Please stop H1 Vs L1 discussion and do not support those who aim to divide this community on various visa types, categories, nationalities etc. Any further attempts by any member in this direction will result in ban. I went through the text of the new bill vis-a-vis current INA and compared the old and the proposed act. Here are the findings -
Section 101 - This spells disaster for all H1Bs in consulting companies (as FT or C2C) -
by striking clause (ii) of sub-paragraph (E) of the section 212(n)(1), and then adding the new clauses under (F), they are PROHIBITING placement of H1B employees on another employer's site, period. This will affect NOT ONLY pure staffing (desi or non-desi) companies who place their W-2 H1B employees at client site, BUT ALSO big consulting companies like IBM/ACCENTURE/DELOITTE et al. No placement/leasing/outsourcing/contracting for services or otherwise at another employer, period - UNLESS a waiver is obtained, which will mean every company will need to obtain a waiver in order to do so, EFFECTIVELY ENDING ANY CONSULTING BY H1B.
Section 102 - This spells disaster for all companies who's H1B+L1 > 50% total employees
by inserting two new clauses (H) and (I) in section 212(n)(1), it prohibits H1B only or H1B preferred advertisements and prevents any company that employees more than 50 employees to submit NEW H1B/L1 application IF the total number of H1B and L1 employees exceeds 50% of its total employees. It also requires ANY company employing even a single H1B employee to submit W-2s of IRS. This affects ALL Indian IT companies like TCS/WIPRO/INFOSYS/COGNIZANT et al.

I totally agree everbody. ICICI bank all time sucks. I have account with them for 5 yrs. and everytime I do transfer money to India (FYI I do Wire Trasnfer On Monday morning US CST only should be credited in 1 business day, expected that the money will be credited by Tuesday IST ICICI Business time). What happens eveytime they will credit after 5 business days and provided with lowest Exchange rate.
hmm, As an Iranian citizen, I cannot do this (transfer money to Iran) anymore. When I used to live in Canada, and before all this Nuke fiasco, I could do this, and the way I got away with losing minimum amount of money was that I asked my bank to transfer, say, 2k in US$ to Iranian bank to be held until my dad went to collect it. He got $2000, with no subtraction, rate conversion or anything. He could sell it to the money exchange shops at the rate of the day. You should try doing that (Send US funds, instead of doing the send & exchange through the bank which has a vested interest in this...)

There are several of us who have advanced degrees and yet have been put under EB3. Now, a lot of them can move on to a more responsible role but held captive by the immigration situation.
Just a thought - if the STEM degree holders can be exempt, then it will take some weight off the entire system.

IV managed to fight its way through the July visa bulleting fiasco and compelled the USCIS to honor the original bulletin. Even after witnessing such a huge achievement if some people are making comments like they would like to weigh IV's worth before deciding to make contributions then they can be classified as perennial skeptics.
Visa bulletin after visa bulletin is putting us into a spiraling depressive state. IV is the only organization which is interested in solving this retrogression mess affecting highly skilled immigrants.
Make IV a paid subscription organization at $50 membership fees per annum. It is better to have 10000 members who can surely generate half a million dollars in revenue, rather than 25000 members who take about 8 days to generate 30000 in funds.

Now after seeing the efforts of the member in the flower campaign and sanjose rally, I am getting my confidence back and started my subscription again for $50 per month.
Will do additional contributions.
No single person needs to spend $64000/- for the community, which are supposed to have a decent earning and educated.
Everyone legal immigrant now has some debt to pay to Aman and IV.
Please help yourself by making a little contributions, if we 15,000 active members and everyone is contributing $10 per month, it will be 150,000 dollors, which is a good amount for lobbying. I am sure everyone can afford this amount monthly.
Start contributing, and let us make our dream realized.

I've live for 15 years in the states and never carried my Passport or Visa Papers when within the country even when out of state. I never got in trouble for that. I don't see the need why I should suddenly start carrying it now.
Of course if I am travelling close to the Mexican/Canadian borders I may carry as extra precaution but otherwise no.

In the EB base, only 1 GC is counted for all family members. How can it count more than one if it is a derivative of an employment visa? It might count against the Family base even though primary applicant is EB-based. Not the other way around.

