I guess formal or semi-formal wear should be good enough in the heat.

I have the same frustrations:
1. Waiting for labor for almost 4 years.
2. Haven't made to 140.
3. Wife on H4, very frustrating for her.
4. Potential contracts/jobs missed.
5. Tired of waiting. Another year???

I am tired but I would like to do something while I am waiting... that's why I am thinking of starting PMP. That way, if I eventually get GC or end up moving to some other country I will have some value addition.

Just submitted I140 (6/2006) but have to endure the fear that my EB2 will be kicked to EB3, which means RETROGRESSION!
With H4, wife cannot work. Going to school is too expensive..i can't afford it with my small salary
Stucked with current company...being under appreciated and under utilized by the current employer...not a place for me to build my CAREER!!!
Have potential contract jobs/independent consultant positions available (recruiters contacted me) which pay 50% than what i am making now...but can't accept those offers bcos of GC!!!!
So so tempted to return home for good (sick and tired of the WAIT), but Everyone was saying "u had waited for years now, so why not wait for another year or so to get it..don't waste the golden opportunity" But...but...is it really going to be just another YEAR? :rolleyes:

AC21 is a law but certain provisions of AC21 have been introduced in separate memos.
Job portability under AC21 is also part of a guidance / memo - so if any AC21 case goes for hearing in an immigration court, any change of employers while 485 is pending is considered illegal. This is not very common though.

To be part of the American Dream. -- They are the ones visiting this website, to check if there is any news.. any ray of hope for their doldrum existence.

The guys who decide to move back unfortunately don't come to this website.
During the last recession & once in a while I see lot of smart guys (lot smarter and lot more educated than myself) move back to their home country. Not because they don't have a job but due to better prospects back home (booming economy et al). They came here since America showed promise.. they left because the way they were treated was not what they expected. Bottomline America failed to holdback those brainy folks. They may have said yes to you. They probably wouldn't have bothered. So coming back to our conclusion. Wrong question.. wrong addressee..:p

Is IV interested in doing a Freedom Of Information Act request to USCIS how and when they used up all visa numbers for EB3-India. That might show some information if they cooked the numbers if at all. We might get some more insight which monthly VISA bulletin does NOT give.

I agree with most of things you said. By the way, I called the office of the Honorable Attorney General Alberto Gonzales today. I sent e-mail messages as well. Obviously I don't even ask about fixes since he is not supposed to have that power. However, I requested a timeline on when the EB3 I-485 cut-off dates are supposed to move ahead. That is something he does have power to do.
Regarding your conclusion on our local IT professionals, I am not sure if that's always the case. I hope you are right.

Americans have the right to determine how many immigrants they need and how to handle this issue. But we have the right to follow clear and simple rules for that process. It seems to me that the way they currently handle the H1 immigrants has a lot to do with the "Las Vegas" type of business (gambling) - shall I get my LC approved, when will I get the LC approved, shall I get a GC, when can I get the GC etc. The rules change permanently and half a million hard working people are in limbo for a decade and more. That is not fair and this is what you have to explain to the Americans.
And, btw, if the local IT "professionals" you were debating with were so great, they would not be unemployed...

Again, including her name on your I-485 application would not help her to "get into the queue". You need to file another I-485 for her and you can only do that if she is physically present in the US. (you need the I-94 card). You could have the court marriage in July and bring her here on an H4 or other visa, and then file for her I-485 as well.
I am in a similar boat as you, except my ritualistic wedding would be in Aug and I am banking on the hope that the dates would still remain current for August.

Well then why dont you picket against NumbersUSA, programmers guild et al too, i can name 20 conservative radio shows try emailing/talking them to change their opinion. I say this because i have emailed to a few and even tho they understand my point of view they will not change something that gets them ratings and propagates their cause.
IV has 25k members, i guess 10% out of those are really motivated to participate and ready do something, if you start diverting your resources towards such issues your team will not have much motivation or people remaining when you really need them to do something. IMO
