Disgusting, Sheriff Joe is monster. Perhaps he came from family with no respect for women.
On the lighter note, if I were a judge, here's what I would do with Sheriff Joe if he was trailed:
1. Perform sex change operation on Sheriff Joe and install a womb.
2. Perform artificial insemination on Sheriff Joe using the seed of big man like Undertaker, Shaq or Khali (so that offspring is a big baby).
3. On term, shackles Sheriff Joe and make him go through the pain of giving birth. In the process don't administer epidural or perform C-Section.
4. Don't repair any damage done to his body parts after delivery.

sweet_jungle, can you please update your first post of this thread with directions on what we need to do and within what timeframe?
All people affected by USCIS blocking approvals for current people, lets get organized.
This time USCIS is hiding by not making official announcements.
We need to act as we did last July.
Lets send letters to congressman like zoe lofgren.
NSC is issuing frivolous RFEs as delaying tactics.
I am not seeing similar outrage as we saw last year.
The time to act is now.

Here it goes
I have about 7 years of experience as a project manager in Environmental Engg and a BS from a very reputed school but my visa status doesnt permit me to work. Recently, I had to let go of a wonderful job offer because I didnt have EAD and was not even eligible to apply for H1 work permit, having used up 6 years of H status (the employer was ready to sponsor). That leaves me no option but wait for backlog to be cleared or Plan B- move back home. With retrogression, it would take atleast two more years to get my EAD. That would take away 8 years of my productive time in life. All these 6 years, I have volunteered in different non-profit organisations by developing and maintaining their websites. I am also volunteering in my son's school. We have been paying our taxes, donating to Firemen, Policemen etc. It is frustrating that we are giving to the community and not getting basic work permit in return.
How US will benefit if you remain here (competitiveness angle) -
I have a subtantial work experience and energy which I can put to use if I get to work and contribute to the US economy. Currently all my skills are wasted while the job position I could not fill due to immigration issues remains open for last 5 months.

Starting Jan 2007, I will chip in 20$ per month every month until we get the bill for GC relief cleared, if we can beat Anurakt's challenge of 60000$ by 31st december.

Sad, but true, the substitution labor are utilizing the visa numbers a lot.. Not sure if any thing can be done @ this time.... There were lots of new people filed I-140/I-485 utilizing substitution labor in July / Aug 07 as the LC substitution was sunset after wards... Though it is legal :confused: they could have made the PD, they day I-140 was filed, since they allow to retain original PD, now people who really waited are forced to wait even longer.... Now that the program is sunset and also many people already jumped the line, do not see any advantage in complaining about it and expect no administrative reaction to this as labor sub no longer exist... Only solution to retro... is unused visa recapture / increase visa number / exclude dependent / etc... none of these can happen without intervention from congress.... which required very intense lobbying... which in turn requires $$$$ ... and more participation and contribution from the members seems to be the only option that could help all... If you don't help yourself.. no one would !!!

Thanks deecha for your response , I am sorry that i was unable to frame the question properly.My question is traing period (July 1st 2004 to Aug 30th 2004 = 60 days) without pay on H1B is treated as Out Of Status??? Is this period(July 1st 2004 to Aug 30th 2004 = 60 days) counted towards 180 Days period (to be covered under 2445(K)) or not?
For a new H1B, a grace period of up to 60 days is allowed before you can start work after entering the country. However, you were already in H1 status and this was a transfer and If you did not get pay stubs for those 60 days, then unfortunately for you, my friend, you were out of status and this period would be counted towards it. There might be other mitigating circumstances you could use to qualify those 60 days as "work" for your employer. You will need to consult a good lawyer and be on good terms with your (ex ?) employer and have his co-operation. If you're in Michigan, I can recommend a good lawyer. PM me.
In my case (see above), I inadvertently left the country in '04, without realizing I may not be allowed back in (I did not even have AP) and I also got lucky on two counts i) My employers petition was approved in just 13 days (non-premium processing) ;and ii) I was able to get a visa stamp in home country without a visa interview (but that scheme was terminated the same month due to other consular concerns).

IV strikes a blow for the high skilled community!
Remember the time when members were ringing up the phones of Senators and Congressmen during last year's CIR discussions? I suppose we all came of age around then.. and grass roots members got the idea they could make a difference.. From then on, IV has been going from strength to strength, a snowball finally on the move.. leading to the flower campaign, then the rally, and now, this!!
My hats off to the core members, who have skilfully steered this sometimes raucous, but always enthusiastic ship.
I was going through my Paypal transactions, and totting up my contributions. The tally? not nearly enough!! So adding some more to the kitty.
Its a small price to pay for the biggest payback, of all: A voice!

The only way we would be able to find out about the truth if by looking at the approvals in the next few days. I guess if an application has been assigned a number then those applications will still be approved but in the next few days the approvals will stop.

Please try to read law carefully. The law will not have simple terms as you think. They have to draft the law in the language of the act. Any way the meaning is same.
The law explicitly say that the 7% country limit does not apply to the EB1, EB2, EB3, EB4, EB5 catagories, if excess visas available in those catagories.

Can you elaborate on your decision to start your own IT training firm (as opposed to a IT service provider)? I grew up in bangalore and there were a large number of training institutes back in the day. I am curious to know how your training firm is going to be different from others.

Well, you know the quality of education which IT traning firm provide there. I will just focus on teaching OCP certification myself. mejority of institute just teaches oracle. They dont have enough expertise in teaching DBA knowledge.

Senthil has articulated legal basis of current system. However, many members feel agrieved by current situation. My displeasure with current law was based on my perception about principles of natural justice and a dogma that one measure (current provisions) should not negatively impact other's basic rights for happiness, equality, nondiscrimination etc. Courts could take a look at how much damage or injury is possible or actually already resulting (stalled careers, family separation, life on hold, creativity-innovation halted) in current system. Atleast it will open up healthy debate and rational measures to address genuine problems.
Could anybody clarify as to whether counting of family members towards annual quota is mandated by congress or it is an administrative provision.
Bill Clinton did a wonderful fix by signing AC21 which corrected many shortfalls of immigration law.
I am personally not impacted by backlog. However, I am feeling bad enough for the failure of current sysem that overlooks human tragedies. 180-day name check fix is a commendable step by USCIS (brought about by healthy debate and do not look at this as court-imposed). As in the scientific world, peer review and criticism is taken seriously in this country. By law suit, we are trying to create peer review or honest analysis about this impasse. No body wins but the truth and humanity.
If there is any way to open up annual quota (recapture, family members exempt from annual limit or any measure I am not aware of), automatically everybody could benefit. It may be also possible for EB3 to interfile or refile for EB2 and take advantage of old priority date and shorten the wait. There is no magic wand! We could help our administrators, law makers, law protectors and law upholders to make appropriate corrections. Hence, scientific and rational dialogue through fair and just means should be our focus.
Let us highlight our difficulties in a logical way. Go about living normal life but stand up for something you believe in.
