    As per the current guidelines adjudicating officer makes the determination based on Department of Labor SOC/O*net code in the Labror Certification Application (ETA 9098) form. ( It's very critical to have a copy of LC application, before considering AC21. If you don't have it through employer, you can get a copy from DOL through FOIA request )

    DOLs SOC/O*Net gives the job description for the Job code as well as "same or similar" jobs (if you search on your SOC/O*net code)

    This is the website IOs are supposed to be using (as per guidelines). Becoming a Sr. Software Engineer from Software Engineer shouldn't be an issue. Salary hike beyond 50% could (or could not) be a problem based on the IOs sole discretion. 50% is just a ball-park assumed by most immigration attorneys. In reality, there is no such preset limit. It's entirely upto the IOs decision.

    Promotion as manager is a tricky situation, as Job description changes. IO may consider it 'same or similar', or consider it altogether different. In such cases it may be possible to prove the jobs are similar by obtaining an 'Expert Opinion Letter' from an expert in the field ( such as a Professor of Computer Science from a University).


    How do Promotions impact one's existing GC application?

    for example: one filed for the GC as a Software Engineer, 5 years down the road one switches to a different company in the same area/location using EAD (avoiding AC21 for now) and the salary is 30 % higher than that was mentioned on one's LC filing and the job title is sr software engineer (same or similar responsibilities, senior title). How would something like this impact one's GC application?

    I also wonder what would happen to the GC application if one was to get another promotion and become a manager with even a higher salary (some job responsibilities stay the same and some new managerial responsibilites get added).

    I am sure many of us would have faced this since clearly many of us have been waiting for many many years - I would really appreciate your input on this. Thanks!

    im on I-485 pending. but had to stay in H1B ( 8th year ) to make my wife stay on H4. i have plans for india this spring and do you see any issues while i go for H1B stamping in chennai ?. Any recent experiance / advise would help. thanks.

    Dont forget the APs. Sometimes they refuse h4 stamping if I485 is pending. In such cases use AP.

    Job switch after getting Green Card!?

    Question:
    My question is: Can a person switch the job once (s)he gets his Immigration Stamp? If not then what is the period of time for changing the job after immigration stamp. Note that he is currently on H1B and waiting for Immigration Interview.


    Answer:

    The official rule (which IMHO has not changed with the passage of AC21) is that you must not have any preconceived intention to leave the job when you get your Green Card. (Your friend clearly does :-( ) In general, working for the company for one year after getting the GC is normally considered sufficient.
    If he can't stand the thought of a whole other year at the company, then he should withdraw his consular processing and switch to adjustment of status within the US. 180 days after his AOS is filed, he can take advantage of AC21 and switch jobs, providing he remains in the same field. Of course, the downside is that it'll be an extra year or more before he actually gets his GC.

    I doubt such a "rule" would be enforceable after AC21 for people getting greencard thru the lengthy I-485 process. It makes no sense that someone in the I-485 for more than 180 can change job while still getting the greencard, while someone with the greencard can't change jobs after waiting for so long on the I-485. A federal judge would certainly dismiss such case.

    I wouldn't speak so soon. We already have an analogous situation with marriage: if you divorce three years and six months into a marriage, do you get to keep your Green Card? Not if the processing took between 18 months and two years. If it was more than two years, you are home and dry because you got a full GC; but if you get your GC even one day before your second wedding anniversary, it's conditional on you staying married for another full two years (with a few exceptions for domestic violence etc.)

    So although I agree the situation is iniquitous, we already have a close analogue enshrined and clear in law. Could it survive a challenge under the 14th Amendment? Maybe not, but nobody (to my knowledge) has ever tried.

    I am just trying to find out the average Lawyer Fee and Cost of GC (including Labor, I-140, 485, AP, EAD etc)

    So far I have paid 8K to Lawyer and USCIS.

    PERM: $1400 (case approved)
    I-140: $1200 (case approved)

    I-485: $1200 for primary applicant, $750 spouse, $500 per child

    My company paid for H-1B and GC

    Mine is already done last month. You may have to wait there for couple of hours if you go on weekend. But once your number comes, it will be very fast.

    20 minutes - 1.5 hours - Waiting time
    5 minutes for physical checkup
    2 minutes for shots
    1 minute for blood work and PPD
    2 minutes to pay initial fee
    48-72 hours for PPD results ( Since labs are very very busy, they may take upto 4 days to send them blood work report)

    After 48-72 hours
    30-40 minutes wait to show your ppd result
    1 minute - Dr to see PPD result
    10 minutes - for xray if ppd positive
    5 minutes - other shots if your blood report says so
    5-10 minutes - for dr to read x-ray
    2 minutes to pay for remaining fees

    30 minutes - wait to get your sealed envelop ( otherwise go next day)

    I got my stamping till 2010 based on my I-140. I did that to save another visit to embassy when I go out of country and its costing me dearly. The visa stamp clearly mentions the effective dates from both 797s. So the officer asked for both 797s and stamped the end date from the current one. As he sounded positive that I can update it at my local USCIS, I didn't persuade him much. Maybe I should've done that!!!

    Why did you show him the previous 797 anyways? Doesn't the previous 797 get invalidated the moment you get a new 797?

    1. Born in 70 but my birth was registered in 2005 when I wanted a birth certificate, BC issued in aug 2005 and says registered in 2005. Is it ok I use them or I need an affidavit also from my parents?

    1st question). As per immigration rules,if ur birth is registered on or after 1year of ur birth till date,u got to submit two additional sworn affidavits along with the birth certificate as proof.

    So in ur case since ur birth was registered in 2005 and got a new birth certificate in 2005 u need to submit the following :

    Birth certificate(which u have now with u..issued in august 2005)

    Two sworn affidavits from any two blood relatives(mom,dad,siblings,aunt,uncle) older and get notarised
    by any attorney/magitrate.The following is the format.

    I would say Canada because British Columbia has a much higher standard of living than Boston. Canada is generally a much better place for raising kids and the stress levels are lower because of freebies like health care etc. BC also has a much better weather compared to Boston.
    The other reason is that you could always come to the USA from Canada later but if you lose the Canadian PR now and don't manage to get a green card in the US, you lose everything.

    Hi All,

    I would really appreciate everyone's honest opinions on this matter.

    We filed 140 and 485 concurrently in July 2007, EB3. As of now there is no word on either application. Previously we had also obtained Canadian PR, the 3 year grace period of which will expire this August.

    Not only am I faced with a decision of staying in the US or going to Canada, but my future career is on the line too. This year I will be 23. After taking my undergrad degree in electrical engineering, I have been accepted into Boston University Law School in the US as well as the University of British Columbia Faculty of Law in Canada. Canadian lawyers make around half as much as American ones after all factors are considered.

    In your opinion, should I stay in the US, going to law school, in hopes that the green card will come through, or should I pursue a new life in Canada, but take the lower future salary / international renown?

    This issue is currently causing much discord in my family. I hope to hear your frank opinion so that I won't take my decision lightly.