It may not be popular here, but IMHO PD porting within the same filing category can be allowed, but not retaining the same PD if you are "upgrading" to another category.
I remember one person giving an analogy of a queue in a grocery store. I would like to give a different take on it. One express line and another regular line. Lets say the regular line moves real slow and the express line is well express. However the express line slows down, but is not as slow as the regular line. The person waiting in a regular line decides enough is enough, moves to express line (by dumping the items that exceed the express line limit).
How would the people in the express line react if the person from the regular line tries to "retain" his or her position by cutting into the express line, stating that he/she was before them, but only in a different line?
If you think logically, that is the case we have here with category interfiling.
I would recommend some sort of compromise, as its not fair either to ask EB3 people to move to the end of queue, as all said and done they've been able to bargain with their employer to apply for their GC, while we did enjoy a bit in grad school, and came out with a sense of entitlement. :D
Some intermediary date, lets say determined by a mathematical algorithm (hopefully not designed by gctest) or whatever is deemed to be a fair date. But retaining the original timestamp in the regular queue is unacceptable to those who have qualified for EB2 before the one porting his/her date to EB2.
I think USCIS must meet the EB convertors somewhere mid-way to maintain fairness.
About gctest, what has pissed me off so consistently is his trash-talk, calling EB3 third grade workers, his utterly self-centered attitude and inability to see other side of the story. Over and above that he lies, cheats and changes his story all the time.
angelfire, before you go and make such a determination, please do understand the root cause of the issue.
EB3-I processing is stalled, especially after USCIS opened the floodgates and let everyone inside one time.
Folks who were waiting patiently had their clocks turned backwards and pushed at the end? Classic case of starvation.
Upshot - some with older EB3 PDs have ported their dates, after qualifying for senior positions based on their academic credentials and job experience and getting jobs under EB2.
Which is why see an odd 2002 EB2 PD suddenly appearing from nowhere and getting ahead of you.

I think USCIS must meet the EB convertors somewhere mid-way to maintain fairness.
About gctest, what has pissed me off so consistently is his trash-talk, calling EB3 third grade workers, his utterly self-centered attitude and inability to see other side of the story. Over and above that he lies, cheats and changes his story all the time.

EB3-I processing is stalled, especially after USCIS opened the floodgates and let everyone inside one time.
Folks who were waiting patiently had their clocks turned backwards and pushed at the end? Classic case of starvation.
Upshot - some with older EB3 PDs have ported their dates, after qualifying for senior positions based on their academic credentials and job experience and getting jobs under EB2.
Which is why see an odd 2002 EB2 PD suddenly appearing from nowhere and getting ahead of you.
How many are actually converting?

Indian markets are in fact more controlled (by the government) than US ones. Last few years were like "wild wild west" on the Wall street under the cloak of "free markets" theory with practically no oversight or regulation of any kind which ultimately landed us all in this hole!!
It's not a wise decision to invest in India for another few years. If a controlled market like the US experiences such short comings, you cant even imagine how things will get in India. It's going to be extremely volatile and the armageddon is just about to begin. Stay away from there.

The donations that we make to IV will be part of the general corpus which will be used for lobbying. As one core member pointed out 99% of that fund is utilized for lobbying, I am guessing remaining 1% is spent on hosting IV website.

People, since Aman and lets not forget other core members also who I am sure have racked up a lot of out of pocket cost we as a community should gather funds for administrative cost also. GC is not just Aman's/ pappu/logiclife and others core member's dream...its OUR dream, and its not fair that in spite of knowing the time and money spent by the core members we donot share the burden.
So here is what I am thinking, there are 21000+ members of which I think 10,000 can be considered the real people (I am sure there are more..but a real conservative estimate) if we all pitch in $10 for administrative cost I think it would not put any dent in our pockets and this collective effort would not create a financial burden on any of the core members.
Even though IV is not for profit, there is no rule which says that you cannot have funds for administrative cost. In fact one rule of thumb to give to any NOP charitable organization like united way etc is to look at their admin cost. Why not IV have that.

could it be that ppl will not be able to sneak in with pre-approved labor now? if there is a significant number doing that, the PDs will move faster. Congrats IV on this achievement!
