well..I have been waiting for my labor certifcation to get certfied for too long. just after Sep 11 I applied both for US GC and Canadian PR. My wife also applied for her GC. meanwhile her GC moved to regional when suddenly DOL thought it was time to regroup and there it went into BPC. In the meantime we got canadian PR some 2 years ago but we did not move thinking that we have jobs here.Then she got pregnant and lot of complications ( premature labor) and during those complications her company got acquired by another bigger firm who thought they don't need her..and result was job loss plus GC into the trash....meanwhile my labor certification even after 5 years was still sleeping in EB3 category(PD Oct, 2001) when i still have Masters( god knows why my lawyer put into that category)..Now my canadian PR was set to expire in march, 2007..so I thought i should decide fast..and i applied for jobs..and I got offer in vancouver with moving expenses paid from califronia..It has been the toughest decision because my employer is Indian here in california..and I have had good growth(10% average) but not the way I had wanted..I guess he also exploits..Indian exploiting another Indian..because they know I am not going anywhere..plus we work hard.. I asked him to match what was being offered in vancouver..and he started converting CAD into USD..well..it is not fair..So I have decided to heck with US and the Employer..and move on...at least I can come back..it is not an easy move because my son being premature child had lot of free facilities in california..hopefully he will get the same in Vancouver until he gets to 3 years ..and then it stops..

Wow, I am really excited about all the support!
I know that with the weather up north (yep, I am in the deep south) it may seem impossible to train/run/walk now, but you can run indoors on a treadmill, cross train on the elliptical machine and even use indoor running tracks. At my gym, I manage to do 8 mile training runs on the indoor track, guys that is 81 laps around this itty bitty track! :) Nutty? yes; but when you are motivated, you can find a way.
The three national events we pick can be for later in the year, but each Team IV member can run local events (weather permitting) accross the country. The fundraising can be 3 events per Team IV member per year. That would be in keeping with the 3 national events we pick.
My idea is for Team IV members to host a targetted fund raising campaign - which is divided into 3 events over the span of 1 year. I have a host of ideas to present on activities you can do and you only have to choose 3 of them for the year. We can get into these details after I run my ideas by the Coordinator Group.
I am going to set up the Group this week, so those who have responded to me, look out for my e-mail from my yahoo account.
Let me just say this much for now. I have run several long distance races over the past 10 years in the US and each and everytime that I have run for a cause, I found myself more motivated to train and I had more fun throughout the process.
Another point I should have made earlier. America today is concerned about obesity and "which is the fatest or more obese state in the nation". We are constantly seeing news articles and polls about these topics. Let it be know that the legal immigrant community of IV promotes a healthy lifestyle by its Team IV campaign. Another positive spin-off for our community and IV.

During the Fox news channel interview of Aman Kapoor, I heard the issue of Drivers licence renewal mentioned. I have heard that people who have one year or less than one year on their work permit have difficulty getting renewals.
Is that true and if yes, is it in every state?
Has IV mentioned this issue with the senetors etc as part of the backlog and retrogression issue?
Pls. post more details if you know. It would help us to be more aware and educated about this issue so that we can address this with more details when we contact other people and our employers.

...I don't mean to sound skeptical, but it is my firm belief (after watching the series of events over the last 8 months), that nothing is final till it's final.
Though, this kind of encouraging news pops up every now and then in the media - we have to (as part of the IV group), work toward getting our provisions passed in whichever Immigration Bill that is on the floor for discussion.
It's surprising that IV is the only group representing the "highly skilled group" and though 100s' of thousands have been affected by the "retrogression" phenomena, we have just about 9000 members...
Let's hope something concrete gets done, this year!

They won't be any better off here.Instead of being kicked out fair and square, they will be made to decay on H1 visas for 15-20 years. Talk of choosing a rock over a hard place. Besides, the British MPs seem to at least understand what skilled immigration means - here they will have the pleasure of being grouped with meat-packers and grape-pickers who matter-of-factly walked across the border.
I think its also a lesson for those tired of the US immigration system and considering moving to other countries - lets face it, immigrants are not exactly welcome anywhere. Either stick it out, or return to home country.

Thanks GotGC! Looks like it depends on the officer at the POE. Can I goto the local CBP office saying it was an error by the officer and get it updated? Anyways, I've an appointment with the USCIS official tomorrow and will update this thread on how it went.
I was in a similar, but slightly different, situation. I got my 3 year extension while my previous extension was still valid (a couple of days left).
So at the POE, the officer gave me on the I-94 a date that was 3 years from the date of entry (that's the max their system was designed to handle) and said that since I have the visa on the passport, the next time I reenter I would get the later date on the I-94.

We submitted our EAD application in June first week and we got our card this week, effective from last week of July for the next one year.
Our priority date is October 2006- EB2 and we are not current. So shouldnt we have been issued a 2 year EAD?
Also we gave our finger prints last year (July 2007 filer) but this time too both the EAD cards shows no FP available .
The EAD card of my spouse (he is the primary applicant says signature waived) I still have signature on my EAD card. Anyone else with the card that says signature waived. Previous card had his signature in there.

