Do they seek some sort of public opinion? If yes, Is that open to non U S citizens? Is there some kind of voting involved? We can touch base with UTD Student Associations so that they can forward it to their alumni who are still in that area.

I never said school can force her to maintain F1. All I said was if she wants to be on F1 (for whatever reasons) she needs to comply with school's policies. Also her maintaining or not maintaining F1 is immaterial to her legal immigration status in the country (which is safe by the virtue of pending I-485) it is just that she will cease to be on F1 status (her current non-immigrant status, just obtaining EAD doesn't mean she has abandoned F1 status, she needs to use it)
Also, she will no longer be on any non-immigrant status when school cancels her F1, from that point on her status will solely be based on I-485 and its outcome.
The school policies does not determine whether someone can be on F1 status or not. Government has laid down the rules for F1 status. School cant say that one has to take so many credit hrs for that person to be on F1. My advice: Dont wait for GC. The world around you is moving very fast and US is one country that is left behind. At 31 I feel the pinch of not going for my MBA. I'm planning for 2009 in INSEAD or ISB. My PD is June 2007. I'm not waiting for the stupid GC. There are better places to go and life to live. One life make the best out of it.

Hello friends,
Of late everybody is talking about bad economy. I mean its all over the TV and newspapers. Apparently we are in a recession since past one year (since Dec 2007).
However, odd it may though sound, I don't see any real economic slowdown in IT sector. I mean all my friends and acquaintances in IT industry in the US and India are retaining their jobs. I recently talked to my IT recruiter and she told me that as far as she is concerned this year has been like any other years. Bit sluggish at the year end, but loads of requirements lined up for January next year.
Am I the only one who is feeling this way, or others also sensing the same thing. Maybe the real jolts are still lying in the future, in the coming year. Or may be its just a hoax. I would love to know other people's observation on this strange anomaly between what is being reported in the media, and what is being observed on the ground.

While I do not want to sound discouraging or pessimistic, this is a very good idea and we must do things like this.
Now, it is just not enough if we make this suggestion and discuss it - we must walk the talk. Will we?
To start with, we can do a lot of stuff, get our co workers, families, friends etc.. involved, print flyers, send emails, post blogs, make videos and post them on youtube, hold local community events and increase awareness.
Our own community is still very ignorant and is indirectly working against us, lok at this post on immigration portal

My 140 got approved yesterday! Just 7 days after they received the response to the RFE. :D
Btw, someone asked abt 3 yr or 4 yr degree. Mine is 4 yr degree.

The media caters to its audience just like any other business nterested in its own customers. When markets worldwide rise or fall in response to election results in India, it gets major media attention everywhere because the audience is interested. Diwali is as unimportant in America as Thanksgiving in the U.K. There is no point fretting over it. Diwali could become newsworthy when people globally start tracking shopping sales in India since their businesses might depend on them. It's better to sharpen our skills so that we can seamlessly join the global highway than to sit on the sides cursing those passing by that they don't care about us.
Strangely google.com did show a logo in 2008 .. I wonder what made them feel that their audience has changed? Is it a sign that immigrants from India are becoming increasingly irrelevant or the numbers are dwindling or there is simply a unofficial policy to just ignore the brownies (please no offence and dont take it too seriously) ;)

Hello guys,
My frustration is increasing and patience going down. I am strongly considering moving back to India. When planning the move, a few questions popped in my head the answer to which I am not able to find (yet); hence putting it out here.
1. How can I inform SSN department or credit bureau that I am not longer in USA..hence no one can use my SSN even if it gets stolen? Is there a way to "lock" things down?
2. What happens to 401K? Is there a IRS tax law that says because this guy was on H1-B and leaving..don't charge him the 40% penalty?
2.1 After 40% in penalty and 30% in taxes...with the market beaten down...not much remains...wonder if it's even worth touching it. So if I decide to leave the money here in my 401K account, what happens when I want to withdraw it? Rather what is the best way to withdraw it?
3. Any estimates on how much it costs to ship things back to India? I live in 2 bedroom apt..so have the usual stuff.....couch, bed, tv, clothes of many sizes, lots of kitchen utensils. Just an average...I understand things can vary a lot.
4. PIO card has the passport number of my son on it...the passport will expire when he is five year old. So do I get a new passport number? If so what happens to the PIO card? Do I need to get a new one?

One of friends got advice from a tax consultant about the 401K withdrawal question you have. The best approach in this case would be to phase out the withdrawal amounts over a period of successive years. When you are in India, you are not earning US income. So say if you take 10K the first year, it will be considered income earned in US for which you have to pay tax. Since 10K is below the standard deduction amt, you will not have to pay any tax. The penalty will still apply as you are breaking the 401K.

I am in 9th year extension with priority date 09/2002.
My I-140 denied on 06/18/08n and immediately I485 also denied.:mad:
I have Visa vailid till Jan09.
1.If I change employer and able to get labor cleared before jan09 , can I apply for I140 PP and get H1B exension.
2.Is the Priority date transferrable if I change the employer?

I met an Indian who got his green card in year2003. Still he attended to give moral support to IV. Hats off to all those guys who made it to the rally even after getting there GC's. Hopefully those people who are still stuck in the GC mess realize the importance to actively participate in the events organized by IV.

Looking at all the things, it looks like August bulletin would be the best bet USCIS have with some cutoff dates but keeping the already filed apps.

The last point depends on the university. Many accept EAD as sufficient for qualifying as an in-state resident for tuition purposes.

USCIS is already aware of this. They have been notified through AILA and our letters are also working. IV has also been pushing for more broader AC21 regulations for a few months now.
Our request from IV is to keep sending the letters. Please send letters in thousands - not like 50 to 60 letters.
Everyone must take initiative and push other members. It is a very importasnt campaign.
It is very much possible that a lot of you may be a victim of AC21 denials. It is your call.
Please take responsibility and everyone must come forward and bring others also into this campaign.
