If someone has experience with working on the software they use for this site, they should volunteer their services. Dont we have a single 'Skilled' immigrant who can help implement those suggestions. This would be a great non cash contribution.

You definitely need to defend yourself. If you do not, the default judgment may be entered against you (you'll be automatically guilty and responsible for the payment). Consult with an attorney first. You usually have 30 days to respond to the complaint. Did you get summons? If there are criminal charges against you, you are entitled to free government attorney. No need to ruin your life because of this.

In this day and age the news travel fast and if we expose wrong people it will help everybody. My friend told me that his brother in law wanted to come to US to earn his flying licence. He wanted to go to this one school in California. My friend left three messages with the school last year buy luckily no one returned his call so his brother in law joined a school in GA. It is still a breaking news and it would take few days/weeks to figure out what actually happened but due to the wonders of internet everybody who is interested in becoming a pilot knows about this and it all happened within days.

bought AIG insurance..twice, my dad had severe hand pain and could not take him to a doctor, cos, the docs wont accept visitors medical insurance without a cash deposit. then i tried to get pre-certification from AIG, for which they would not give it, so its a catch 22...so screw it, even if ur parents fall sick, all of a sudden when they are in the US, take them to the emergency, there is no system in place for medical insurance for visitors, every other insurance is a scam..so dont even have any hopes..just do what u need to do..there are lots of times, this country does not allow us to live more than 6 years being on h1 without a freakin green card, we have paid lots and lots of taxes which we will never claim..so, this is how they repay.

Absolutely not. AC21 only removs the per-country limit in any calendar quarter in which overall applicant demand is less than the total of available numbers. In the present calendar year, the overall demand is defenitely more than the total of available number and AC21 priviledges would not apply.
DOS would clearly violate the 7 percent limit if excess EB2 ROW numbers flow to EB2 china/india. Don't want to get into an argument here, so I will leave it at this. Each person is entitled to his/her interpretation just as DOS has its own. Peace.

PD provides twoway door, one for new people to apply and other for USCIS to approve pending cases. Having more applications pending (out of PD range) will not help USCIS to approve cases, they need to move the PD forward for more applications to become current and for them to approve some of them.
Most of the people who rushed into July-Aug 2007 where EB3 or EB2 India/China. Since EB3 is closed for the year they have to move the number of EB2 India/China to pick those applciations.
well yeahhhh ... anyways, we will definitely have the numbers moving from now on EB2 and it may retrogress but not beyond April 2004 :)

Indian real estate market is fueled by the black money india. They are using NRIs as a facade. Investing in realestate legitimizes that money. Now they don't care how much rent they are getting. It makes no business sense at all. You and me cannot comepete with them.

Country quota is NOT affirmative action, nowhere even close. If you are socio-politically dominated by Indian or Chinese, yes, then it is affirmative action. But if you do not come from a place there Indian and Chinese imperial powers have taken over the country, then how are you socio-politically dominated by Indian or Chinese. And if you are not dominated by Indian or Chinese in the country where you came from, then how could it be "like" affarmative action.
Maybe you yet don't know, but Indian and Chinese EB applications cannot vote and they do not have any representation in the US government. So its not that you are "not properly represented" and Indian and Chinese have all the representation. WE ALL HAVE NO REPRESENTATION. Just so that its clear.
Your next argument is that you are "overwhelmed" by Indian and Chinese so there should be country-limits. Well, I can understand that, we are very overwhelming people. You see 40% of the world population gets 14% green card, we tend to become "overwhelming" for other.

Yes! on IV you are supposed to say only good things about IV (though IV is "grass-root" non-profit) but no free speech here :confused:

At least we should know that what is cooking inside. Because people are hanging here from 2001, USCIS should let us know how many GC(s) assigned to EB-3 India/ROW in 2008.
I would like to add one more item here but I don't know how many know this fact. I have seen and know that when someone wins a green card from Lottery, USCIS gives GC to all dependent family members of that person and they count one GC but in EB base they count GC for all family member(Primary applicant plus all his/her dependents). I think this is an Unjustice with us. We should raise this issue too.

Why are you so PROUD to be an American? Just be happy for it...its just your need so that you can live in this country for as many year as you want and of course its good achievement and i am happy for you, you just lived here for 10+ yrs and you forgot your Home country where you were born and gave you a good education with you had an opportunity to come here and make your life based on that..you should be PROUD of that country no matter where you go and what you achieve its all because of you Home Country

He has chosen the US to be his country and so he has all the reasons to be proud! As for being Indian fisrt and then being American, it is all wrong. You can't have one foot in one place and the other foot in another place. He chose the US as his country and he as an obligation to be loyal to the US first.

Unfortunately, this situation is analogous to riding into a starving town and waving your loaf of cake (bread = GC, cake = USCzip) at the hungry and the poor.
How do you think it is going to make an EB3 feel who has been here just about as much time as you have been but is still waiting for his date to get current so he can expect some action?
When people here report their GC approval they do it because it helps others who are waiting know what their filing dates, PD, etc was.

That's too short a wait. You have to give atleast 10 working days to be safe. It takes 7 working days for many people these days and if you are lucky you can get it sooner than that.

I paid 100 USD to my attorney, just to reply to a small RFE. I think that is how it works.
I got soft LUD on 4/10 and a hard LUD on my wife's application on 4/13. My attorney recd the RFE today and informed that USCIS is requesting evidence of my marriage to be bonafide.
My attorney is asking for additional legal fees for replying to RFE. Gurus, do you think I should pay to the attorney or can I just reply to USCIS with evidence?

Couple of my friends, who have 3 year degrees from India and also have 2 year Masters degree from India, have not been able to apply for EB2. Their lawyers suggested that 3 year degree are a hindernace to get EB2. They both have not tried applying for EB2 and both have active EB3 applications.

I don't think AILA is fighting this memo on the grounds that it is illegal because of the fact that E-E relationship is illegally defined by USCIS, but they are fighting on the grounds that it is illegal because such directives should come in the form of laws!
Simply put, they are telling USCIS to follow the laws passed by the Congress without providing their own interpretation. This could very well apply to AC21!