The main important thing is that the occupation classification of new job (onet classification) should be same or similar to old job. The same or similarity determination is based on comparing job descripion/duties of both jobs. The salary of the new job should be equal or more than prevailing wage for that occupation in the same level of orignal one in the area of new job. The prevailing wage can be obtained for a area, and for a level, in DOL web site.
For example, lets say prevailing wage of a software engineer level 2 in TX is 75K and for Bay area in CA is 120K. If a guy works for fortune 500 in TX and moves to small bussiness in bay area, still he/she has to meet the PW in that area. The AC21 job change from TX to CA should satisfy the PW in CA irrespective of employer size.
The justification of wage difference based on employer size and profit will not work.

What does this mean. The lady didnt have any information on name check. Seems like there is no way of knowing anything about name check!:mad:
Yeah sadly, there is no way to know. Even I am desperate to find out how one can know if they have cleared name check. I happened to know this from my friend - Get an infopass appointment and maybe an immigration officer might be willing to help you. I don't know how far this is possible since I HAVE NOT TRIED IT. But could be one of the options. More discussions from other experts might help.

I guess when it comes to GC processing, NOTHING is really "wrong" is it? If you get a chance to work around and beat the long lines, I guess "It's all good". Some people are lucky that they get a chance to get Labor Sub, some ppl marry the GC and some ppl like the rest of us wait in line like "honest citizens".
The REAL question is, just how many of us would have refused a good labour sub, given the present conditions, solely on the basis that "it is unfair to others"? I know i would have taken it. Reason? It's LEGAL (or used to be). Our "misfortune" (if i can use that word), is that we did not get a similar chance.
For those wondering, what I am babbling about: "Let's not look down on this guy who got his GC approved by Labour Sub, or even continuously point out that he did."
Fellas, I exactly understand your pain you feel when you see a person like me with Labor Substutute ending GC journey in 3 years.
I know my words are not going to change your opinion or make your pain feel less but be rest assured that i had gone thro same agony and distress as you during this immigration process for past 10 years. I entered USA as F1 in Aug/1997. I had been legally working (ResearchAssistant/OPT/H1) eversince. Before that I had 3 years of experiance in top indian company as an engineeer. Many of my Batch mates have received their GCs 4-5 years ago. So logically i should have got my GC then since i had alredy busted by B*** enough so that USA economy gets benefitted.
I coulnnt get GC because i was late in applying. Are you going to now say that simply because i was late in applying to GC, my efforts put in job for my employer are worthless to get an immigrant benefit?
I put the same point to my employer who rightfully agrreed with it and helped me with a labour substitute. I am sure if you had a valid case , a genuine USAbased employer would have done the same to you.
Anyways, I belive all of those who had applied GC after July VB will get their cards within next 6 months due to economics of situation. USA is on the verge of reccession right now lead by crappy housing market. The USA government does understand that EB based immigrants do have a (lot of) money and if they pump that money in USA economy , the recession could be avoided/be less severe. Also Conservative Bush administration people ( lIke Attorney General Alberto Gonzales) are resigning and are being replaced by less fanatic administrators. So (artificial) crapy things like Namecheck can not be cooked anymore. This will result in many many apporvals. Trust me no one can ask feds if thay give millions of GCs to legal immigrants (Off course the converse is not true- yaa the VB scenario) so expect your approval soon.

Haha. That is an accurate assessment at a 50-foot level. I was pretty disillusioned after a couple of years of working. A mixture of what the fuck am I doing, but not really knowing what to do, and all confused because I was at probably the biggest firm around and and a feeling of even if I switch, what's the point? And not having the balls to switch jobs, for the fear of throwing away what I had, mixed with personal struggles with life and not having the social life that I wanted.
In between all this, the desire to get the GC process kicked off came and went, esp. since I wanted to switch positions to a more people oriented role, and the feeling of gosh, do I want to stay in 6+ years in this job - maybe if I file, then I won't want to change jobs.
As you can see, even I am not sure what was going on there. But my personal life and acclimatizing has sorted itself out rather well of late, and I do want to stay here now that I have a really interesting life (and partly out of fear of throwing everything away and moving somewhere new).
Now, I know that IV is not a self-help trauma group, so I will cut short my story here, which has little to do with the raw facts of my immigration situation :)
And yes, I did not participate or know much about the visa process, or IV till recently, and am a recent need based participant, but I hope that does not stop anyone from contributing their ideas to help me out.

UPDATE: My company attorney suggested talking about this in April, and I am nervous about waiting till then in limbo - things are only going bad to worse, I might as well find a job at a place which will sponsor a PERM sooner rather than later.
I request you to PM me if you have any leads for such companies might still be a good bet for filing a PERM.

UPDATE: My company attorney suggested talking about this in April, and I am nervous about waiting till then in limbo - things are only going bad to worse, I might as well find a job at a place which will sponsor a PERM sooner rather than later.
I request you to PM me if you have any leads for such companies might still be a good bet for filing a PERM.

Yes, you may be better of in a smaller private owned companies that will do perm and are in a strong position. This downturn will get worse...Even if you want to wait and see what your attorney has to say in April, you can try to look for other jobs and be ready with options..
