ya, lets step-up a poll and have everyone vote, as if this is the US congress. And after voting leave it for someone else to work on this and other "brilliant" idea. There needs to be a reality check. This poll doesn't mean anything unless there are enough people to spend time and energy at every level. But ya, lets setup a poll and have everyone vote, it will give everyone a feel good factor that everyone contributed in the advocacy effort, how? by voting in the pool and not doing anything about how everyone votes.

Pascal ... I really admire your straight thoughts. I am watching this EB2 Vs Eb3 uproar from last couple of months. Its amazing that we are more focused on this useless conversation rather than taking positive steps and spending our energy to fix the problem. Only if all the affected people start contributing money, start organizing the state chapters, and start participating in the IV activities .. we will see some light at the end of the tunnel. It purplexes me that people use this forum to start war of words, just to keep them busy, but seldom use the forum to unite themselves and fight for the cause.
Please ... I do not want to offend people, just urging everyone to think really hard to solve the problem.

I came across this website last year in November. I got active in December, and contributed, and tried to get active in my state chapter.
When I come across posts that want to remove country caps, or some other measure that is going to be harmful to me, I have to stop and ask myself if I am shooting myself in the foot by supporting IV.
Its not about whats fair. Nor about what common sense is. Its about self-interest.
If we are increasing the size of the pie, then it benefits me (ROW) to be here. If we are to fight each other over crumbs, then it doesn't.

Denatured, looks like no one knows the exact answer. It's only the 2nd year we've had the lottery, and last year it was unexpected so not many people had 2 applications in.
If both of your H1s are approved, then I'd imagine you'd receive two approval notices with different company names on it. I believe you'd then have to choose which one you want to use for your visa stamp, and let the other company know you have to turn down their offer. I imagine they won't be happy about it, but it's your right and if you want to be ethical you can offer to refund their H1B filing fees.
I'm not an expert but from what I know the H1B is always issued for a specific person and a specific company. You are able to change the company on that visa, but the company cannot take the visa that was issued to your name and give it to another employee.

The picture you paint is very morose and depressing (and I sympathizes with you, so please do not get me wrong) and we hope that this whole situation that all of us are in turns out to be a bad nightmare and we wake up to see some hope again.

I think you can find a lot of people on the IIT forums that float around the web. I am sure we can find really successful(well almost) with sorry stories and restrained in career advancement due to EB retrogression.

I applied for my 2nd visa extension (1-year extension) after completion of 6 years in the middle of March 2007 (before I-94 expiry). My I-94 expired in the middle of March. I didn't hear from USCIS until the middle of July when they sent a huge list of request for evidence regarding my case (although I've been working on the same company's H1s for last many years now).
Meanwhile, I applied for adjustment of status on July 2nd as a beneficiary on my wife's application. If my H-1B gets rejected after sending the request for evidence for some reason now will I be out of status? Since my 180 days from my last valid I-94 will expire in the middle of September, is it a good idea to go on H4 before the middle of September and reenter the country?
In worst case, what will be my status if USCIS gets back to me, say in October, and says my H-1B extension application has been rejected?
Any input from UN or other gurus is appreciated.

Yes, that would suffice as a name change in the passport. My situation was as follows.
Passport:
Surname: Y**** Z****
Given name: X****
I requested for an observation from SFO consulate and got it corrected to the following format.
Surname: Z****
Given name: X**** Y****
I got this done through mail and these were the documents required
1. Passport
2. $10 Cashiers cheque
3. Miscellaneous service form
4. self addressed and prepaid usps envelope
5. Cover letter
I guess as long as you dont change the spelling of your name, you do not require an advertisement or affidavit for getting it corrected.
