I had a delay on a clients site, they needed something changed which took all my time. Business comes first. Here is my entry. I am dissapointed that my notebook PC won't be finished until Friday/Saturday, was looking forward to using it in the battle. The 3D Render was made by me.

A bit melodramatic, but i can relate to that. I lost one of my parents to this "US dream". But that is my personal problem.

"post office monthly income scheme" - that is good info i will definitely check on that.
In short as long as a person is on H1B he is no better than his indian counter part working in a multinational or maybe he is worse, atleast person in india is close to family ,spouse can work anywhere etc etc.
So the sooner the person gets GC the faster he has made his efforts worthwile - otherwise he will find his story similar to what sai posted in first article of this thread.

Each of us have a decent and true story. It has been a struggle here in US for all of us.
I spent a life's fortune and emigrated to Canada with wife and 2 grown up kids. In early 1999, a large multinational from Netherlands (think of TVs, bulbs and fans) lured me and others into coming to US on H1. They promised they will apply for permanent residency in 6 months. The company couldn't survive the consultancy business and folded operations by end 2000 and my application evaporated into the air.
Post 9/11, and at the height of tech and internet bubble, I was laid off by that company in their operations closing in late 2001. I also lost my Canadian permanent residency (because I stayed away from that country form more that 180 days). I was lucky enough to get a decent job in late 2001. This large global company is a gem of its own; they also promised they will apply GC in 3 months. Thus my PD is EB3 Nov 2001.
I am always for writing one's experiences so that others know how to avoid them, if they are smart enough. That's all I have got.

And I do not think we should be ashamed of the fact that this great country screwed us and made more than half a million highly educated and trained people (spouses included) chasing for a decade a mirage called GC and looking like idiots.

Somewhere in these forums I read somebody�s suggestion to rename the organization to legal-immigrants-first, or a similar sounding name. It may sound wholly redundant exercise to many of us, who are living the retrogression problem everyday, but it will make real difference in achieving our goals. We must first clearly identify and register ourselves in the eyes of leader of this country, before letting them know of our problems.

Friends I think a great injustice is being done to NSC filers , their applications are taking months for ead and ap, while TSC filers are getting ead adn AP as soon as they get receipt, do you think this will improve for NSC in future, at this time looks like august NSC filers will haveto wait till the end of the year for EAD,ap, which is sad.

What word we should use for july 2 filers who r still waiting for receipts as july 23 or later or even early august filers getting the receipts. People who got their receipts already boarded the bus, it is just a matter of time when they gill get the seat. People who haven't even got their receipts are still waiting for the next bus. Many people are worried that they might even miss the bus (Fearing that their application may be rejected).

That's not true, as per my attorney. When you are on the 7th yr of your H1 the only reason for the you get the 3 year extention on the H1 based on your approved I140 after filing your 485, is so that you won't be out of status even if your 485 gets rejected. You can still stay is status in US and appeal your 485.
Sorry, forgot to mention the MTR. If your I-485 AND MTR is rejected, my point still stands.

My wife is also in a similar situation. She went for stamping on Feb 1st and then she received a 221g yellow form. We submitted the docs and we are just waiting for a response for more than 3 months. I researched quite a bit on this one, but there is no way to expedite this process. I even contacted the local senator. This is happening quite a bit now. If the case is genuine then it will get approved, but it might take some time.

That's why I was saying that if he did work for more than 180 days for the employer, his GC is safe. If not, it can be rescinded if the employer appeal to the I-140 denial of the labor sub. and tries to prove that the original beneficiary is a "fraud".
It can happen to anyone. So to be on the safe side, work for the original petitioner for more than 180 days. If the petitioner is a GC factory, then both beneficiaries will suffer.
Yeah, it's good to know that AC21 works and that one labor is not used to produce many GCs.

If it’s small consulting firm with a mom-pop type attorney just be very care-full! I was in same situation in 2001 my H1B pimp promised me that my LC was filed but they were waiting to put me behind 2001 May 31 (all 245(i)) and that’s what they did....that LC is probably still somewhere in PBEC ...well I was new to the game and I ended up wasting almost 5 years on that.
Another story - my wife's consulting firm promised her that if she pays for LC they will continue her GC even if she joins the client we paid almost $7000 for LC it finally got approved probably few months back when attorney and employers stopped returning her call and e-mail. She contacted PBEC and we found that LC was approved...I'm sure they sold it someone else like us.
Anyone needs name of these two consulting firms just PM me

My Lawyer does whatever my employer tells him. They never give any receipt notice or approval notice to employees.
They did not even let me file my EAD and AP along with I-485.
I can file EAD/AP myself but I'm worried they might not give me the receipt notice of my I-485 filed in july, in a last ditch effort to prevent me from fleeing(I don't yet have any intention btw) or atleast make it difficult for me.
I'm sure there would be many in this situation.

If IV is successful with this 485 filing ability by 2/15 deadline thing... when does it become law and more importantly how soon can we file for 485 (before or after the CIR wars in Mach-September)?

I am not saying we shud do anything forcefully. I am saying, that if we have to show IV's face as being multicultural and since we Have members from all over the world sharing ideas on here anyways, might as well show the media that aspect.
In my opinion, if general public/law makers see faces from all over the world complaining about the GC system, it would have more impact.
If a core member/moderator can comment on this, that would be greatly appreciated.
