2007)?

Your question is not clear but when you say I-94 I assume you mean the I-94 that you got the last time you entered the country, right? The expiration date on that has nothing to do with your status as long you have an approved I-797 for your H1B extension till April 2008. You are in status till that time.
But you do need an unexpired Visa stamp on your passport if you leave the country and want to come back to the US.
So the way I see it, even after filing 485 you will continue to be in status till April 2008 and then I am sure you will extend that for another term if your I-485 is still pending.
As for going to Canada to get a new I-94, it may not work because they do not make you surrender your old I-94 when you go to Canada and so therefore do not issue a new I94 when you return after a short trip to Canada.

Your question is not clear but when you say I-94 I assume you mean the I-94 that you got the last time you entered the country, right? The expiration date on that has nothing to do with your status as long you have an approved I-797 for your H1B extension till April 2008. You are in status till that time.
But you do need an unexpired Visa stamp on your passport if you leave the country and want to come back to the US.
So the way I see it, even after filing 485 you will continue to be in status till April 2008 and then I am sure you will extend that for another term if your I-485 is still pending.
As for going to Canada to get a new I-94, it may not work because they do not make you surrender your old I-94 when you go to Canada and so therefore do not issue a new I94 when you return after a short trip to Canada.

Wait a minute…. You guys have a problem if someone else is getting GC even though you guys very well know how much difficult it is to wait for the long process to finish. I am completely stunned to read some of the posts on the forum as these posts are always looking for parity with this or that group. Some posts say “why undocumented are getting GC after paying 10K as we have been paying taxes for years”, some posts simple whine as to why L-1 get to file in EB-1 etc etc. Is there an end to this unnecessary complaining and this urge to always looking for parity, sometimes with the privileged and sometimes with the under privileged? Some posts are always looking for “fairness” whatever "fairness" means to the individual situation, and then, blame the rest of the world around for delay with their green card process. I think we ought to grow-up and stop complaining about someone else getting their green card. We ought to stop complaining about all the wrong things that may be going on our lives and we should get serious about making phone calls and meeting with the lawmakers. I do not intent to start a flame war and my intent is not to offend anybody either, just trying to point out that we could be happier and effective if we stop whining and complaining. It would also help to create a more positive and constructive environment on the forums.

Not simply because she applied for her SSN.
The EAD kicks in, once her employer fills out her I-9 using her EAD as permission to work inside the US. If she holds multiple jobs, then entering EAD into one I-9 will mean she has to ensure that she has all her I-9s from all employers updated to the EAD.
At this point, the H-1b is no longer used, but does not get cancelled (unless the employer revokes it). It just goes dormant and can be revived again by filing an extension. Another way is to go out of the country and return using the H-1b visa.

Labor substitution case..eh..
All,
My employer revoked the i140 of a person after 180 days. He did not reveal this information to me and used labor substitution for me.
The other person used AC21 and got his 485 approved. INS has denied my I140 since a 485 has already been approved and there can be only one GC on one labor. INS says that once the 485 is approved that job ceases to exist.
My company is saying that they have done this in the past and got approvals. They are saying that they applied the I140 substitution long before the 485 approval of the other person.
Now they are saying that they will appeal that the other guy never had the intention of working for the comapany.
Is there any chance for the I140 approval and using the existing labor ? If not will the INS help me keep the Priority Date.
Does anyone have knowledge of such cases (or) know the results of such appeals.

No visa required with GC. But, since I only had my AP, they asked me to get a Mexican visa ($36). The above rule must be new (no visas needed with non-immigrant US visas).

I wonder on what basis did they advance the dates by whatever margin they did. No doubt, any positive movement (in hours, days ) is good but the consolidated database is not in place as I understand and so this seems pretty much a watershed. The dates might move with out any GC being issued :)

I have been constantly trying to get the message out here that it is imperative that we do not condone illegal or unlawful activities including covering up out-of-status cases. I have received so many REDs for doing it. Go look at the other two posts I have replied to. Some people who don't like the fact that I advise people to leave the country. They are the ones that give me reds!

Hope some of you will learn a lesson from it and stop posting threads about Telgus, Eb3 vs Eb2.
I have also seen posts by ignorant educated illiterates on IV where they advice people to do illegal things. Some of you own consulting firms or businesses and try to promote it by posting and sending Private messages. If we see such message, let us give reds and report to IV. We also need to discourage people from answering wrong info to posts where someone is illegal/out of status. All this used against us.

I am in bit of a situation and trying to sort my options. I got my EAD, last month. Also took care of finger printing and received AP documents also. I 485 was filed in July 07. My I-140 is not yet approved.I am accepted to school in france for one year business course, starting Jan and ending Dec 08. Max I can fly back few times from France to US, for few days (In case there is rule for not staying abroad for more than six months). Plea
I am planning to either
a) Submitmy resignation and leave US by end of Nov 07 OR
b) take Leave of Absence from my firm for 15 months.
Is there a way I can continue my GC processing, factoring that I will be out of states for whole of next year.
Your suggestions are sincerely appreciated

First of all you need to talk to your emplopyer before you take any decision.What if he revokes the I140.Then when you get back to US you have to start the GC process again.
Why dont you defer your business course for a yr.By that time you're I140 wld be most likely approved and then you wld have passed 180 days.That makes it easy for your GC to process.

Agree with you 100%. And this does not require a law change and is relatively easy. Not very easy, but easier than getting a new law passed.
I saw a comment on a lawyer's website that recapture of unused visas can only be done through legislation and not through administrative fix..
And, the real issue we should try to address here is USCIS inefficiency.
There are a lot of " worldwide" category folks who have been current for over a year (and a few months after the 180 day memo) but are yet to get their GC.... So unless we get USCIS to move fast on the applications that are current, all our visa recapture efforts help DOS to move cut off dates further ahead.. but if past history is any indication, more of these visa #s will be assigned to Consular processing cases rather than AOS cases in USA..
So.. I think while lobbying for Visa Recapture is the right move, we should also lobby to highlight USCIS inefficiency in adjudicating cases that are current..
