We should file 485 but lets keep our eyes on this and start action as soon as we know what is going on. Filing 485 will not gain you much if they add some amendment which nullifies EAD extention or something like this.

Also, I have moved to Biz Dev from an engineer after my Labor. I now have my 140 and EAD. Is there any risk because of my change in role?
I am just giving a general idea of what the process might be. many people get RFEs for no good reason. In this particular instance for example the work experience may be questioned and also the job duties and how much they are different (including difference in pay) to justify EB3 to EB2 conversion. many aspects that are generally overlooked will attract more scrutiny as the application becomes more complicated as they have to review both the applications in detail.
Moreover, lets say the number of EB2 applications every year is about half of the number of EB3 applications or lets assume the average number of EB2s every year in the last 5-6 years was abut 30,000 per year and unusually if this year the EB2 applications go up to 60,000 and 30,000 of them are actually EB3 to EB2 conversions, that in itself will trigger a red flag to USCIS and will lead to increased scrutiny of all those applications that may have been converted or are filed after the visa numbers became unavailable. My intention is not to discourage anyone moving from EB3 to EB2, but am just advising that you do it right and take the help of the lawyer, because by chance if you get an RFE, you do not want to be answering it yourself. let a professional lawyer handle it. if you are confident that you have a high likelihood of success then go for it, but don't listen to all those that say it is very easy. do your own assessment and decide for yourself. in the end it is your greencard application and not theirs. you always hope for the best outcome but remember you have to be well prepared for the worst possible outcome if it happens. what did life teach you so far?

I faced the exact same question a few months ago. I came to INSEAD in Aug'07 after taking a leave of absence from my employer. My advice is to keep the door open by trying to keep your process active.

Doctors have played a pivotal role in the last few days in getting things done for us.
Ethnic diversity is desirable but not always easy to achieve and if the organization can achieve its goals with groups without ethnic diversity, what's the harm? After all, we are here to achieve the goals and diversity is not the only way that can be achieved.
So please be thankful to Doctors of AAPI who have much bigger and powerful organization AAPI - both in terms of money and clout - and have decided to endorse our effort and help us.
I would kindly request folks to be careful when posting comments as we dont want to neglect or even appear to neglect our supporters.
By the way, we have tried to get a couple of best selling authors on the competitiveness topics but we could not get them to come on the advisory board. We did get endorsements from two of them though - Richard Florida and David Heenan.

Also there could be election year effect because most of the resources at NSC are directed to work on Naturalization cases but why to single out just EB3 cases ? Didn't they have sufficient approved EB2 140 at hand to give them a 485 ?
I never imagined being stuck for 15 months for a 140 - at the most 9-12 months was my worst case analysis. My plans of porting from Eb3 to Eb2 got ruined , job change AC21 all preparations went haywire. I've already renewed EAD card once but can't use it confidently unless this Eb3 140 is approved .
How come EB3 at TSC is going smoothly - didn't they get the directive like NSC to stop working on EB3 140 's ?

Before Nebraska service center retrogressed their processing dates I was able to speak with an IO. I asked her a few questions relevant to this.
There maybe a public USCIS rule / procedures that would confirm what she told me.
Q) When is the name check typically initiated
A> Soon after receipt
Q> Is my name check cleared.
A> wait a moment..... yes

1) Transfers from Texas
2) VB moving forward coupled with no pre-adjudication. Therefore they have to go back to older receipt dates.
3) 180 day name check rule taking effect -- clean up old cases.
4) Public processing date was internally known to be too far ahead of reality (and therefore causing service requests).
Now could USCIS hide behind name check now?

2000-2002 was worst. Who didnt do job search during that time have no idea how it felt like.
I just came out of school then and it felt like sky is falling on me. Becoming desparate to survive, i went to work in a gas station. The lady owner didnt pay me after i worked for a week saying i am not concentrating enough. Then out of no where i found a technology job that paid 17$ per hour to keep me going and they did my H1 a year later in 2002. It just made me more strong i guess. But, it is a hell of an experience. Most of my freinds went for second masters or PHD to Keep the status.
I've got to agree with you. I was just getting out of college that time as well. I had a job at Best Buy, and trying to find my first break, and all my senoirs were getting laid off. I finally got an internship at a startup company for $2000 a month, and ever since then the market has been doing good. I really hope it will never come to the way it was back then. But as of now things are doing quite well, there is stilll a lot of hiring going on.

You need to speak to an attorney. The language which ties to this employer until a project is completed might go against the "employment at will" law - not sure what the status is in NJ.
Once you complete a timesheet, an employer should pay you considering the timesheet is appropriate and not fraudulent. If the employer does not get paid by the client, that liability should not shift to you in terms of asking you pay back your paycheck.
I am not a lawyer (only a liaison to the legal eagles), please seek legal advise.

Interesting...looks like this bill is moving faster than we'd think...it would be interesting to see where it ends up. Also, it appears that this bill does not talk about giving the DV visas to existing EB-X categories but instead to create a new EB category for STEM graduates...not sure, but that's what it sounds like.

There were a few instances where the previous senate majority leader, Dr Frist was trying to by-pass the committee. But, in the case of the House of Reps, it would not have done any good as Denny Hastert had the rule of "super majority" meaning that he would only bring bills to the floor when a majority of the majority (of Republicans) would support it.
Bills almost never go to the floor directly. Especially something as huge as CIR. It will go thru committee again and it will go thru normal rounds of debate and amendments between the 18 people in Judiciary committee.
Its very unusual for a bill to hit the floor directly without going thru the committee that has jurisdiction over it. If it happens all the time, then the committees would be meaningless. The whole point of having a committee is to be able to either kill the entire bill, or a congressional appointment before such a bill / confirmation is debated by all 100 senators. Same thing in the House.
If it was possible to bypass committees, then people would have floored the SKIL or other bills directly on the floor of the house, therby bypassing Jim Sensenbrenner and his Judiciary committee last year.

Applications were sent to NSC on July 19th' 2007. I got my receipt numbers today and all three numbers (I485, EAD & AP) start with WAC ### ### ####. The online status for the applications say that the 485 application was transfered to Texas Service Center and the EAD & AP applications were sent to Califorina Service Center.
Also just fyi, my I-140 app. is pending at NSC since Dec' 2006. So now I am all over the country :-) Don't know its good or bad. Any idea anyone?

It's just a caution. Some people would like to take it slowly but surely, some people love to run fast with a risk of stumbling in the middle. Whichever you go, the finish line is always the same.

Maybe USCIS is already processing the PD 2007 for India, and the VB Bulletin next month will be current for the others. If thats the case they already advanced the cutoff dates.
